[1976 Code § 61-1]
As used in this chapter:
COLLECTOR
Shall mean any person engaged in the business of collecting
refuse in the Township.
GARBAGE
Shall mean animal and vegetable wastes resulting from the
handling, preparation, cooking or consumption of food.
PLANT CLIPPINGS
Shall mean that portion of a plant which is separated from
the plant by cutting, trimming or pruning.
REFUSE
Shall mean all putrescible and nonputrescible solid wastes,
except human and animal excretions, including garbage, rubbish, trash,
ashes, plant clippings, street cleanings and solid industrial wastes.
RUBBISH
Shall mean nonputrescible solid wastes consisting of both
combustible and noncombustible materials, such as paper, cardboard,
tin cans, wood, glass, bedding, crockery, ashes and similar materials.

It shall be unlawful for any person to transport upon the public
streets in the Township any refuse or other waste materials in any
open cart or vehicle or in any manner whereby any refuse or other
waste materials may fall from the cart or vehicle.

No vehicle shall be used by any collector for the transportation
of refuse or other waste materials within the Township until such
vehicle has been inspected by the Sanitarian or his agent to determine
whether the vehicle may be closed or covered so as to prevent refuse
or other waste materials from falling from or blowing from the vehicle.
The Sanitarian shall inspect each licensed vehicle at least once during
each twelve-month period.

Each collector shall deliver to the Sanitarian a liability insurance
policy for each vehicle to be covered by the license, which policy
shall remain in force for the period of the license, in the following
amounts: property damage, $5,000; personal injuries, one person, $100,000;
two or more persons, $300,000.

All vehicles transporting garbage shall be washed and cleaned
on both inside and outside at least once on each day that the vehicle
is used. All vehicles transporting refuse shall be kept free of dirt
and offensive odors and shall be washed and cleaned on both inside
and outside at least once every two weeks.

Any vehicle used by a collector for the collection or transportation
of refuse within the corporate limits of the Township shall be stored
in a garage when the vehicle is not in use and is within the corporate
limits of the Township.

Any person who shall violate this chapter shall be subject upon conviction to the penalty stated in Chapter
BH1, Section
BH1-2.

Any person collecting or transporting refuse or other waste
materials within the Township shall be subject to the "Anti-Noise
Ordinance of the Township of Holmdel."

No person shall collect, transport, load or unload any refuse
or other waste materials excepting during the hours of 6:00 a.m. and
7:00 p.m. (prevailing time) Monday through Saturday.

Each collector shall notify each person from whom the collector
is to collect any refuse or other waste materials of the time, within
two hours, and of the day of the week, when the collection is to be
made from that person.

All refuse or other waste materials being placed for collection shall be placed at the curbline of the property for collection. If the property has a driveway touching a public street, the refuse or other waste materials shall be placed on that portion of the curbline that borders a side of the driveway touching the public street. No person shall place refuse or other waste materials or any trash or garbage container at the curb, except upon a day upon which that person has been notified, pursuant to subsection
BH7-3.3, that a collection will be made. All containers used for storage of refuse or other waste materials shall be removed from the curb and stored on the property of the person owning or controlling the containers on the same day on which the refuse or waste materials are collected.
