Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the New Jersey Statutes shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police and/or the Township Engineer is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he finds that such closing is necessary for the preservation of public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police or the Township Engineer and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressed provided by New Jersey Statute, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $50 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Township of Holmdel are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other, more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S. 39:4-138, any other New Jersey Statute or as hereinafter provided.

a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his absence, the ranking police officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire, large events, or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.

b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.

a. 
It is the purpose and intent of this subsection, in the interest of public safety and the general welfare of the Township, to facilitate snow removal from curb to curb on public streets of the Township as efficiently and expeditiously as possible after a snowfall.
b. 
As used in this section, the term "snow" shall mean any precipitation depositing any accumulation on the public streets of the Township, including, without limitation, snow, sleet, hail, or ice.
c. 
Notwithstanding any ordinance or regulation to the contrary, no person shall park a vehicle upon either side of a public street or allow any portion of a vehicle to extend into a public street at any time from when snow has covered the public roadway sufficient to obscure road markings or the road surface. Upon such conditions, the foregoing parking restriction shall remain in effect for a period of 12 hours after the snow has ceased, subject to extension by the Township Administrator, Chief of Police, or Director of Public Works in the event that snow removal has not been completed during that time period.
d. 
Regulatory and warning signs in accordance with N.J.S.A. 39:4-138 shall be erected and maintained at major street entrances to the Township for motor vehicles, and shall be deemed adequate for enforcement of the provisions of Subsection C. Any extension of the parking prohibitions pursuant to Subsection C shall be deemed effective upon notice prominently posted on the Township website and transmitted via prerecorded telephone message to Township residents.
e. 
The Township Administrator, Chief of Police, and Director of Public Works, and their respective designees, shall have the authority, at their discretion, to waive or modify parking regulations, including hourly limits, permit fees, and parking prohibitions, at all municipally owned or controlled parking lots during a declared snow emergency, or at such time as storm warnings have been issued by a recognized weather service, or a reasonable basis otherwise exists to anticipate an accumulation of snow greater than two inches.
f. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage, which may result from such removal, before regaining possession of the vehicle.
g. 
Any person violating the provisions of this subsection shall, upon conviction thereof, be punished by a fine of $100 for the first offense, and a fine not to exceed $500 for each offense thereafter occurring within six months of the previous offense. Each day on which a violation of this subsection exists shall be considered a separate and distinct violation and shall be subject to imposition of a separate penalty for each day of the violation as the Municipal Court Judge may determine.

No person shall park, or cause to be parked, any commercial motor vehicle, non-commercial truck, truck, omnibus, school bus, pole trailer, trailer, or recreational vehicle with a gross vehicle weight of four tons or any camper, recreational vehicle, boat or utility trailer, regardless of weight, on any Township street at any time.
b. 
Exceptions. The provisions of paragraph a shall not apply to any vehicle which is parked upon any street for the purpose of loading or unloading supplies, materials, foodstuffs or other such items or construction vehicles during construction. The operator, owner, or person in possession of the vehicle shall be responsible for any violation of this subsection.

Pursuant to N.J.S. 40:67-16.1, the streets or parts of streets as described are hereby designated as Route for Vehicles Over Four Tons. All trucks having a total combined registered gross weight of vehicle plus load in excess of four tons shall be excluded from all streets, except from those streets listed which form a part of the system of truck routes. Vehicles will be permitted on all streets for the purpose of the pick up and delivery of materials.
The provisions of this section shall not apply to any vehicle of the Police or Public Works Departments of the Township of Holmdel nor to any fire truck, hospital ambulance and vehicles of any public service corporation while the operator of such vehicle is operating the same in an emergency or in the necessary performance of public duties, nor to school buses transporting children to and from school.

No person, other than those persons who have been issued special vehicle identification cards by the Division of Motor Vehicles, pursuant to N.J.S. 52:27D-119 et seq.; N.J.S. 39:4-197.5; 39:4-204 et seq., or a temporary handicap placard issued by the Chief of Police pursuant to N.J.S. 39:4-206, or any other applicable law, shall be permitted to park a vehicle upon any public or private property appropriately marked for vehicles for the physically handicapped unless the vehicle is authorized by law to be parked therein and a handicapped person is either the driver or a passenger in that vehicle.

Any person, firm or corporation found guilty in the Municipal Court of the Township of Holmdel of a violation of the terms of this section shall be subject to one or more of the following in the discretion of the Municipal Court Judge: imprisonment in the County jail or in any place provided by the municipality for the detention of prisoners, for any term not exceeding 90 days or by a minimum mandatory fine of $100 for the first offense. For subsequent offenses a fine of at least $100 and up to 90 days community service on such terms and in such form as the Court shall deem appropriate, or any combination thereof.

Pursuant to the authority granted to this municipality by N.J.S. 39:4-197, the following locations are hereby designated as restricted parking spaces for the use by persons who have been issued a special vehicle identification card by the Division of Motor Vehicles. The Township Committee finds and declares that problems of traffic control occur when traffic must be moved through or around street construction, maintenance operations, and utility work, above or below the ground which requires blocking the street and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safe and expeditious movement of traffic through and around construction and maintenance zones and to provide safety for the work forces performing these operations.

The Manual on Uniform Traffic Control Devices for Streets and Highways, hereafter known as M.U.T.C.D., is hereby adopted by reference, except as hereby supplemented and amended, as it controls and regulates whenever construction, maintenance operations or utility work obstructs the normal flow of traffic. Any person, contractor or utility that fails to comply with the provisions of the most current version of the M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or public utility operating pursuant to a public utility agreement, N.J.A.C. 16:25-2.1, wishing to conduct work (hereinafter the "contractor") on, under or above the street to contact the Holmdel Township Police Department in order to arrange a preconstruction meeting and submit plans for the safe movement of traffic during such period of construction work. The preconstruction meeting and submittal of plans shall take place no earlier than five working days prior to the requested start of such work. The Chief of Police, or his designee, shall have discretion for the scheduling of such meeting if requested earlier than five working days prior to the requested start of such work or during emergency situations. Prior to the start of construction operations, the contractor shall assign a supervisory-level employee to serve as the Traffic Control Coordinator. The Holmdel Township Police Department shall be notified as to the name of this individual, along with a method of contacting the individual on a twenty-four-hour, seven-day-a-week basis, before or at the preconstruction meeting. Any contractor that fails to comply with this section prior to the start of such work or whose plans are not submitted to and reviewed by the Police Department of the Township of Holmdel is in violation of this section.

The person, contractor or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact must be made, or if the emergency contact person does not respond to the call from the Police Department to correct such hazardous condition, the Township may respond to correct such hazardous condition(s). The reasonable fees for such emergency services by the Township of Holmdel shall be charged to the person, contractor or utility responsible for such condition.

There shall be no construction, maintenance operations or utility work on any roadway in the Township before the hour of 9:00 a.m. or after 4:00 p.m. The officer in charge of the Township Police Department may adjust this time limit to permit work prior to 9:00 a.m. or after 4:00 p.m. If the officer in charge determines that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

a. 
The Holmdel Township Police Department and/or the Township Engineer is hereby authorized to provide by regulation for the establishment of a work zone, including but not limited to the detour and/or closing of any street or portion thereof to motor vehicle traffic, whenever they find that such closing is necessary for the preservation of public safety, health or welfare.
b. 
All street closings shall be discontinued and the area under construction reopened to traffic at the conclusion of a work day until work begins the following work day. This shall include the contractor ensuring that all of his or her equipment and materials are removed from the roadway, the road clear of debris and all raised manholes, inlets, and other appurtenances have traffic control devices (i.e., drums) placed over them. In the event that the manhole, inlet or other appurtenance is in the middle of a travel way and the placement of a traffic device would impede the flow of traffic, the manhole, inlet or other appurtenance shall be ramped with fresh bituminous material (either cold or hot mix), and the use of millings to perform this operation shall not be permitted.
c. 
The foregoing provisions shall not apply to a contractor that obtains approval to maintain a street closing on a twenty-four-hour basis, which shall be subject to regulations set forth by the Holmdel Township Police Department and/or Township Engineer.
d. 
The Township shall not be liable for any actions or omissions by a contractor relating to performance of requirements set forth under this section, and the Township shall retain all immunities it possesses under all applicable laws, including but not limited to the New Jersey Tort Claims Act, N.J.S.A. 59:1-1 et seq.

Traffic control coordinators shall be certified by the American Traffic Safety Services Association (ATSSA) or equivalent. Certification shall be provided to the Holmdel Township Police Department prior to start of any construction when working at a construction or utility site. Township Police, or their designee, shall be posted at all construction or maintenance sites on Township roadways when determined by the Holmdel Township Police Department that it is necessary to provide for the safety and expeditious movement of traffic. All costs connected with such traffic controls shall be at the cost of the applicant/independent contractor.

The Township Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

a. 
It is to be expressly understood that no materials, vehicles or equipment are to be placed in the roadway or sidewalk until all construction signs, light devices and pavement markings are installed.
b. 
The contractor shall be responsible for maintaining driveway access for all adjacent property owners. In the event that driveway access must be temporarily denied, the contractor shall provide written notice to the Holmdel Township Police Department and affected property owner(s) at least five working days in advance of the driveway closing.
c. 
The contractor shall present to the Holmdel Township Police Department's Traffic Safety Unit all traffic control devices and materials necessary to execute proper maintenance and protection of traffic operations for the project, as well as the number and type of traffic control devices deemed necessary by the Holmdel Township Police Department's Traffic Safety Unit. The contractor shall have all traffic control devices and materials present for examination at least five working days prior to the start of work.
d. 
All traffic control devices supplied are to be new or in satisfactory condition. Traffic control devices damaged under the work contract as a result of carelessness or mishandling by the contractor (i.e., running over cones or barrels with his equipment or splashing tar on traffic control devices, etc.) shall be replaced by the contractor within five working days.

The Holmdel Township Police Department's Traffic Safety Unit reserves the right to reject any traffic control device which, in its sole discretion, does not satisfy the criteria of M.U.T.C.D. specifications, is damaged, or is otherwise incapable of providing the function for which it was intended. In such case, the contractor shall replace the deficient traffic control devices and/or materials within two working days.
f. 
If the contractor completes work pursuant to a public contract with the Township of Holmdel, and the contract provides for the Township gaining possession of traffic control devices, all traffic control devices and materials used therein shall become the property of the Township at the conclusion of the contract term.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100, nor more than $500 and/or be imprisoned in the County jail for a term not exceeding 90 days; for a second offense, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County jail for a term not exceeding 90 days. A separate offense shall be deemed committed on each day during or on which violation occurs or continues.
