It is hereby determined, declared and found that within the
confines of the municipality there is an amusement park. This amusement
or entertainment area within the customary understanding of said terms
is defined as that land area known as "Land of Make Believe."

It shall be unlawful for any person, firm or corporation to
own or operate within this municipality any amusement game or games
as said terms are defined by said Amusement Games Licensing Law (P.L.
1959, c. 109), whether said game or games are of skill or chance or
both and whether said game or games are played and operated with or
without numbers or figures, without first having obtained a license
from the Township Committee of the Township of Hope to do so. Said
license shall be issued pursuant to and subject to the provisions
of the Amusement Games Licensing Law (P.L. 1959, C. 109).

Each applicant for such license shall fire with the Municipal Clerk a written application in such form as prescribed by and in accordance with said Amusement Games Licensing Law, as amended and supplemented, and the rules and regulations promulgated by the Amusement Games Control Commissioner of the State of New Jersey. Licenses shall only be issued with respect to the conduct or operation of Amusement Games within the amusement or entertainment area as defined in Section
21-1 of this Chapter.

a. The amusement games which may be licensed by the Township Committee
pursuant to this Chapter shall be limited to those presently certified
by the State of New Jersey Department of Law and Public Safety, Division
of Consumer Affairs, Legalized Games of Chance Control Commission.
The fee for each license issued pursuant to this section shall
be $100 and said fee shall accompany the application for each such
license.
b. Arcade games issued pursuant to Certification No. 2, N.J.A.C. 13:3-7.9(a)(2),
may be licensed, permitted and allowed; provided that no more than
50 arcade games will be permitted under any arcade license.
c. A license must be obtained for the operation of each amusement game;
except that up to 50 arcade games may be operated pursuant to a single
arcade license. The annual fee for each arcade license shall be $200.
d. The Township of Hope expressly reserves the right to license amusement
games other than the ones described herein and to establish fees therefor
for use in the area designated in accordance with the requirements
set forth in this Chapter. The games hereinafter licensed shall be
incorporated herein by reference thereto.
e. No more than 12 amusement game licenses and one arcade license shall
issue and remain in force and effect at any given time.

The Township Committee of Hope Township shall have and exercise
control and supervision over all amusement games held, operated or
conducted under such license, with all the powers authorized or granted
to it under the Amusement Games Licensing Law and all amendments and
supplements thereto and the rules and regulations of the State Amusement
Games Control Commissioner.

Forfeiture of any license, and penalties for any violations
of this Chapter, shall be governed by applicable provisions of the
Amusement Games Control Law and administrative regulations promulgated
pursuant thereto.

If any portion of this Chapter shall be determined to be unconstitutional,
then the same shall not affect the remainder of said Chapter.

All ordinances or parts of ordinances inconsistent herewith
are hereby repealed but only to the extent of such inconsistency.

This Chapter shall take effect upon final passage and publication
as provided by law, and acceptance by the Amusement Games Control
Commissioner as required by law.
