That from and after the adoption of this Article female chickens
will be allowed to be kept and raised on any residential property
in the City limits of the City of Canton, Missouri.

A. The
maximum number of chickens allowed will be five (5) chickens per household.
A household shall be determined based on water meter locations for
service from the City of Canton municipal water distribution system
to a residential property.
B. Only
female chickens are allowed. There is no restriction on chicken species.
C. If
a male chicken (rooster) is discovered to be among the flock, the
male chicken (rooster) must be immediately removed and not kept within
the City of Canton, Missouri.

It shall be unlawful to engage in chicken breeding, chicken
sales, sale of eggs, or the production of fertilizer for commercial
purposes within the City of Canton, Missouri.

A. Chickens
must be kept in an enclosure or fenced area at all times. During daylight
hours, chickens will be allowed to be at large within the fenced area
only if their flight from the fenced area is prohibited by an appropriate
enclosure.
B. During
non-daylight hours, all chickens must be secured within a henhouse
or chicken tractor.
C. All
areas where chickens are kept must be kept in a clean, dry, odor-free,
neat and sanitary condition at all times.
D. Henhouses,
chicken tractors, and chicken pens must provide adequate ventilation
and adequate sun and shade, and must be impermeable to rodents, wild
birds, and predators, including dogs and cats.

A. Henhouses
and chicken tractors shall be designed to provide safe and healthy
living conditions for the chickens while minimizing adverse impacts
to other residents in the neighborhood.
B. A henhouse
or chicken tractor shall be enclosed on all sides and shall have a
roof and doors. Access doors must be able to be shut and locked at
night.
C. Openings,
windows, and vents must be covered with predator and bird proof wire
with the wire having openings no larger than one (1) inch.
D. The
materials used in making a henhouse or chicken tractor shall be uniform
for each element of the structure such that the walls are made of
the same material, the roof has the same shingles or other covering,
and any windows or openings are constructed using the same materials.
The use of scrap, waste board, sheet metal, or similar materials is
prohibited. Henhouses and chicken tractors shall be well maintained.
E. Henhouses,
chicken tractors and chicken pens shall only be located at the rear
of the residential unit main structure in the rear yard thereof.
F. Henhouses,
chicken tractors, and chicken pens must be located at least ten (10)
feet from the property line and at least twenty-five (25) feet from
any adjacent residential dwelling, church, school, or place of business.
G. Any
enclosed chicken pen shall consist of sturdy wire or wooden fencing
and the pen must be covered with wire, aviary netting, or solid roofing
to prevent chickens from flying from the pen.

A. Odors
from chickens, chicken manure, or other chicken related substances
shall not be perceptible at the property boundaries.
B. Perceptible
noise from chickens shall not be loud enough at the property boundaries
to disturb persons of reasonable sensitivity.

The chicken owner shall take necessary action to reduce the
attraction of predators and rodents and the potential infestation
of insects and parasites. Chickens found to be infested with insects
and parasites creating unhealthy conditions to human habitation shall
be immediately removed from the City of Canton by the chicken owner.

Chickens shall be provided with access to feed and clean water
at all times. The feed and water shall be unavailable to rodents,
wild birds and predators.

A. The
chicken owner must provide for the storage and removal of chicken
manure.
B. All
stored manure shall be covered by a fully enclosed structure with
a roof or lid over the entire structure. No more than three (3) cubic
feet of manure shall be stored.
C. All
manure not used for composting or fertilization shall be removed from
the premises and the City of Canton.
D. The
henhouse, chicken tractor, or chicken pen and surrounding area must
be kept free from trash and accumulated droppings. Uneaten feed shall
be removed in a timely manner.

A. Chickens
shall not, at any time, be allowed to be at large within the City
of Canton, Missouri, and must, at all times, be kept entirely within
the chicken confinement area on the property of the chicken owner.
B. No
dog or cat which kills a chicken will for that reason alone be considered
a dangerous or aggressive animal.

A. Every
person placing chickens on residential property within the City of
Canton shall obtain an annual written permit from the City prior to
placing chickens on such property. The permit must be reapplied for
on the anniversary date of the original permit each year that chickens
are to be kept on the property described in the permit.
1. A written application for the permit must be submitted to the office
of City Clerk, together with an application fee of fifteen and no/100
dollars ($15.00) which is being collected to offset the cost of processing
the application.
2. The application will be submitted on an application form provided
by the City.
3. The application shall state the name and address of the person requesting
the permit, including the precise location where the chickens will
be maintained.
4. The applicant will give irrevocable permission to Police Officers
of the City of Canton, Missouri, to enter upon the property where
the chickens are being kept, without necessity of further consent
or warrant, to periodically inspect the property for compliance with
this Article or to investigate any complaints about the applicant's
property not being in compliance with the terms of this Article.
5. The applicant, in the application, will state, under penalty of making
a false affidavit or declaration, that the applicant has read and
is thoroughly familiar with the terns and requirements of this Article.

A. It
shall be unlawful for any person to keep chickens in violation of
any provision of this Article.
B. It
shall be unlawful for any owner, renter, or leaseholder of property
to allow chickens to be kept on the property in violation of the provisions
of this Article.
C. No
cockfighting will be allowed within the City of Canton.

Any violation of this Article that constitutes a health hazard
or that interferes with the use or enjoyment of neighboring property
is a nuisance and may be abated under the general nuisance abatement
provisions of the Municipal Code of the City of Canton, Missouri.

Each day that a violation of this Article continues is a separate
violation.

A. Any person, firm, or corporation who shall fail to comply with the requirements of this Article shall, upon conviction, be subject to the penalties provided for in Section
100.220 of the Municipal Code of the City of Canton, Missouri.
B. Any
person, firm, or corporation convicted of or who shall plead guilty
to a violation of this Article shall be ineligible to receive a permit
to place chickens on any property within the City of Canton, Missouri,
for a period of fifteen (15) years after the date of the conviction
or entry of the plea of guilty.
