To provide certain minimum standards, provisions, and requirements for property maintenance, upkeep, repair and renovation, safe and stable design, methods of construction, and uses of materials in buildings currently existing and hereafter erected, constructed, enlarged, altered, repaired, relocated, and converted, the International Property Maintenance Code, 2018 Edition, printed in book or pamphlet form is hereby adopted and incorporated by reference as though printed in full herein insofar as said code does not conflict with the Statutes of the State of Nebraska. One copy of the Property Maintenance Code, as amended, is on file at the office of the Municipal Clerk and is available for public inspection at any reasonable time. The provisions of the Property Maintenance Code shall be controlling throughout the municipality and throughout its zoning jurisdiction. To the extent that any provision of the International Property Maintenance Code conflicts with or is more specifically addressed or defined in other parts of the Ralston Municipal Code, such other parts of the Ralston Municipal Code shall take precedence. Except as modified by these local amendments, The International Property Maintenance Code shall apply to all existing residential and non-residential structures within the City of Ralston.

The 2018 International Property Maintenance Code is hereby amended, altered, modified and changed in the following respects:
Section 101.1: Title. These regulations shall be known as the Property Maintenance Code of the City of Ralston, Nebraska, hereinafter referred to as "this code."
Section 103.5 Fees. The fees for activities and services performed by the department in carrying out its responsibilities under this code shall be as indicated upon a fee schedule adopted by resolution of the governing body from time to time.
Section 111.1 Application for appeal. Strike "board of appeals" and replace with "board of health."
Section 111.2 Membership of board. Strike section in its entirety and substitute the following language. "The Board of Health shall be appointed by the Governing Body as required by Ralston Municipal Code § 2-104, and shall consist of five members. The members of the Board shall include the Mayor, who shall serve as chairman; the Police Chief, who shall serve as secretary and quarantine officer; a physician who shall serve as the medical advisor; and the President of the City Council and one other member.
Section 111.2.1 Alternate members. Strike subsection in its entirety.
Section 111.2.2 Chairman. Strike subsection in its entirety.
Section 112.4 Failure to comply. Violation of a stop work order including the continuance of any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall constitute a misdemeanor. Any person who violates this ordinance or fails to comply with any of its requirements shall upon conviction thereof be fined not more than $100 or imprisoned for not more than 30 days, or both, and in addition shall pay all costs and expenses involved in the case. Each day such violation continues shall be considered a separate offense.
Section 202: Definitions. Add the following definitions:
ELECTRICAL CODE: The electrical code for this jurisdiction shall be Section 9-801 of the Ralston Municipal Code and all codes adopted therein.
FIRE CODE: The fire code for the jurisdiction shall be Sections 7-201, 7-202, 7-202.01 of the Ralston Municipal Code and all codes adopted therein.
FUEL GAS CODE: The fuel gas code for this jurisdiction shall be NFPA 54 as adopted and enforced by the Nebraska State Fire Marshal.
ICC ELECTRICAL CODE: Wherever reference is made to the ICC Electrical Code it shall mean "Electrical Code." See definition for "Electrical Code."
INTERNATIONAL ENERGY CONSERVATION CODE: Whenever reference is made to the International Energy Conservation Code, it shall mean the International Energy Conservation Code as adopted and amended by this jurisdiction.
INTERNATIONAL FIRE CODE: Whenever reference is made to the International Fire Code it shall mean "Fire Code." See definition for "Fire Code."
INTERNATIONAL FUEL GAS CODE: Wherever reference is made to the International Fuel Gas Code it shall mean NFPA 54, as adopted and enforced by the Nebraska State Fire Marshall.
INTERNATIONAL MECHANICAL CODE: Whenever reference is made to the International Mechanical Code it shall mean "Mechanical Code." See definition for "Mechanical Code."
INTERNATIONAL PLUMBING CODE: Wherever reference is made to the International Plumbing Code it shall mean "Plumbing Code." See definition for "Plumbing Code."
INTERNATIONAL PROPERTY MAINTENANCE CODE: Wherever reference is made to the International Property Maintenance Code it shall mean "Property Maintenance Code." See definition for "Property Maintenance Code."
MECHANICAL CODE: The mechanical code for this jurisdiction shall be Section 9-802 of the Ralston Municipal Code and all codes adopted therein.
PLUMBING CODE: The plumbing code for this jurisdiction shall be Section 9-701 of the Ralston Municipal Code.
PROPERTY MAINTENANCE CODE: The property maintenance code for this jurisdiction shall be Section 9-601 of the Ralston Municipal Code and all codes adopted therein.
Section 302.4 Weeds. The language is stricken in its entirety and the language "see Ralston Municipal Code § 6-754" substituted therein.
Section 304.14 Insect screens. Strike "During the period from [DATE] to [DATE]" and begin sentence with "Every."
Section 602.3 Heat Supply. Every owner and operator of any building who rents, leases or lets one or more dwelling units or sleeping units on terms, either expressed or implied, to furnish heat to the occupants thereof shall supply heat during the period from September 15 to April 15 to maintain a temperature of not less than 68° F. (20° C) in all habitable rooms, bathrooms and toilet rooms.
Section 602.4 Occupiable work spaces. Interior occupiable work spaces shall be supplied with heat during the period form September 15 to April 15 to maintain a temperature of not less than 65° F. (18° C.) during the period the spaces are occupied.
