The Borough of Frenchtown, pursuant to N.J.S.A. 52:27D-119 et seq. and N.J.A.C. 5:23-4.3 hereby relinquishes its jurisdiction for the administration and enforcement of the Uniform Construction Code and hereby transfers jurisdiction for the administration and enforcement of the Uniform Construction Code to the Department of Community Affairs of the State of New Jersey. This section shall not take effect until the expiration of 120 calendar days from the date a certified copy of this section is forwarded to the Department of Community Affairs, or until the Department of Community Affairs shall exercise its jurisdiction to enforce the Uniform Construction Code, whichever is sooner.

The Borough of Frenchtown shall deliver or make available to the Department of Community Affairs any and all records and files of the municipality necessary for the Department to carry out its function, and the Department is hereby authorized to transfer such records and files to a location designated by the Department.

a. 
There is hereby established in the Borough of Frenchtown, a State Uniform Construction Code enforcing agency to be known as the Frenchtown Borough Construction Department, consisting of a Construction Official, Building Subcode Official, Plumbing Subcode Official, Electrical Subcode Official, Fire Protection Subcode Official, and such other subcode officials for such additional subcodes as the Commissioner of the Department of Community Affairs, State of New Jersey, shall hereafter adopt as part of the State Uniform Construction Code. The Construction Official shall be the chief administrator of the enforcing agency.
b. 
Each official position created in paragraph a hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, C. 217 (N.J.S.A. 52:27D-126 et seq. and as may be amended) and N.J.A.C. 5:23; provided that, in lieu of any particular subcode official, an onsite inspection agency may be retained by contract pursuant to N.J.A.C. 5:23. More than one such official position may be held by the same person, provided that such person is qualified pursuant to P.L. 1975, C. 217 and N.J.A.C. 5:23 to hold each position.
c. 
The public shall have the right to do business with the enforcing agency at one office location except for emergencies, and unforeseen or unavoidable circumstances. The office shall be within the Municipal Building of the Borough of Frenchtown.

Persons aggrieved by a decision of the enforcing agency may appeal such decision to the Construction Board of Appeals established by the Board of Chosen Freeholders of Hunterdon County.
a. 
The fee for a construction permit shall be the sum of the subcode fees listed in paragraphs a, b, and c hereof and shall be paid before the permit is issued. All construction permits will be rounded off to the nearest dollar on permits inspected by the Frenchtown Borough Construction Code official and the fees for subcode inspections by private on-site officials authorized by the Borough shall likewise be rounded off to the nearest dollar.
1. 
The building subcode fee shall be:
(a) 
For new construction other than agricultural, commercial, industrial, warehousing or related use buildings, as defined in paragraphs a1(b) and (c) below, the permit fee shall be based upon the volume of the structure. Volume shall be computed in accordance with N.J.A.C. 5:23-2.8(d). The new construction permit fee shall be in the amount of $0.027 per cubic foot of volume for buildings and structures of all use groups and types of constructions not covered paragraphs a1(b) and (c) provided that the minimum fee shall be $46.
(b) 
For additions, $0.027 per cubic foot of building or structure volume for the added portion provided that the minimum fee shall be $46.
(c) 
For renovations, alterations and repairs, $24 per $1,000 estimated cost up to and including $50,000 and $18 additional fee per $1,000 portion of cost $50,00.01 up to and including $100,000, plus an additional fee of $15 per $1,000 portion of cost above $100,000.01 provided that the minimum fee shall be $46.
(d) 
For combinations of renovations and additions, the sum of the fees computed separately as renovations and additions.
(e) 
For new constructions, additions, renovations or repairs to any building used for agricultural purposes, as defined in the Frenchtown Borough Zoning Ordinance, the construction permit fee shall be in the amount of $0.0008 per cubic foot of volume.
(f) 
For new construction of any building used for commercial, industrial, warehousing or related uses as outlined in the Frenchtown Borough Zoning Ordinance, the new construction permit fee shall be $0.015 per cubic foot.
(g) 
The fee for plan review shall be 20% of the amount to be charged for the construction permit and shall be paid before the plans are reviewed. The amount paid for this fee shall be credited toward the amount of the fee to be charged for the construction permit. Plan review fees are not refundable.
(h) 
The fee for the permit for demolition of a building or structure less than 5,000 square feet in area and less than 30 feet in height, for one or two family residences (R-3 Zone) and for structures on farms, including commercial farm buildings, shall be $65. The fee for the permit for the demolition of all other structures shall be $120.
(i) 
The fee for a permit for the removal of a building or structure from one lot to another or to a new location on the same lot shall be $25 per $1,000 of the sum of the estimated cost for moving for new foundations and for placement in a completed condition in the new location, provided that the minimum fee shall be $50 (this inclusion also for modular homes).
(j) 
The fee for a certificate of continued use occupancy for nonresidential uses shall be $120.
(k) 
The fee for a certificate of occupancy granted pursuant to a change of use shall be $120.
(l) 
The fee for a multiple certificate of occupancy shall be $50 per unit, regardless of use.
(m) 
The fee for a certificate of occupancy as a result of new construction, renovation, addition or the like shall be $28.
(n) 
The building fee for an above ground pool shall be $46 and the fee for an in-ground pool shall be $100.
(o) 
The fee to construct a patio, retaining wall, tennis court, all other playing courts, etc. shall be $46.
(p) 
The fee for a renewal permit for an expired permit will be the minimum fee of each subcode.
(q) 
The fee for a permit for the roofing, reroofing, siding or residing of an existing structure or any part thereof shall be $46 each.
2. 
Plumbing Subcode Fees. The fee to be paid for plumbing subcode permits, inspections and other services under the plumbing subcode shall be the fee charged by the current third-party inspection agency and in accordance with state law, plus a percentage thereof for an administrative fee as agreed to in the contract.
3. 
Electrical Subcode Fees. The fee is to consist of that charged by the authorized third-party inspection agency in accordance with State law, plus a percentage thereof for an administrative fee as agreed to in the contract.
4. 
Miscellaneous.
(a) 
The fee for code letters, research or information letters and related matters shall be $25, plus $0.75 per page.
(b) 
The fee for a permit for installation of an elevator shall be the fee as established by N.J.A.C. 5:23-4.20.
(c) 
The fee for the inspection of an elevator shall be the fee as established by N.J.A.C. 5:23-4.20.
(d) 
The permit fee for the construction of any building or structure by the Borough of Frenchtown or any of its respective agencies is waived.
(e) 
The fee for a photocopy of any document shall be $0.75 per page. In addition, general research for unspecified documents shall be billed at the rate of $25 per hour with a minimum fee of $25.
b. 
The Construction Official shall, with the advice of the subcode officials, prepare and submit to the Mayor and Common Council biannually, a report recommending a fee schedule based on the operating expenses of the agency, and any other expenses of the municipality fairly attributable to the enforcement of the State Uniform Construction Code Act.
c. 
In order to provide for the training, certification and technical support programs required by the Uniform Construction Code Act and the Regulations, the enforcing agency shall collect in addition to the fees specified above a surcharge fee of $0.0016 per cubic foot of volume or new construction. The surcharge fee shall be remitted to the Bureau of Housing Inspection, Department of Community Affairs, on a quarterly basis for the fiscal quarter ending September 30, December 31, March 31 and June 30 and not later than one month next succeeding the end of the quarter for which it is due. In the fiscal year in which the regulations first become effective, the fee shall be collected and remitted for the third and fourth quarters only.
d. 
The enforcing agency shall report annually at the end of each fiscal year to the Bureau of Housing Inspection and not later than July 31, the total amount of the surcharge fee collected in the fiscal year. In the fiscal year in which the regulations first become effective, the report shall be for the third and fourth quarters only.
The following fire limits are established pursuant to N.J.A.C. 5:23: All outside fire limits.

The Construction Official shall prepare and submit to the Mayor and Council, biannually, a report reevaluating the delineation of the fire limits. This report shall indicate the recommendations of the Construction Official, the Building Subcode Official and the Fire Subcode Official regarding those areas which should be designated as within fire limits with the reason therefore.

a. 
There is hereby adopted, by reference, the State Uniform Construction Code Act of New Jersey, P.L. 1975, c. 217 (N.J.S.A. 52:27D-119 et seq.) as may be amended, and the Construction Official and all subcode officials shall enforce the State Uniform Construction Code with all of the powers, functions and duties described by said Act and the New Jersey Administrative Code 5:23.
b. 
The Construction Official shall keep a detailed record of all applications and proceedings in said department and shall provide monthly reports to the Mayor and Common Council on those items within the department and as directed by the Mayor and Common Council, as well as the accounting for all fees received and submitted to the Chief Financial Officer of the Borough.
