There is hereby established a Cape May Point Environmental Commission for the restoration, preservation and development of the natural resources located in the Borough of Cape May Point, pursuant to the provisions of N.J.S.A. 40:56A-1 et seq.

The Mayor shall appoint the members of the Environmental Commission, which shall consist of no less than five nor more than seven members, one of whom shall also be a member of the municipal planning board and all of whom shall be residents or homeowners in the municipality, which members shall serve without compensation. The Mayor shall designate one of the members to serve as chairman of the Commission. The terms of office of the Commissioners shall be two members for one year, three members for three years, respectively from the date in the year in which said appointments are made and until the appointment and qualification of their successors. Any vacancy on the Commission occurring otherwise than by expiration of a term shall be filled for the unexpired term in the same manner as an original appointment. The Mayor shall also appoint two alternate members of the Commission which shall be designated as Alternate Number "1" and Alternate "2", the terms of which Alternate member shall be two years, except that the terms of the Alternate members first appointed shall be two years for Alternate number "1" and one year for Alternate number "2" so that the term of not more than one Alternate member shall expire in any one year. A vacancy occurring otherwise than by expiration of term shall be filed by the Mayor for the unexpired term only. An Alternate member shall not be permitted to act on any matter in which he or she has either directly or indirectly any personal or financial interest. An Alternate member may participate in discussions of the proceedings but may not vote except in the absence or disqualification of a regular member. A vote shall not be delayed in order that a regular member may vote instead of an Alternate member. In the event that a choice must be made as to which Alternate member is to vote, Alternate number "1" shall vote first. The Mayor or the Commissioners may remove any member, alternate member of the Commission for cause, on written charges served upon the member or alternate member and after a hearing thereon in which the member or alternate member shall be entitled to be heard in person or by counsel.

The Environmental Commission organized under the provisions of N.J.S.A. 40:56A-1 et seq. shall have power:
a. 
To conduct research into the use and possible use of the open land areas of the Borough;
b. 
To coordinate the activities of unofficial bodies organized for similar purposes;
c. 
To act as a coordinating agency on conservation problems with county, state and federal bodies;
d. 
To keep an index of all open areas, both privately and publicly owned, in order to obtain information as to the proper use of these areas and to recommend from time to time to the Board of Commissioners programs and plans for the care and development of such areas;
e. 
To study and make recommendations concerning all types of pollution and its control;
f. 
To study and make recommendations concerning waste disposal and litter control;
g. 
To prepare and distribute printed material, charts, maps or other material which would aid its purposes;
h. 
To manage donated lands and funds for conservation programs.
i. 
To study and make recommendations concerning open space preservation, water resources management, air pollution control, solid waste management, noise control, soil and landscape protection, environmental appearance, marine resources and protection of flora and fauna.

The Environmental Commission may, subject to the approval of the Board of Commissioners, acquire property, both real and personal, in the name of the Borough, by gift, purchase, grant, bequest, devise or lease, for any of its purposes, subject to the terms of the conveyance or lease. Such an acquisition may be to acquire the fee or any lesser interest, development right, easement, including conservation easement, covenant or other contractual right (including a conveyance with limitations or reversions) as might be necessary to acquire, maintain, improve, protect, limit the future use of or otherwise conserve and properly utilize land or property in the Borough. The Environmental Commission shall keep records of its meetings and activities and shall make an annual report to the Board of Commissioners. It may also make reports on request.

The Board of Commissioners may appropriate funds for expenses incurred by the Commission.
