[1988 Code § 88-1]
a. 
Pursuant to N.J.S.A. 52:27D-202, the New Jersey Uniform Fire Code shall be locally enforced in the Borough of Cape May Point.
b. 
There is hereby created a Bureau of Fire Prevention, which shall be a subsidiary unit of the Borough of Cape May Point. The local enforcing agency for the Uniform Fire Safety Act (N.J.S.A. 52:27D-192) shall be the Bureau of Fire Prevention.

The Bureau of Fire Prevention shall enforce the Uniform Fire Safety Act and the codes and regulations adopted under it in all buildings, structures and premises within the established boundaries of the Borough of Cape May Point, other than buildings owned or operated by the Federal government, the State or interstate agencies and other than owner-occupied one- and two-family dwellings, and shall faithfully comply with the requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

a. 
The Bureau of Fire Prevention, as the local enforcing agency, shall be under the direct supervision and control of the Fire Official, which said Fire Official shall be appointed by and supervised by the Commissioner of Revenue and Finance. In making this appointment, the Commissioner of Revenue and Finance shall consider any recommendations provided by the Fire Chief. The Fire Official shall be subject to removal for inefficiency or misconduct after an appropriate hearing.
b. 
The Fire Official shall serve for a term of four years during good behavior. Any vacancy shall be filled for the unexpired term.
c. 
The Fire Official shall appoint such inspectors as may be necessary in the Bureau of Fire Prevention and who shall be subject to removal by the Fire Official for inefficiency or misconduct. Each inspector or employee to be so removed shall be afforded an opportunity to be heard by the Fire Official or a designated hearing officer.

Pursuant to N.J.S.A. 52:27D-206 and 27D-208, a person aggrieved by any order of the Bureau of Fire Prevention shall have the right to appeal to the Construction Board of Appeals of the County of Cape May.
