Pursuant to N.J.S.A. 40A:9-136 there is created the office of Municipal Administrator to coordinate the administrative affairs of the Borough of Cape May Point, and to have such powers and to receive such compensation as hereinafter provided. The person so appointed as Municipal Administrator shall not, however, simultaneously hold the office of Municipal Clerk as established in Chapter 29, Section 29-15.

The appointment to the office of Administrator shall be made by the Board of Commissioners and shall be for a term of office at the pleasure of the Board of Commissioners.

The Municipal Administrator shall receive annual compensation as determined by the current salary ordinance, and shall enjoy those applicable benefits as provided in the Borough Code and the Personnel Policies and Procedures of the Borough.

The Municipal Administrator may be removed for cause by a two-thirds vote of the Board of Commissioners.

The office of the Municipal Administrator may be filled by resolution on either a full-time or part-time basis as may be determined by the Board of Commissioners to be in the best interests of the Borough.

The office of the Municipal Administrator shall, at a minimum, be experienced in local government affairs and administration as well as have demonstrated managerial skills, ability and experience.

The Municipal Administrator shall be the Chief Appointed Administrative Officer of the Borough, and shall coordinate the administrative affairs of all Borough departments, officers, employees, agencies and agents of the Borough. In addition, the Municipal Administrator shall specifically:
a. 
Be the principal appointed administrative official responsible for all public bidding, competitive contracting, negotiation of all employee contracts, as well as the administration of all other contracts for goods, services, or equipment;
b. 
Be responsible for the coordination of the municipal budget process;
c. 
Be responsible to carry out all Borough policies and procedures duly established by the Board of Commissioners, and to require compliance in accordance therewith;
d. 
Sign each departmental personnel transaction, which signature shall confirm compliance with all duly established rules and regulations and that said transaction is otherwise proper in all respects prior to any final action being authorized by each Department Head or member of the Board of Commissioners as the case may be;
e. 
Report directly to the Board of Commissioners as directed by the Board, and shall act as liaison to the Board with all federal, state and local agencies and offices;
f. 
Coordinate the maintenance of a sound personnel system, inclusive of all policies and administrative practices appertaining thereto;
g. 
Serve as Public Information Officer for the dissemination/communication of all duly established municipal ordinances, resolutions, and all other rules and regulations, including the preparation of any press releases in accordance therewith;
h. 
Serve as the issuing authority for all permits upon approval, as necessary or required, by the Board of Commissioners.

The Board of Commissioners has entered a shared services agreement for animal control.

The Board of Commissioners shall not appoint a Certified Animal Control Officer, shall not contract for animal control services with any company that employs a Certified Animal Control Officer, shall not contract for animal control services under any Interlocal Services Agreement with any other municipality, and shall revoke the appointment of a Certified Animal Control Officer, who has been found to have violated the provisions of N.J.S.A. 4:22-17, 4:22-18, 4:22-19, 4:22-19.1, 4:22-19.2, 4:22-20, 4:22-21, 4:22-22, 4:22-23, 4:22-24, 4:22-25.1 and/or 4:22-26 as amended. The Board of Commissioners may, by resolution duly adopted by the Board of Commissioners, prescribe rules and regulations for the administration of this procedure. A Certified Animal Control Officer who pleads guilty or who is adjudicated guilty of a violation of any of the above enumerated offenses in any Court of this State or in a Court of any other State, shall immediately notify the Municipal Clerk of such plea or conviction. In any event, written notification shall be provided to the Municipal Clerk indicating the date, place, court and nature of the conviction and the penalty imposed, not later than 10 days following the entry of such conviction. Failure to do so shall constitute a separate and distinct cause for removal from office.

Pursuant to N.J.S.A. 40A:5-4, the Borough Council shall employ a registered municipal accountant of the State of New Jersey to prepare an annual audit of its books, accounts and financial transactions of the Borough or shall enter into an agreement with the Director of the Division of Local Government Services for an audit to be made by the Division.

The position of Borough Engineer is hereby established in the Borough of Cape May Point.

Pursuant to the provisions of N.J.S.A. 40:72-7, the Borough Engineer shall be appointed by the Board of Commissioners. Unless otherwise provided by law, his term shall be fixed in the appointing resolution or three years. Pursuant to N.J.S.A. 40A:9-140, the Borough Engineer shall be required to hold a New Jersey Professional Engineer License, a Land Surveyor License and the Certified Municipal Engineer (CME) designation.

The Borough Engineer shall perform such duties as are assigned by the Board of Commissioners and shall be compensated for his services in such manner as the Board of Commissioners may provide.

The position of Borough Solicitor is hereby established in the Borough of Cape May Point.

Pursuant to the provisions of N.J.S.A. 40:72-7, the Borough Solicitor shall be appointed by the Board of Commissioners for such term as may be fixed in the appointing resolution. He shall be an attorney at law of the State of New Jersey but need not be a resident of the Borough of Cape May Point.

The Borough Solicitor shall perform such duties as are assigned by the Board of Commissioners and shall be compensated for his services as provided in the appointing resolution. Any additional compensation for extraordinary services shall be approved by the Board of Commissioners.
Pursuant to N.J.S.A. 40A:9-140.1 et seq., there is hereby created the position of Chief Financial Officer of the Borough.

The Chief Financial Officer shall also hold the position of Comptroller/Treasurer and shall fulfill all the obligations of a Municipal Finance Officer in accordance with N.J.S.A. 40A:9-140.1 et seq. and in accordance with N.J.S.A. 52:27BB-24 et seq.

The Chief Financial Officer shall be required to have a Municipal Finance Officer certification issued pursuant to the provisions of N.J.S.A. 40A:9-140.1 et seq.

The compensation for the Chief Financial Officer shall be fixed in the Salary Ordinance of the Borough.

Pursuant to N.J.S.A. 40A:9-140.10, the term of office shall be four years commencing January 1 of the year of appointment.

The Chief Financial Officer shall be responsible for carrying out the duties set forth in N.J.S.A. 52:27BB-26 et seq.
The Chief Financial Officer shall:
a. 
Receive funds entrusted, received or under the control of any department and deposit all funds received by him in depositories authorized by the Governing Body by resolution;
b. 
Have custody of all investments and invested funds of the Borough or in possession of the Borough in a fiduciary capacity, except as otherwise provided by law, and keep such funds and all moneys of the Borough not required for current operations safely invested or deposited in interest bearing accounts;
c. 
Have the safekeeping of all bonds and notes of the Borough and the receipt and delivery of the Borough bonds and notes for transfer, registration or exchange;
d. 
Keep a full account of all case receipts and disbursements of the Borough and at least once each month, or more often if the Governing Body requires, furnish the Governing Body with a statement of all moneys received and expended by him;
e. 
Be responsible to carry out all duties and functions provided for in N.J.S.A. 40A:9-140.1 et seq. and shall perform such duties as the Board of Commissioners may direct.

The Chief Financial Officer duties shall include:
a. 
The responsibility for the fiscal records of the Borough and shall advise and assist the Board of Commissioners with regard to fiscal planning and future financial recommendations;
b. 
Receiving funds entrusted to or under the control of any department and depositing all funds received in depositories authorized by resolution of the Governing Body within 48 hours after their receipt;
c. 
Transmission of all payroll data to payroll company bi-weekly;
d. 
Preparation of Bill List for approval at Board of Commissioner's Meetings;
e. 
Auditing receipts and disbursements of each department and requiring reports to be made at such intervals as will most efficiently protect the public interest;
f. 
Disbursing moneys for the payment of claims approved by the Board of Commissioners;
g. 
Authorizing the payment of bills, claims, demands and payroll upon the proper certification of the appropriate Director of the amount due and owing;
h. 
Keeping books and records of accounts for the exercise of financial budgetary control over each department.

The Board of Commissioners is authorized to appoint one or more suitable individuals to the position of Code Enforcement Official within the Borough. The person or persons so appointed shall serve in either a full-time or part-time capacity, as may be determined by the Board of Commissioners.

The Code Enforcement Official shall be charged with the duty and responsibility of enforcing all ordinances of the Borough except for those ordinances where the enforcement is restricted to law enforcement officers possessing police powers and except where the enforcement of a particular law or ordinance is reserved to a specified official or where the enforcement requires a specific license to be issued by the State of New Jersey or any department or agency thereof. Except for the limitations contained in this section, whenever an ordinance of the Borough designates a specific enforcement official or agency, such ordinance or ordinances are hereby deemed amended to include the Code Enforcement Official as an enforcement agency or enforcement official with respect to any and all such ordinances. In the enforcement of such ordinance or ordinances, the Code Enforcement Official shall have concurrent jurisdiction with the enforcement officials or enforcement agencies specified in any and all such ordinances and the enactment of this Article is not intended and shall not be construed as removing or depriving any such enforcement official or enforcing agency of jurisdiction to enforce such ordinance.

Before assuming duty, any Code Enforcement Official shall first take the oath of office prescribed for officials in the State of New Jersey, and a copy of said oath shall be filed on record in the office of the Municipal Clerk.

Compensation of the Code Enforcement Official shall be determined by the Salary Ordinance of the Borough.

A Code Enforcement Official shall receive such training in the performance of his duties as may be required by law.

Pursuant to N.J.A.C. 5:23-4.4, there shall be the position of Construction Official for the Borough.

The Construction Official shall receive compensation for the services provided pursuant to the annual Salary Ordinance.

The Construction Official shall be responsible to:
a. 
Coordinate the activities of the Subcode Officials;
b. 
Assist public in preparing applications;
c. 
Review all applications for completeness;
d. 
Determine proper fees;
e. 
Collect all fees and penalties;
f. 
Issue construction permits;
g. 
Record all notices of Uniform Construction Code violations;
h. 
Ensure that all inspections are scheduled and performed;
i. 
Ensure that all reports of inspections are complete and properly filed;
j. 
Ensure all final inspections are complete prior to issuance of Certificate of Occupancy;
k. 
Issuance of Certificates of Compliance/Temporary Certificates of Occupancy;
l. 
Prepare and obtain required reports;
m. 
Attend all meetings and hearings as required;
n. 
Comply with all procedures promulgated by the Board of Commissioners.

a. 
Pursuant to N.J.A.C. 5:23-4.4, there shall be the positions of Building Subcode Officials for the Borough.
b. 
The Building Subcode Officials shall receive compensation for the services provided pursuant to the annual Salary Ordinance.

There is established a position of Deputy Chief Financial Officer, which position may be filled or remain vacant within the discretion of the Board of Commissioners.

Pursuant to N.J.S.A. 40A:9-135, the position of Deputy Municipal Clerk is hereby established. The Deputy Municipal Clerk shall be appointed by the Board of Commissioners.

In the absence of the Municipal Clerk, the Deputy Municipal Clerk shall be empowered and directed to perform all duties required by law or ordinances to be performed by the Municipal Clerk.

a. 
The office of Deputy Tax Collector is established.
b. 
In the absence of the Tax Collector, the Deputy Tax Collector shall perform the duties of the office of Tax Collector.
c. 
The Board of Commissioners may appoint the one person to fill both the office of Deputy Tax Collector and the office of Deputy Treasurer.

a. 
The office of Deputy Treasurer is established.
b. 
In the absence of the Treasurer, the Deputy Treasurer shall perform the duties of the office of Treasurer and shall be authorized to sign checks.
c. 
The Board of Commissioners may appoint one person to fill both the office of Deputy Tax Collector and the office of Deputy Treasurer.

There shall be appointed an Emergency Management Coordinator. The Emergency Management Coordinator shall serve for a term of three years and be a resident of the Borough. As a condition of his appointment and his right to continue for the full term of his appointment, each Municipal Emergency Management Coordinator shall have successfully completed at the time of his appointment or within one year immediately following his appointment or the effective date of this act, whichever is later, the current approved Home Study Course and the basic Emergency Management Workshop.

a. 
The position of Licensing Official shall be established in the Borough.
b. 
The Municipal Clerk or Deputy Municipal Clerk or any other individual may be appointed by the Board of Commissioners.
c. 
The duties of the Licensing Official shall be to issue any licenses, permits, approvals or other documents required by the Borough in accordance with the parameters ordained in the Borough Code as such duties shall be assigned to the Licensing Official by the Board of Commissioners.
d. 
In no event shall the Licensing Official be responsible for issuing any licenses, permits or approvals which are required to be issued by specific individuals other than the Licensing Official under the New Jersey State Statutes or any other provision of the Borough Code.
e. 
The salary of the Licensing Official shall be established in the annual Salary Ordinance.

Pursuant to N.J.S.A. 40A:9-133, there shall be a Municipal Clerk appointed by the Board of Commissioners. The term of office of the Municipal Clerk shall be three years or as governed by State Statute.

No person shall be appointed as Municipal Clerk unless he shall have a Registered Municipal Clerk Certificate issued pursuant to N.J.S.A. 40A:9-133 et seq.

Statutory Duties.
a. 
Secretary of the Municipal Corporation:
1. 
Custodian of the municipal seal;
2. 
Maintain custody of all minutes, books, deeds, bonds, contracts and archival records of the municipal corporation;
3. 
Attest to the signatures of municipal officers and officials;
4. 
Maintain receipt of service of legal documents.
b. 
Secretary to the Governing Body:
1. 
Prepare agenda for annual Reorganization Meeting of the Governing Body;
2. 
Maintain and keep new members of Governing Body aware of Rules of Order for conducting meetings;
3. 
Prepare meeting agenda at the discretion of the Governing Body, be present at all meetings of the Governing Body;
4. 
Keep an official record of the proceedings of every meeting, retain the original copies of all minutes, ordinances and resolutions;
5. 
Process, record, file and, when necessary, advertise ordinances, resolutions and the municipal budget;
6. 
Administer and record oaths of office;
7. 
Maintain custody of all official records not specifically handled by other departments;
8. 
Act as liaison to the public and correspondent on behalf of the Governing Body.
c. 
Chief Administrative Officer of all Elections:
1. 
Certify vacancies at a local level;
2. 
Maintain receipt of nominating petitions and certification to the County Clerk of local candidates nominated by petition;
3. 
Exercise quasi-judicial authority in determining the validity of petitions;
4. 
Conduct the drawing for positions of candidates on the local ballot;
5. 
Furnish material for local elections;
6. 
Suggest polling places;
7. 
Maintain receipt of election results;
8. 
Certify to the County Clerk persons elected to partisan county committee offices in each election district;
9. 
Canvass the votes for and certify election of candidates for municipal office in nonpartisan local governments.
d. 
Chief Registrar of Voters in the Municipality.
e. 
Chief Administrative Officer.
f. 
Records Coordinator and Manager:
1. 
Responsible for implementing local archives and records retention programs as mandated by state law.

The purpose of this section is to create the administrative mechanisms needed for the execution of Cape May Point Borough's responsibility to assist in the provision of affordable housing pursuant to the Fair Housing Act of 1985.

As used in this section:
ADMINISTRATIVE AGENT
Shall mean the entity responsible for administering the affordability controls of some or all units in the affordable housing program for Cape May Point Borough to ensure that the restricted units under administration are affirmatively marketed and sold or rented, as applicable, only to low- and moderate-income households.
MUNICIPAL HOUSING LIAISON
Shall mean the employee charged by the Governing Body with the responsibility for oversight and administration of the affordable housing program for Cape May Point Borough.

a. 
There is hereby established the position of Municipal Housing Liaison for Cape May Point Borough.
b. 
Subject to the approval of the Council on Affordable Housing (COAH), the Municipal Housing Liaison shall be appointed by the Governing Body and may be a full- or part-time municipal employee.
c. 
The Municipal Housing Liaison shall be responsible for oversight and administration of the affordable housing program for Cape May Point Borough including the following responsibilities, which may not be contracted out:
1. 
Serving as the Borough's primary point of contact for all inquiries from the State, affordable housing providers, Administrative Agents, and interested households;
2. 
Monitoring the status of all restricted units in the Borough's Fair Share Plan;
3. 
Compiling, verifying, and submitting annual reports as required by COAH;
4. 
Coordinating meetings with affordable housing providers and Administrative Agents, as applicable;
5. 
Attending continuing education opportunities on affordability controls, compliance monitoring, and affirmative marketing as offered or approved by COAH;
6. 
If applicable, serving as the Administrative Agent for some or all of the restricted units in Cape May Point Borough as described in paragraph f below.
d. 
Subject to approval by COAH, Cape May Point Borough may contract with or authorize a consultant, authority, government or any agency charged by the Governing Body, which entity shall have the responsibility of administering the affordable housing program of Cape May Point Borough. If Cape May Point Borough contracts with another entity to administer all or any part of the affordable housing program, including the affordability controls and Affirmative Marketing Plan, the Municipal Housing Liaison shall supervise the contracting Administrative Agent.
e. 
Compensation shall be fixed by the Governing Body at the time of the appointment of the Municipal Housing Liaison.
f. 
Administrative powers and duties assigned to the Municipal Housing Liaison.
1. 
Resale and rental:
(a) 
Instituting and maintaining an effective means of communicating information between owners and the Administrative Agent regarding the availability of restricted units for resale or rental; and
(b) 
Instituting and maintaining an effective means of communicating information to low- and moderate-income households regarding the availability of restricted units for resale or re-rental.

Pursuant to N.J.S.A. 40A:11-9, there is hereby created the Office of Purchasing Agent to implement those regulations and activities as provided therein.
b. 
The Borough specifically adopts and incorporates by reference herein all provisions of N.J.S.A. 40A:11-9 and such other provisions as may be referenced therein.

The Purchasing Agent shall possess a qualified purchasing agent certificate.

Pursuant to N.J.S.A. 26:8-25, there is created the office of Registrar of Vital Statistics.

The Registrar of Vital Statistics shall be responsible for all records pertaining to marriages, deaths and births and the certifications of said documents. Duties shall include:
a. 
Strictly enforce the law relative to the disposal of dead bodies and the registration of vital records;
b. 
Supply blank forms of certificate to such persons as require them;
c. 
Supply copies of the law relative to the registration of vital records and disposal of dead bodies;
d. 
Sign and date birth, death, and marriage certificates;
e. 
Examine each certificate presented to determine if it is complete, legibly prepared, and in accordance with the law;
f. 
Retention of original copies of certificates;
g. 
Transmission of original certificates to the State monthly;
h. 
Make immediate report to the State of any violation of the statutes pertaining to the Registrar.

Pursuant to N.J.S.A. 40A:9-146, the Board of Commissioners shall appoint a Tax Assessor for the Borough of Cape May Point.
[N.J.S.A. 54:1-35.25]
The Tax Assessor shall hold the Tax Assessor's Certificate provided for in N.J.S.A. 54:1-35.25 et seq. and shall have the duty of assessing property for the purpose of general taxation. Nothing in this section shall affect adversely the salary or tenure rights acquired pursuant to N.J.S.A. 54:1-35.31 or any other law.

The Tax Assessor shall perform the duties required of the holder of such office pursuant to Title 54 of the New Jersey Statutes and such regulations as may be promulgated by the New Jersey Division of Taxation and the County Board of Taxation.
a. 
Have, perform and discharge all the functions, powers and duties prescribed by law for a Municipal Tax Assessor.
b. 
Maintain adequate assessment records of each separate parcel of real property assessed or exempted.

a. 
The Tax Assessor's duty shall be to maintain a fair and equitable tax base for the community based on sound assessment practices and to treat all property types and property owners impartially.
b. 
Job duties include:
1. 
Identifying and placing a value on every parcel of land within the confines of the municipality's borders;
2. 
Review and update property valuations on an annual basis;
3. 
Valuation and defense of tax appeals;
4. 
Performance of annual inspections of properties relative to sales;
5. 
Revise appraisals as a result of new construction and/or renovations.

Pursuant to N.J.S.A. 40A:9-141 et seq., the Borough Tax Collector shall be appointed by the Board of Commissioners for a term of four years from the first day of January next following his appointment. The Tax Collector shall be subject to the provisions of the laws of the State of New Jersey relating to tenure of office and removal from office. The office of Borough Tax Collector and Borough Treasurer or Municipal Clerk may be held by the same person.

The Tax Collector shall receive such compensation as prescribed by the Salary Ordinance and shall attend the duties of office as shall be prescribed by resolution of the Board of Commissioners and State law. The Tax Collector shall give bond for the faithful performance of his duties, which bond shall be paid for by the Borough of Cape May Point.

No person shall be appointed or reappointed as Tax Collector unless he shall hold a Tax Collector Certificate issued by the Director of the Division of Local Government Services. A Tax Collector Certificate shall be obtained upon qualification and successful completion of the examination given by the Director of the Division of Local Government Services. Qualifications for certification shall be in accordance with N.J.S.A. 40A:9-145.3. Revocation or suspension of any certificates shall be in accordance with N.J.S.A. 40A:9-145.5.

The Tax Collector shall be responsible for the billing, collection and reporting of taxes for all non-exempt real property in the Borough, including:
a. 
Preparation and mailing of all municipal tax bills;
b. 
Receiving and collecting all current and delinquent real and personal property taxes;
c. 
Reporting of all non-exempt properties;
d. 
Charging and receiving penalties and interest and accounting for all collections in such form and manner as may be prescribed by law;
e. 
Making or causing to be made and certifying searches for tax and other liens on any real property in the Borough as may be authorized by law and charging and collecting for the use of the Borough the fee required by law for such search.

The office of the Tax Collector shall be responsible for the performance of the following functions:
a. 
Perform the functions of a collector of taxes, including, without limitation thereto, the rendering of bills for property taxes and the conducting of tax sales;
b. 
Receive and collect all current and delinquent real and personal property taxes and charges, receive penalties and interest pursuant to law and account for all collections in such form and manner and at such times as may be prescribed or approved by the Director of Revenue and Finance;
c. 
Record receipts in proper records and deposit the same to the account of the Tax Collector in accordance with requirements of the statutes and the rules and regulations of the Division of Local Government Services;
d. 
Review and prepare all tax bills and bills for added assessments, omitted assessments and other municipal funds that may be raised by assessments;
e. 
Maintain a tax duplicate or other approved subsidiary records to record and credit payments to accounts of property or individuals against which taxes or assessments are levied;
f. 
Reconcile bank accounts at the close of each month and turn over the checks to the Borough Chief Financial Officer, and, at least monthly, total collections of the prior month and supply the Chief Financial Officer with the proper details to support turnover checks;
g. 
Confer at least monthly and, on all occasions when required, with the Borough Chief Financial Officer, Borough Auditor and other officials of the Borough of Cape May Point who may have jurisdiction over the collection of funds that may be collected by the Tax Collector;
h. 
File statutory required monthly reports; and file, in accordance with proper statutory direction and the rules and regulations of the Division of Local Government Affairs, other reports that may be required by statute or regulations;
i. 
Collect all utilities taxes, gross receipts tax, franchise taxes, bank stock taxes, taxes for added assessments, omitted assessments and any other assessments that may be levied according to law;
j. 
Ascertain what taxpayers are entitled to veterans' exemptions and senior citizen exemptions, and review and, where necessary, assist all taxpayers in the filing of applications for veterans' exemptions and senior citizen exemptions;
k. 
Conduct tax sales when required and maintain a proper record of the disposition of items of sale and a record of liens acquired by the municipality.

a. 
There is hereby created the position of Zoning Officer for the Borough.
b. 
The Zoning Officer shall receive compensation for the services provided pursuant to the annual Salary Ordinance.

Duties of the Zoning Officer shall include:
a. 
Review all applications for development;
b. 
Issue Zoning Permits;
c. 
Inspect structures and properties for compliance with all Borough Zoning Ordinances.
