The Board of Commissioners has authorized the Municipal Clerk
to establish written procedures and procedural forms for compliance
with the Open Public Records Access Law in accordance with the provisions
as contained in N.J.S.A. 47:1A-a et seq.

The Municipal Clerk shall be the custodian of government records
for the Borough of Cape May Point. The Chief Financial Officer is
designated as the deputy records keeper for records other than public
safety. The City of Cape May Police Chief is designated deputy records
keeper for all public safety records.

a. The following costs shall be charged for copies and other requested
material from the Borough in accordance with N.J.S.A. 47:1A-5b:
1. Basic per page copy fees, actual cost not to exceed:
(a) 8 1/2 x 11: $0.05 per page
(b) 8 1/2 x 14: $0.07 per page
(c) Should the actual costs to produce paper copies exceed the $0.05
and $0.07 rates, the Borough may charge the actual cost of duplication;
(d) The Borough will provide electronic records free of charge (i.e.
records sent via e-mail and fax); and
(e) The Borough will charge the actual cost to provide records in another
medium (i.e. computer disc, CD-ROM, DVD).
b. In accordance with said statute, the Municipal Clerk has established
a fee of $15 per hour for research or retrieval of any records requested
which are not readily accessible or are required to be retrieved from
storage or archives by the Borough of Cape May Point in order to provide
same. This fee is in addition to any copy fees.
c. For duplication of records when the actual costs exceed the rates
as provided by statute or whenever the nature, format, manner of collection
or volume of a government record requested to be provided by the Borough
pursuant to the statute is such that the record cannot be reproduced
by ordinary document copying equipment in ordinary business size or
involves an extraordinary expenditure of time and effort to accommodate
the request, the Borough shall charge a special service charge in
addition to the actual cost of duplicating the record that shall be
determined to be reasonable and shall be based on the actual direct
cost of providing the copy, which special service fee shall not exceed
the amount of $15 per hour.
d. For records in which a record request is made to provide records
in the same medium in which the Borough maintains the record, in addition
to the actual cost of duplication, the Borough shall charge a fee
that shall be reasonable and based on the cost of the technology used
for same or the labor cost of the Borough or other personnel providing
the service that is actually incurred by the Borough or is attributable
to the Borough for programming, clerical or supervisory assistance
required for both.
