Appeals from shutoffs or terminations effected under this chapter
shall be governed by the Commission's Billing, Termination and Appeal
Regulations.
Water/Sewer Commission as hearing board.
A. Any user who is aggrieved by the actions of the Superintendent may request a hearing before the Commission as defined in Chapter
16 of the City Ordinances.
B. The aggrieved person shall file a written request for such a' hearing
within seven working days from the date the Superintendent's order
was served or given to the aggrieved person. The Commission shall
set a time and place for such hearing and shall inform the aggrieved
person in writing of the same.
C. The hearing shall be commenced not later than 30 days after the day on which the written request was filed and shall be concluded within an additional 30 days thereafter. If an aggrieved person filed a request for hearing regarding Article
8.0, the Commission shall commence the hearing within seven working days from the date on which the written request was filed.
D. At the hearing, the petitioner shall be given an opportunity to be
heard and to show why the order or decision of the Superintendent
should be modified or withdrawn.
E. After the hearing, the Commission shall sustain, modify or withdraw
the order or decision of the Superintendent, and shall inform the
petitioner and the Superintendent, in writing, of its decision within
seven working days after the conclusion of the hearing.
F. If a written letter for hearing is not filed in the office of the
Commission within seven working days after an order has been issued
or if after a hearing the order has been sustained in any part, each
day's failure to comply with the order as issued or modified shall
constitute an additional offense.
