The owner or tenant of lands lying within the limits of the Borough of Woodstown, New Jersey, is required to keep all brush, hedges and other plant life growing within 10 feet of any roadway and within 25 feet of the intersection of two roadways, cut to a height of not more than two and one-half (2 1/2) feet where it shall be necessary and expedient for the preservation of the public safety. When the Borough Clerk learns of any violation of this provision, he shall immediately cause notice to be given to the owner and/or tenant of the premises or property affected to remove or cut the brush, hedges or other plant life within (10) days after the receipt of such notice.
In the event that such brush, hedges and other plant life as provided in § 43-6 are not so cut, the Street Superintendent shall, under his direction, cause said brush, hedges and other plant life to be cut to a height of not more than two and one-half (2 1/2) feet as above provided.
In all cases where brush, hedges and other plant life are so cut within the limitations of this Article by or under the direction of the Street Superintendent, such Street Superintendent shall certify the cost thereof to the Borough Council, which shall examine the certificate and, if found correct, shall cause the cost as shown thereon to be charged against said lands, or in the event that such cost is excessive, shall cause the reasonable cost thereof to be charged against said lands.
The amount so charged shall forthwith become a lien upon such lands and shall be added to and become and form part of the taxes next to be assessed and levied upon such lands, the same to bear interest at the same rate as other taxes, and shall be collected and enforced by the same officer and in the same manner as taxes.

In addition to any other penalties, civil remedies or relief afforded in this chapter, any person found guilty of violating any section of this chapter may be punished by imprisonment in the county jail for a term not exceeding 90 days or by a fine not exceeding $1,000 or both. For a first conviction, the minimum fine shall be $100. For any subsequent conviction, the minimum fine shall be $200.
