A certain document, one (1) copy of which is on file in the office of the City Clerk of Merriam Woods, Missouri, being marked and designated as the International Residential Code, 2003 Edition, including Appendix Chapters, as published by the International Code Council, be and is hereby adopted as the Residential Building Code for Merriam Woods, Missouri, for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of one- and two-family dwellings and townhouses not more than three (3) stories in height in the City of Merriam Woods, and providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, conditions and terms of such International Residential Code, 2003 Edition, published by the International Code Council on file in the office of the City are hereby referred to, adopted, and made a part hereof as if fully set out in this Article.

The following Sections are hereby revised:

Section R301.2(1), insert:

Roof Snow Load: twenty (20) lbs.

Winter Design Temperature: twelve degrees (12°).

Section R703, Exterior Covering, from the International Residential Code 2003, including Table R703.4, is hereby replaced with Section R703, Exterior Covering, from the International Residential Code 2006, including Table R703.4.

Section R105.2, Work Exempt from Permits, of the 2003 International Residential Building Code is hereby amended as follows:

"To obtain a permit, the property owner or his/her authorized agent shall first file an application thereof in writing on a form furnished by the department of building safety for that purpose. Such application shall:"

A. 
For any violation of the code adopted hereby, the violator, upon conviction, shall be punished by a fine not exceeding five hundred dollars ($500.00) or by imprisonment in the City or County Jail not exceeding ninety (90) days, or by both such fine and imprisonment. Every day any violation shall continue shall constitute a separate offense.
B. 
Whenever any act is prohibited by the code adopted hereby, by an amendment thereof, or by any rule or regulation adopted there under, such prohibition shall extend to and include the causing, securing, aiding, or abetting of another person to do said act. Whenever any act is prohibited by the code adopted hereby, an attempt to do the act is likewise prohibited.

If any Section, Subsection, sentence, clause or phrase of this Article is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Article. The Board of Aldermen hereby declares that it would have passed this Article, and each Section, Subsection, sentence, clause or phrase thereof, irrespective of the fact that any one (1) or more Sections, Subsections, sentences, clauses or phrases be declared unconstitutional.
