Marlborough Township shall provide the Borough of Green Lane
with the same police service and protection that it provides the residents
of Marlborough Township with the same limitations to said service
as may exist in Marlborough Township, if any.
Green Lane Borough shall pay to Marlborough Township, on account
of police services provided to the Green Lane Borough by Marlborough
Township between June 1, 1999, and May 31, 2000, the sum of $15,000
in 12 monthly installments of $1,250 each, the first such installment
payable on or before June 15, 1999, with subsequent such installments
due on or before the first day of each succeeding month through the
term of the agreement.
The term of this agreement is one year, commencing on June 1,
1999, and terminating on May 31, 2000, subject to written extension
or amendment signed by both parties and further subject to the right
of either party to terminate at any time upon 90 days' written
notice to the other party.
Any dispute relating to this agreement, including, but not limited
to, the right to indemnification shall be decided only by arbitration
to take place within Marlborough Township in accordance with the commercial
arbitration rules then in effect of the American Arbitration Association,
before a panel of three arbitrators, one of whom shall be selected
by Green Lane Borough, the second of whom shall be selected by Marlborough
Township, and the third of whom shall be selected by the other two
arbitrators. If one of the parties fails or refuses to select an arbitrator,
or if the two arbitrators selected cannot agree on the selection of
a third within 30 days after such time as the parties have each been
notified of the selection of the other's arbitrator, the necessary
arbitrator or arbitrators shall be selected upon petition to the Court
of Common Pleas of Montgomery County. Any award entered by the arbitrator
shall be final, binding and non-appealable, and judgment may be entered
thereon by any party in accordance with applicable law in the Court
of Common Pleas of Montgomery County.
Green Lane Borough is purchasing police services from Marlborough
Township and absolute control of the Marlborough Township Police Department
shall remain within the province of that municipality. The Mayor of
Green Lane Borough or his chosen delegate shall serve as liaison with
the governing body where such operations are discussed and is encouraged
to express the concerns of Green Lane Borough in police issues raised
before that body.
The Chief of Police of the Marlborough Township Police Department
shall submit monthly his report of police activity within Green Lane
Borough during the preceding month to the governing body of Green
Lane Borough. Though the Chief is encouraged to personally or by another
officer of the Department deliver the report to the governing body
at each of its monthly meetings, he shall be required personally or
by another officer of the Department to appear at such meetings at
least four times during the term hereof, at the meetings of August
and November of 1999 and those of February and May of 2000 to both
deliver his Department's monthly report and hear such concerns
as might be expressed by those in attendance.
