A new section 3309 shall be added to Chapter 33, "Explosives
and Fireworks," of the 2003 International Fire Code, as amended, and
shall read:
"Ground and hand-held sparking devices, novelties, including
devices containing small amounts of pyrotechnic and/or explosive composition
(such devices produce limited visible or audible effects, and examples
include snakes, tanks, poppers and snappers) that do not fall under
the category of fireworks, toy caps and other related or similar type
items are to be sold at least 150 feet from any device dispensing
gasoline, propane or other such flammable products."
Any violation of the following codes of 2003, as amended, including
the International Building Code, International Residential Code, ICC
Electrical Code, International Existing Building Code, International
Energy Conservation Code, International Fire Code, International Fuel
Gas Code, International Mechanical Code, International Plumbing Code
and International Urban-Wildland Interface Code, shall allow the imposition
of a fine of up to $300 per day per violation, in addition to any
other penalties allowed by law.
In the event any section, sentence, clause, phrase or word of
this article shall be declared illegal, invalid or unconstitutional
by any court of competent jurisdiction, such declaration shall not
prevent, preclude or otherwise foreclose enforcement of any of the
remaining portions of this article or 2003 International Fire Code,
as amended.
All ordinances or parts of ordinances inconsistent herewith
or in conflict with any of the specific terms enacted hereby, to the
extent of said inconsistencies or conflicts, are hereby repealed.
This article shall become effective within the time period provided
by law.
