This chapter shall be known and may be cited as the "Green Lane
Borough Park Ordinance." Whenever in this chapter the term "park"
is used, it shall be deemed to include all parks, playgrounds and
open spaces within the Borough of Green Lane in which the Borough
has an ownership and proprietary interest, which shall include, but
shall not necessarily be limited to, Isaac Smith Park.
The Isaac Smith Park Committee shall be vested with responsibility
for the maintenance, improvement and day-to-day operation of the park
and for the establishment of such rental charges and schedules of
events as to allow for maximum public access to the park with minimum
adverse environmental impact.
All persons using park facilities in the Borough of Green Lane
shall abide by and be subject to the following regulations:
A. The Borough park system shall be open to all Borough residents and
guests from 5:00 a.m. to 10:00 p.m. daily.
B. Swimming is not permitted.
C. All persons using the park facilities shall refrain from exhibiting
boisterous, obnoxious, abusive, indecent or threatening behavior and
language while on park property.
D. Persons renting park facilities will be fully liable for any injuries
that may occur to themselves, their invited guests or to the general
public, which injury is occasioned by their utilization of park facilities
and shall save the Borough of Green Lane, the Green Lane Fire Company
and any other person or entity having an ownership or proprietary
interest in the park harmless from any and all legal liability that
may be occasioned by their utilization of park facilities. This shall
apply to use of the baseball field, picnic area, parking areas and
the roadway around Isaac Smith Park but shall not be strictly limited
thereto.
E. In order to facilitate the enforcement of the regulations set forth in Subsection
D, hereof, the Isaac Smith Park Committee may, in its sole discretion and when it deems such to be necessary, require of persons renting park facilities a certificate of insurance, naming the Borough of Green Lane, the Green Lane Fire Company, the Committee itself and any other persons or entities having an ownership or proprietary interest in the park as additional insureds.
F. Damaging, vandalizing and destroying signs, property, structures,
equipment, trees, shrubs or vegetation is prohibited and, in facilitating
compliance with this regulation, the Isaac Smith Park Committee may,
in its sole discretion and when it deems such to be necessary, require
of persons renting park facilities an escrow deposit, in such amount
as it, in its sole discretion may deem necessary, to make whole the
Borough of Green Lane, the Green Lane Fire Company and any other persons
or entities having an ownership or proprietary interest in the park
for damages, as above stated, occasioned by the actions of the renter
or his guests while utilizing park facilities. Subsequent to any rental
for which an escrow deposit has been required, the Isaac Smith Park
Committee shall cause an inspection of the rented park facilities
to be made and upon the completion of such inspection shall cause
the entire amount of the escrow deposit or any portion of that deposit
not used in the repair of the above stated damages to be returned
to the renter who made the escrow deposit.
G. Pets are permitted on park grounds only if they are under leash or
otherwise properly controlled by their owner or handler.
H. Trash, garbage or litter shall be discarded only in containers provided
for that purpose. "Litter" shall include rubbish, paper, trash, ashes,
junk, waste, liquid or solid vegetable or animal matter and garbage.
I. Persons renting the park shall be responsible for clearing garbage
and litter from park grounds, tables, pavilion, kitchen area, bar
area and baseball field and disposing of such garbage and litter in
the proper containers. In the event that a renter who has been required
to make an escrow deposit fails to properly dispose of garage and
litter, then the cost of cleaning the park grounds shall be a charge
properly deducted from the escrow deposit.
J. Passenger cars, trucks or other vehicles, regardless of their description,
shall not be driven or operated in a reckless or negligent manner
or in such other fashion as to either endanger or place in jeopardy
the health, safety or welfare of any persons, either within or outside
of the park areas.
K. Motorcycles, mini-bikes, snowmobiles or other motorized recreational
vehicles shall not be operated or parked anywhere within the Borough
park system except upon roadways or paths which the Isaac Smith Park
Committee may, if they in their sole discretion should choose to do
so, establish and clearly designate for such use or in parking areas,
and then only when the parks are open to the public.
L. Except for authorized farm vehicles and Borough maintenance equipment,
no passenger car, truck or other vehicle shall be operated, stopped
or parked except upon designated roadways or parking areas.
M. No person, other than a police officer, shall possess, carry or discharge
any firearm, bow and arrow or other weapon within the limits of the
park.
N. Fires shall be permitted only in designated areas and within facilities
provided by the Borough.
O. Trapping and hunting is prohibited within the park.
P. Camping is permitted only if authorization therefor is first secured
from the Isaac Smith Park Committee.
Q. The posting of any signs or posters is prohibited unless permission
therefor is first secured from the Isaac Smith Park Committee.
R. Gambling of any kind is not permitted within the park.
The Police Department of Green Lane Borough or of any other
jurisdiction which may be providing police services to the Borough
of Green Lane shall enforce these regulations and exercise general
supervision over persons occupying or using the parks.

Any person or persons violating any of the provisions of this
chapter shall, upon conviction thereof, be sentenced to pay a fine
of not more than $600 plus costs and, in default of payment of said
fine and costs, to a term or imprisonment not to exceed 30 days.
