This chapter shall be known as the Wantage Township Fees Chapter.

The purpose of this chapter is to adopt a new chapter establishing, amending and consolidating all of the fees of the Township of Wantage in one chapter of the ordinance.

Requests for copies of government records under the Open Public Records Act, N.J.S.A. 47:1A-1 et seq.
(1)
Photostatic copies of any government record that can be photocopied with municipal facilities - $0.05 per letter size page or smaller and $0.07 per legal size page or larger.
(2)
In the event that the actual cost for duplication of a government record exceeds the foregoing rate, the charge shall be the actual cost of duplicating the government records requested. The actual cost shall be the cost of materials and supplies used to make a copy of the record, but shall not include the cost of labor or other overhead expenses associated with making the copy except as provided in paragraph (5) hereof.

For any government record copied onto a non-paper medium, the actual cost of the non-paper medium.
(4)
For any copy of a government record for which the township is unable to duplicate with its own facilities and requires the services of an outside vendor, the actual cost to the township from the outside vendor.
(5)
Whenever the nature, format, manner of collation or volume of a record embodied in the form of printed matter to be inspected, examined or copied is such that the record cannot be reproduced by ordinary document copying equipment in ordinary business size or involves an extraordinary expenditure of time and effort to accommodate the request, the charge for the record shall be the actual cost to the township, together with a service charge of $12 per hour for each hour required to duplicate the record. The requestor shall have the opportunity to review and object to the charge prior to it bring incurred.

In the event that the township does not maintain the record requested in the medium requested, the township shall either convert the record to the medium requested or provide a copy in some other meaningful medium. If a request is for a record in a medium not routinely used by the township, not routinely developed or maintained by the township or requiring a substantial amount of manipulation or programming of information technology, the cost for the record shall be the actual cost of duplication together with a special charge that shall be reasonable and shall be based upon the cost for any extensive use of information technology, or for the labor cost of personnel providing the service, that is actually incurred by the township or attributable to the township for the programming, clerical and supervisory assistance required, or both.

Access to electronic records and non-printed materials shall be provided free of charge, provided however, that the township may charge for the actual costs of any needed supplies, such as computer disks.

a. 
Developers are required to pay appropriate fees pursuant to the Council of Affordable Housing ("COAH") rules, and as set forth in Chapter 27, "Affordable Housing," in the Township of Wantage Ordinance.
b. 
Administrative fee. Once any COAH fee has been paid by an applicant, if the return of fees is later sought, Wantage Township shall charge a fee of $200 for the administrative costs incurred related to the Township's COAH and affordable housing obligations.

Application fees for development shall be reasonable and shall be established by ordinance. Such fees shall be used to cover the administrative costs associated with the implementation of P.L. 1975, C. 291, these fees shall also be used to defray the cost of tuition for those persons required to take the course in Land Use and Planning in the municipality as required to P.L. 2005, C. 133 (N.J.S.A. 40:55-23.3 et. al.).
a. 
Charitable, philanthropic, fraternal and religious nonprofit organizations holding a tax exempt status under the Federal Internal Revenue Code of 1954 [26 U.S.C. § 501(c)] shall be exempt from the payment of any fee charged under the Municipal Land Use Law or Township ordinances;
b. 
A Board of Education shall be exempt from the payment of any fee charged under the Municipal Land Use Law or Township ordinances;
c. 
A disabled person, or a parent or sibling of a disabled person, shall be exempt from the payment of any fee charged under the Municipal Land Use Law or Township ordinances in connection with any application for development or an appeal which promotes accessibility to his own living unit.

For the purposes of this subsection, "disabled person" means a person who has the total and permanent inability to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment, including blindness, and shall include, but not be limited to, any resident of this state who is disabled pursuant to the federal Social Security Act (42 U.S.C. § 416), or the federal Railroad Retirement Act of 1974 (45 U.S.C. § 231 et seq.), or is rated as having a 60% disability or higher pursuant to any federal law administered by the United States Veterans Act. For purposes of this paragraph, "blindness" means central visual acuity of 20/200 or less in the better eye with the use of a correcting lens. An eye which is accompanied by a limitation in the fields of vision such that the widest diameter of the visual field subtends an angle no greater than 20° degrees shall be considered as having the central visual acuity of 20/200 or less.
