[1983 Code § 136-1]
As used in this section:
ALL-TERRAIN VEHICLE
An engine-driven device which has a net weight of 650 pounds
or less, which has a width of 48 inches or less, which is equipped
with a seat designed to be straddled by the operator and which is
designed to travel on three or more low-pressure tires. A "low-pressure
tire" is a tire which has a minimum width of six inches, which is
designed to be mounted on a rim with a maximum diameter of 12 inches
and which is designed to be inflated with an operating pressure not
to exceed six pounds per square inch as recommended by the manufacturer.
BOARD OF RECREATION
The Board of Recreation Commissioners established pursuant to Chapter
2, Administration, of the Borough of Pompton Lakes Code.
PUBLIC LANDS AND RECREATION AREAS
Borough land or lands includes all lands owned or leased
by the Borough of Pompton Lakes, including those lands under land
use agreement with it, including lands that provide open space, wildlife
or recreational benefit.
SNOWMOBILE
Any engine-driven vehicle manufactured solely for snowmobiling;
such vehicle has an endless belt tread and sled-type runners or skis
to be used in contact with snow.
VEHICLE
Any wheeled conveyance, including bicycles and tricycles,
whether motor powered, animal drawn or self propelled. The term shall
include any trailer of any kind or description, but shall not include
wheelchairs.

The provisions of this section shall apply to all lands, structures
and property owned, leased, controlled or administered by the Borough
of Pompton Lakes. All such lands shall be shown on an Official Map
or listing on file at the Borough Offices, in accord with the records
in the office of the Passaic County Register of Deeds.

The Borough may establish, construct and maintain recreation
and interpretation facilities, boat landings, wild resource zones,
aesthetic, management zones, special use areas and wildlife habitats.

Rules and regulations may be made by the Mayor and Borough Council
governing the further use and enjoyment of property administered by
the Borough. Any person who shall violate such rules or regulations,
or who refuses to subject himself thereto, may be excluded from the
use of such facility and be subject to penalties.

Borough parks and public lands shall be open daily from one
hour before sunrise and shall be closed one hour after sunset. Use
of recreational facilities and fields will be prohibited after dusk
and through and until 8:00 a.m., unless the Mayor and Council shall
extend such time by written resolution for a particular day or dates.

A. In order to pay part of the cost of maintaining public lands and
recreational areas, the Borough shall be permitted to charge nominal
admission fees, which may include additional fees for the use of tennis
courts to defray, in part, the cost of construction, maintenance and
supervision of same.
B. The Borough shall be permitted to charge fees for summer day camp
operated by the Borough and supervised by the Board of Recreation.

For a recreational activity sponsored by the Board of Recreation,
when a charge is made therefore by another person, firm, corporation
or agency and the Board of Recreation shall determine said charge
or a part thereof shall be paid by persons participating in such recreational
activity, the Board of Recreation may charge a fee thereof, not to
exceed the pro rata cost thereof, based upon the estimated number
of persons to participate in the program.

No person shall disturb, vandalize, damage, deface, remove or
destroy any trees, shrubs, plants other natural growth, sand or gravel;
carve on any rocks, archaeological or geological features, signs,
walls, tables or structures; drive nails into trees; or remove, injure
or deface in any manner any structures, including buildings, signs,
gates, fences, tables or other Borough property.

A. No dogs or other domesticated animals are permitted in designated
Borough parks unless otherwise posted.
B. It shall be unlawful for any person to allow or otherwise permit
any pet, dog or cat or other domesticated animal to be upon any public
lands or recreation areas operated by the Borough unless leashed or
restrained at all times and under the specific physical control of
the person who owns or has legal custody of said animal. Leashes must
be no longer than 10 feet in length. All persons who bring pets, as
described above, onto property operated by the Borough must have proof
that the animal has a current valid rabies inoculation and valid license.
C. It shall be unlawful for any person to bring or keep a noisy, vicious
or dangerous animal onto Borough property and remain thereon after
having been asked to leave by any agent of the Borough.
D. It shall be unlawful for any person bringing said animal, as heretofore
described, not to remove and dispose of its animal waste in proper
containers from park premises.

A. No motor vehicle shall be parked within the confines of Lakeside
Park. Motor vehicles shall be parked in all other public lands, parks
and recreational areas only in the parking lot(s) designated for the
purpose; except, however, that this section will not apply to motor
vehicles owned by the Borough of Pompton Lakes.
B. No person shall operate a motor vehicle, including but not limited
to trail bikes, motorcycles, minibikes and all terrain vehicles, upon
any Borough public land or recreation areas. Agents of the Borough
doing official business are exempted from this rule.
C. The Police shall immediately confiscate any motor vehicle operated
in the prohibited areas. The motor vehicle shall be returned upon
payment of towing charges, storage fees and an administrative restoration
fee in the amount of $100.

No boats shall be allowed on the swimming beaches except boats
to be used for lifesaving purposes.

Gambling of any kind is prohibited.

It is unlawful for any person to engage in violent, abusive,
indecent, profane, boisterous, unreasonably loud or otherwise disorderly
conduct under circumstances in which such conduct tends to cause or
provoke a disturbance on any property administered by the Borough.

Bicycles must be parked in designated areas. Riding bicycles
in public parks and recreational areas is prohibited unless otherwise
posted.

No intoxicating liquors or beverages shall be permitted in the
parks except at an event sponsored by the Borough, provided that approval
of the Mayor and Borough Council is first obtained.

A. Purpose. The purpose of this subsection is to establish requirements
to control littering in the Borough of Pompton Lakes, so as to protect
public health, safety and welfare, and to prescribe penalties for
failure to comply.
B. Definitions. As used in this subsection:
LITTER
Any used or unconsumed substance or waste material which
has been discarded, whether made of aluminum, glass, plastic, rubber,
paper or other natural or synthetic material, or any combination thereof,
including, but not limited to, any bottle, jar or can, or any top,
cap or detachable tab or any bottle, jar or can, any unlighted cigarette,
cigar, match or any flaming or glowing material or any garbage waste,
newspapers, magazines, glass, metal, plastic or paper containers or
other packaging or construction material, but does not include the
waste of the primary processes of mining or other extraction processes,
logging, sawmilling, farming or manufacturing.
C. Prohibited acts and regulated activities.
1. It shall be unlawful for any person to throw, drop, discard or otherwise
place any litter of any nature upon public or private property other
than in a litter receptacle, or having done so, to allow such litter
to remain.
2. Whenever any litter is thrown or discarded or allowed to fall from
a vehicle or boat in violation of this section, the operator or owner,
or both, of the motor vehicle or boat shall also be deemed to have
violated this subsection.
D. Enforcement. This subsection shall be enforced by the Pompton Lakes
Police Department.
E. Penalties. Any person(s) who is found to be in violation of the provisions
of this subsection shall be subject to a fine not to exceed $100.

The following speed limit is hereby established for all traffic
within public lands and recreational areas of the Borough of Pompton
Lakes: 15 miles per hour.

It is unlawful for any person to place unauthorized signs on
any property administered by the Borough.

No person shall remove, cover, bury, destroy or deface any survey
monument, corner post, monument accessory, witness tree, bearing tree,
memorial tree or survey accessory on any lands within Borough property
without permission from the Borough.

It is unlawful for any person to disturb, destroy, vandalize,
damage or remove the property or personal effects of others on any
property administered by the Borough. Personal effects left on property
administered by the Borough may be removed by agents of the Borough.

It shall be unlawful for any person, except authorized police
officers, to possess, display or use on any land operated under the
jurisdiction of the Borough any gun, including shotgun, rifle, pistol,
revolver, air or BB gun, paintball, sling shot, bow and arrow, switchblade
knife with spring loaded blade, throwing knife, tomahawk or throwing
axe, unless specifically authorized by the Borough in writing.

While on any park, recreation area, playground, ball field,
tennis court or any other recreation facility or other public lands
or the parking facilities thereof owned or controlled by the Borough,
all persons shall conduct themselves in a proper and orderly manner.
It shall be unlawful for any person, unless authorized by the Mayor
and Borough Council, to:
A. Disturb or interfere unreasonably with any person or party occupying
any area or participating in any authorized activity.
B. Willfully mark, deface, disfigure, injure, tamper with or displace
or remove any structure, equipment, facilities or other property,
either real or personal.
C. Damage, cut, carve, transplant or remove any tree or plant or injure
the bark or pick the flowers or seeds of any tree or plant, or dig
or otherwise disturb grass areas, or in any other way injure or impair
the natural beauty or usefulness of any area.
D. Drive any vehicle on any area except the paved park roads or parking
areas or such other areas as may be specifically designated.
E. Hunt, harm or kill any animal life.
F. Camp in any area without permission of the Borough. No person shall
set up tents, shacks or any other temporary shelter for the purpose
of overnight camping, nor shall any person leave in any park after
closing hours any movable structure or special vehicle to be used
or that could be used for such purpose, such as a camper-trailer,
house trailer or the like without permission of the Borough.
G. Build or attempt to build a fire. No person shall drop, throw or
otherwise scatter lighted matches, burning cigarettes or cigars or
other flammable material within any park, public lands or recreation
area or on any highway, road or street abutting or contiguous thereto.
H. Discharge or otherwise place or cause to be placed in the waters
of any body of water in or adjacent to any public lands any substance
which may result in the pollution of the waters.
I. Dump any refuse or trash, including yard waste and grass clippings,
anywhere on the grounds thereof, but shall place refuse in the proper
receptacle where these are provided. Where such receptacles are not
provided, such refuse shall be carried away from the public lands
by the person responsible for its presence and properly disposed of
elsewhere.
J. Have in his possession, or otherwise cause to explode or discharge
or burn, any firecrackers or other fireworks.
K. It shall be unlawful to use any paths and trails in a manner other
than as specifically posted.
L. Nothing in this section shall prevent employees or agents of the
Borough from performing their assigned duties.
M. Solicit alms or contributions for any purpose, whether public or
private.
N. Have in his possession glass containers of any type.
O. Play golf, drive, pitch, putt or chip any golf balls in other than
designated areas.
P. Trespass on any public lands or recreational areas temporarily closed
for maintenance and appropriately posted by the authority of the Borough.
Q. Use electronic sound equipment, including but not limited to stereos,
public address systems, and amplifiers, which shall be prohibited
unless a permit for such use shall have first been obtained from the
Borough.
R. Use electrical generators which shall be prohibited unless a permit
for such use shall have first been obtained from the Borough.
S. Smoking is prohibited on all Borough open space properties, parks,
recreation areas, playgrounds, ball fields, tennis courts or any other
recreation area owned or operated by the Borough, including parking
facilities for such properties, and in compliance with all other federal
and state statutes, rules and regulations. Smoking shall include the
use of the burning of, the inhaling from, the exhaling of smoke, or
the possession of a lighted cigar, cigarette, pipe or any other matter
or instrument which contains a tobacco product or any other matter,
substance or product that can be smoked, inhaled, exhaled or burned
including the vapor from electronic smoking devices.

The following lands and premises are hereby designated as parks
and recreation areas and are subject to the regulations established
for parks within the Borough of Pompton Lakes.
A. Federal Square: premises located within the intersection of Hamburg
Turnpike, Wanaque Avenue and Passaic Avenue and delineated by the
curbline of the park area.
B. DuPont Square: the area located within the intersection of Howard
Street, Walnut Street and DuPont Place, delineated by the curbline
of the park area.
C. Pacifico-Gallo Park: Lot 5, Block 1301, as shown on the Tax Assessment
Map of the Borough of Pompton Lakes.
D. Wilderness Park: premises known as Lot 1, Block 7600, on the Tax
Assessment Map of the Borough of Pompton Lakes.
E. Lakeside Park: premises known as Lot 3, Block 12600, as shown on
the Tax Assessment Map of the Borough of Pompton Lakes.
F. Schuyler Park: premises known as Lot 1, Block 5001, as shown on the
Tax Assessment Map of the Borough Pompton Lakes.
G. Hershfield Park: Lots 2 and 4, Block 8706, as shown on the Tax Assessment
Map of the Borough of Pompton Lakes.
H. Snodgrass Park: Lot 16 of Block 8700, as shown on the Tax Assessment
Map of the Borough of Pompton Lakes.
I. Old Swimming Hole: Lots 1 and 24A in Block 8000 and Lot 13 in block
7806, as shown on the Tax Assessment Map of the Borough of Pompton
Lakes.
J. Firemen's Memorial Square: located within the intersection of Hamburg
Turnpike and Center Street and delineated by the curbline of said
park area.
K. Police Memorial: located at the intersection of the southerly side
of Hershfield Park Place and the westerly side of Ramapo Avenue.
L. DuPont Field: premises leased by Borough from E.I. DuPont deNemours,
Inc., located off Barbara Drive.
M. P.L.Y.O. Field: premises located south of Garden Road and leased
by the Borough of Pompton Lakes to the Pompton Lakes Youth Organization.
N. Willow Avenue ball fields: baseball fields and picnic areas located
adjacent to Willow Avenue and west of Riverdale Road, more commonly
known as the "Joe Black Field Complex," and consisting of the Don
Jenkins Field, the George Laraia Field and the Joe Grill Field, and
comprised of Lot 1 of Block 11000 and Lot 1 of Block 11100 on the
Tax Assessment Map of the Borough of Pompton Lakes.
O. Stiles Park, Lot 9 of Block 9520, as shown on the Tax Assessment
Map of the Borough of Pompton Lakes.
P. John E. Murrin Community Park, Lot 29, Block 7806, on the Tax Assessment
Map of the Borough of Pompton Lakes, Passaic County, New Jersey.

A. Any person, business, or organization that seeks to use a portion of a Borough's park, as listed under subsection
11-1.23, for the duration of at least one hour, shall require a permit for the use of the park for such event.
B. The Borough Clerk or their designee shall issue a permit hereunder
for use of a municipal park for an event if the following criteria
are met:
1. The proposed activity or use of the park will not unreasonably interfere
with or detract from the general public enjoyment of the park.
2. The proposed activity and use will not unreasonably interfere with
or detract from the promotion of public health, welfare, safety and
recreation.
3. The proposed activity or use is not reasonably anticipated to incite
violence, crime or disorderly conduct.
4. The proposed activity will not entail unusual, extraordinary or burdensome
expense or police operation by the Borough.
5. That the facilities desired have not been reserved for other use
at the day and hour required in the application.
6. In the case of farmers' markets, a non-profit corporation seeking
a permit for same shall, in addition to all other applicable requirements
and restrictions in this chapter and Code, obtain any and all applicable
prior approvals from state or local government, including but not
limited to any food establishment licenses required pursuant to the
Borough's Municipal Code.
7. Within five days after receipt of an application, the Borough Clerk
or their designee shall apprise an applicant in writing of his or
her reasons for refusing a permit, and any aggrieved person shall
have the right to appeal in writing within 10 days to the Borough
Clerk. The decision of the Clerk shall be final.
8. A permittee shall be bound by all park rules and regulations and
all applicable ordinances fully as though the same were inserted in
the permit.
9. The person or persons to whom a permit is issued shall be liable
for any loss, damage or injury sustained by any person whatever by
reason of the negligence of the person or persons to whom such permit
shall have been issued.
10. A permit may be revoked upon a finding of violation of any rule or
ordinance or upon good cause shown.
C. All events in which a permit is required at a park shall be scheduled
to end at or before sundown. Permission must be received from the
Board of Recreation to extend this time.
D. Water games, Water balloons, sprinklers, pools, water slides, and
amusement rides are prohibited except by permit.
E. Use of drugs, alcohol, profanity, abusive language and/or vandalism
is strictly prohibited and shall result in the penalties provided
to the fullest extent of the law.

G. Any and all events that are for the use of a trail for an event with
10 or more people shall require a permit and a fee of $50.

A. Person.
1. The person to whom the permit is issued shall be liable for all loss,
damage or injury sustained by any person by reason of the negligence
of the person whom such permit shall have been issued. The Borough
of Pompton Lakes shall have the right to require any permittee to
submit evidence of liability insurance covering injuries to members
of the general public arising out of such permitted activities in
such amounts as may be from time to time determined prior to the commencement
of any activity or issuance of any permit, as well as any other insurance
or indemnification as determined by the Borough of Pompton Lakes.
B. Group/Organization/Business.
1. Upon application for a permit for use of the Borough's Park
facilities, any group, organization or business shall submit to the
Borough Clerk or their designee, together with their permit application,
evidence of a paid insurance policy naming the Borough of Pompton
Lakes as additional insured covering public liability for injury to
any person or persons and property damage with minimum limits of liability
not less than $1,000,000 per occurrence and $2,000,000 per aggregate.
Nothing contained herein shall be construed to limit acquisition of
additional coverage.
C. Person/Group/Organization/Business.
1. The person/group/organization agreeing to use the Borough's
parks, agrees to hold harmless and indemnify the Borough against all
loss and damage, including defense costs and attorney fees for damage
to person or property, arising from any act by, or negligence of the
restraint of their friends, relatives, or otherwise while engaged
in the use of the parks, or while in or about the premises, arising
from accident or any injury not caused by act of the Borough. The
registrant further acknowledges that the use of the parks by themselves,
friends, relatives or otherwise is done at their own risk.

Activities sponsored by or supervised by the Board of Recreation
shall be subject to regulations adopted by the Board of Recreation
and approved by the Mayor and Borough Council.

The provisions of this section shall be enforced by the Borough
of Pompton Lakes Police Department.

Any person who violates any provision of this section is guilty
of a petty disorderly person offense and, upon conviction, is subject
to the following: a fine not exceeding $1,000 or imprisonment in the
County Jail for a period not exceeding 90 days or a period of community
service not exceeding 90 days, or any combination of the above. Community
service will consist of repairing, restoring, or remediating environmental
damage whenever possible.

Nothing in this section is intended or shall be read to conflict
or prevent the Borough from taking action against persons found to
be in violation of the Code.

Should any section, paragraph, sentence, clause, or phrase of
this section be declared unconstitutional or invalid for any reason
or preempted by Federal or state law, the remaining portions of this
section shall not be affected thereby and shall remain in full force
an effect, and to that end the provisions of this section are hereby
declared to be severable.

The purpose of this section shall be to protect the general
health, safety and welfare of the residents of the Borough of Pompton
Lakes and visitors to the Borough, provide safety to the residents
and visitors of the Borough, provide protection to the docks and ramps
located within the Borough, and to provide for an orderly procedure
for the use of the ramp and ramp area by boaters and visitors.

The following definitions apply to this section:
BOROUGH OF POMPTON LAKES RESIDENT
A Person owning a valid New Jersey driver's license
or other sufficient proof of residency in the opinion of the Borough
Clerk or their designee, which lists upon it the applicant's
name and an address located within the boundaries of the Borough of
Pompton Lakes.
NEW JERSEY STATE RESIDENT
A Person owning a valid New Jersey driver's license
or other sufficient proof of residency in the opinion of the Borough
Clerk or their designee, which lists upon it the applicant's
name and an address located within the boundaries of the State of
New Jersey.
OUT-OF-STATE RESIDENT
Any and all applicants that are neither residents of the
Borough of Pompton Lakes or the State of New Jersey.

A. No one shall be permitted use of the docks or launch for any and
all events and/or tournaments without obtaining a dock/launch permit
from the Borough of Pompton Lakes. Applicants for a permit must provide
proof of a valid registration of the vessel and a valid driver's
license and boating license (for power vessels).
B. No one shall be permitted use of the docks or launch for any and
all events and/or tournaments without obtaining a park use permit
from the Borough of Pompton Lakes.
C. No organization shall use the property herein described for an event
and/or tournament unless and until they have paid the required fee
to the Borough for a permit. Permits may be purchased from the Borough
Clerk or their designee.
D. Event permits for the dock and boat launch shall be issued for event
and/or tournament specified and are valid only for specific event/tournament
and date(s) for which they are issued.
E. The launch shall be closed one hour after sunset until one hour before sunrise, in accordance with subsection §
11-3.11.
F. The fee for event/tournament permits is as follows:

G. Upon obtaining a permit from the Borough for an event and/or tournament,
the permittee shall deposit with the Clerk or their designee prior
to the date of the event/tournament a cash bond for $500 for damage
and cleanup. Said bond shall be returned to the permittee.

A. Mooring of vessels shall not be permitted in the launch area so as
to restrict access to the ramp or dock.
B. No person shall obstruct the use of the launch and dock areas used
by the public.
C. Vessels and other watercraft passing within the vicinity of the launch shall do so at a speed in accordance with subsection
11-3.10 so as to prevent the creation of wakes which may endanger the safety and welfare of the public.
D. Waste shall not be deposited or disposed of into the water or left
on the docks.

A. Upon application for a permit for use of the Borough's dock
and/or boat launch, any group for an event, upon application for a
permit for use shall submit to the Borough Clerk or their designee,
together with their permit application, evidence of a paid insurance
policy naming the Borough of Pompton Lakes as additional insured covering
public liability for injury to any person or persons and property
damage with minimum limits of $1,000,000 per occurrence and $2,000,000
per aggregate. Nothing contained herein shall be construed to limit
acquisition of additional coverage.
B. Any group who agrees to use the Borough's boat launch or dock,
in addition to the insurance, agrees to hold harmless the Borough
against all loss and damage, including damage to person or property,
arising from any act by, or negligence of the restraint of their friends,
relatives, or otherwise while engaged in the use of the dock or boat
launch, or while in or about the premises, arising from accident or
any injury not caused by act of the Borough. The registrant further
acknowledges that the use of the boats or watercraft by themselves,
friends, relatives or otherwise is done at their own risk.

No person or persons shall operate or ride in any motorboat
or powerboat upon such part of Pompton Lakes or other waters as lie
within the Borough of Pompton Lakes or bound the Borough, whether
driven by a motor or engine built into such boat or by what is commonly
termed and known as an "outboard or detachable motor," without a muffler
on such motor or engine, or which shall make or cause any loud or
obnoxious noise or noises.

No person or persons shall operate or ride in any motorboat
or powerboat upon such part of Pompton Lakes or other waters as lie
within the Borough of Pompton Lakes or bound the Borough, which boat
is propelled or driven by a motor or engine built into such boat,
commonly known as an "inboard motor," of a horsepower greater than
10 horsepower S.A.E. rating.

No person or persons shall operate or ride in any motorboat
or powerboat upon such part of Pompton Lakes or other waters as lie
within the Borough of Pompton Lakes or bound the Borough, which boat
is propelled or driven by a motor or engine commonly known as an "outboard
or detachable motor," of a horsepower greater than 10 manufacturer's
advertised horsepower, excepting boats used for police or municipal
work.

No person or persons shall, while riding in any boat, motorboat,
canoe or raft upon Pompton Lakes or other waters within the bounds
of the Borough of Pompton Lakes or upon or near the banks of said
lake or other waters, make any loud or unnecessary noise or use any
profane, indecent or obscene language or, by any quarreling, shouting
or otherwise, disturb the public peace in the Borough.

No person or persons shall operate any motorboat or powerboat
upon such part of Pompton Lakes or other waters as lie within the
Borough of Pompton Lakes or bound the Borough at a speed to exceed
10 miles per hour.

No person or persons shall operate any motorboat or powerboat
upon such part of Pompton Lakes or other waters as lie within the
Borough of Pompton Lakes or bound the Borough one hour after sunset
until one hour before sunrise.

Each and every person violating any of the provisions of this
section shall, upon conviction thereof, forfeit and pay a fine of
not more than $100 or be imprisoned in the County Jail for not more
than 10 days, and the Judge before whom any such person may be brought
may impose such punishment by fine or imprisonment in the County Jail
as he may see fit, not exceeding the maximum herein fixed.

Nothing in this section is intended or shall be read to conflict
or prevent the Borough from taking action against persons found to
be in violation of the Code.
