A. 
The Board of Supervisors may grant a modification or waiver of the requirements of one or more provisions of this chapter for the following reasons, provided that such modification or waiver will not be contrary to the public interest and that the purposes of this chapter are observed:
(1) 
Hardship. The literal enforcement of the provision will exact undue hardship because of peculiar conditions pertaining to the land in question; or
(2) 
Alternative standard. An alternative standard can be demonstrated to provide equal or better results.
B. 
All requests for modifications or waivers shall be in writing and shall accompany and be a part of the application. The requests shall state in full the grounds and facts of hardship or evidence of equal or better result on which the request is based, the provision or provisions of this chapter involved and the minimum modification necessary.
C. 
The Board of Supervisors shall refer all requests for waivers to the Planning Commission for review. The Planning Commission shall study the request, make findings, record the findings in its minutes, and submit the findings to the Board of Supervisors.
D. 
The Board of Supervisors shall keep a written record of all actions on requests for modifications.
A. 
The Township shall keep a record of its findings, decisions, and recommendations relative to all subdivision plans filed with it for review.
B. 
All such records shall be public records.
