[HISTORY: Adopted by the Board of Supervisors of the Township of North Franklin 10-13-1969 by Ord. No. 1-69 (Ch. 6, Part 1, of the 1988 Code of Ordinances). Amendments noted where applicable.]
No child under the age of 18 years shall be upon any of the streets, alleys, or other public places in the Township between the hours of 10:00 p.m. and 5:00 a.m., Eastern standard time or Eastern daylight savings time, whichever may be in effect at the time on Monday through Friday, or between the hours of 11:00 p.m. and 5:00 a.m. on Saturday and Sunday, unless such child is accompanied by his or her parent or guardian or the person having the legal care and custody of such child, or is accompanied by a responsible person over the age of 21 years, or is in the performance of an errand or duty directed by his or her parent, guardian, or legal custodian.
No parent, guardian or person having the legal care or custody of a child under the age of 18 years shall allow or permit such child to go or be in or upon any of the streets, alleys, or other public places in the Township between the hours stated in § 148-1 except as specified in § 148-1 of this chapter and unless reasonable necessity can be shown therefor.
Any child under the age of 18 years found upon any of the streets, alleys, or other public places in the Township, in violation of § 148-1 of this chapter, shall be taken into custody by any member of the Police Department of the Township and delivered to his or her parent, guardian or legal custodian at the police station and report shall be made by such policeman within 24 hours to the Chief of Police, who shall make a record thereof in a book to be kept for the purpose. The Chief of Police shall thereupon send to the parent, guardian or legal custodian of such child a written notice of the violation of this chapter, together with a notice to such parent, guardian or legal custodian that unless the terms of this chapter are complied with in the future, the penalty thereof will be invoked against such parent, guardian or legal custodian of such child.

If any parent, guardian or legal custodian of any child shall, after having received a notice as is prescribed in § 148-3 of this chapter, again allow or permit such child to be in or upon any of the streets, alleys, or other public places in the Township, in violation of § 148-1 of this article, such parent, guardian or legal custodian shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 and/or to imprisonment for a term not to exceed 90 days.
Any child who shall violate this chapter more than three times shall be reported to a society or organization, the purpose of which is to take charge of incorrigibles and delinquents, and proceedings shall then be taken in the court of quarter sessions or juvenile court for the permanent welfare of such child, and a like procedure shall be taken in cases where the arrest of the parent, guardian or legal custodian shall not be effective, or where for any other reason the provisions of § 148-1 of this chapter cannot be made effective by fines and penalties imposed under any other section of this chapter.
The police officers of the Township, in taking children into custody under this chapter, shall use their discretion in determining age and in doubtful cases may require positive proof, and, until such proof is furnished, the officer's judgment shall prevail.
A. 
It shall be unlawful for any owner or operator of any establishment, or their servants, agents or employees, knowingly to permit any minor or minors to remain upon the premises of said establishment between the hours and on the days and nights as set forth in §§ 148-1 and 148-2 of the within chapter.
B. 
Any person, firm or corporation who shall violate any provision of this § 148-7 shall, upon conviction thereof, be sentenced to pay a fine of not more than $300 and/or to imprisonment for a term not to exceed 90 days. Every day that a violation of this § 148-7 continues shall constitute a separate offense.
