There shall be a Borough Clerk appointed by the Mayor and Borough Council. The term of office of the Clerk shall be three years which shall run from January 1 in the year in which the Clerk was appointed.

The Duties of the Borough Clerk:
To maintain a record of all ordinances;
To keep the minutes of the Governing Body;
To have custody of the seal of the municipality and all papers and records thereof;
To process, record and file all Resolutions;
To record and file the Municipal Budget;
To record bids for municipal equipment;
To administer and record oaths of office;
To issue licenses;
To furnish data to the public media;
To purchase supplies and equipment, when required;
To receive and file bonds and insurance policies;
To maintain personnel records;
To direct correspondence and inquiries for action to various municipal departments;
To conduct business with other municipal departments as directed by the Governing Body;
To supervise all employees and personnel assigned to the office of the Borough Clerk;
To perform such other or additional duties as may be required by the Governing Body of the Borough of Woodbine.
b. 
The Duties of the Borough Clerk as Election Official:
Shall register voters and transmit registration lists to the County Board of Elections;
Shall certify to the County Clerk all offices up for election;
Shall certify to the County Clerk all petitions of candidacy for the primary election;
Shall advertise in the newspaper the time, place and purpose of the primary election and places of registration;
Shall have the official primary ballot printed;
Shall keep custody of the printed ballots;
Shall deliver to the members of the local Board of Elections all records and equipment required to hold the election which he may have received from the County Clerk;
Shall keep his/her office open until all such equipment and records are returned;
Shall canvass the statements of the District Election Boards and issue Certificates of Election to each person shown by the returns to have been so elected.

a. 
Office Created. Pursuant to N.J.S.A. 40:46-2.1 the off-ice of Deputy Borough Clerk is hereby created in the Borough.
b. 
Appointment and Confirmation. The Deputy Borough Clerk shall be appointed by the Mayor and confirmed by the Council in accordance with the laws relating to appointive officers.
c. 
Terms of Office. The term of office of the Deputy Borough Clerk shall be for one year and shall continue until the successor to the office shall have been appointed and confirmed or until the office shall have been abolished.
d. 
Powers and Duties. The duties of the Deputy Borough Clerk are:
1. 
To perform all of the duties of the Borough Clerk in the absence of the Borough Clerk or when specifically assigned to do so;
2. 
To perform such other duties as may be assigned by the Borough Clerk;
3. 
To perform such other duties as may be assigned by written rule, regulation, resolution or directive of the Governing Body.
e. 
Compensation. The compensation of the Deputy Borough Clerk shall be as provided in the Salary Ordinance.

Chapter 110 of the Laws of 1988 became effective August 22, 1988, which amends P.L. 1971, c. 413 and P.L. 1977, c. 39, and supplements Chapter 9 of Title 40A of the New Jersey Statutes and requires every municipality in the State of New Jersey to create the position of "Chief Financial Officer". "Chief Financial Officer" shall be a suitable person who is a Certified Municipal Finance Officer appointed by the municipality to carry out the responsibilities set forth under P.L. 1947, c. 151, otherwise known as N.J.S. 52:27 (bb)-26, et seq. Section 5 of said Act (otherwise known as N.J.S.A. 40A:9-140.10) requires that the Governing Body of each municipality shall, by ordinance, create the position of Chief Financial Officer and establish the compensation therefor.

The purpose of this section is to create the position of "Chief Financial Officer" in compliance with the requirements established by Chapter 110, Laws of New Jersey, 1988, which is also known as the Municipal Finance Officer's Certification Bill, which was signed into law on August 22, 1988 and which became effective on that date.

The Mayor and Council hereby establish the position of Chief Financial Officer who shall be under the general supervision of the Governing Body and under the specific direction of the Mayor.

The appointment to the position of Chief Financial Officer shall be made by the Mayor and Council, as the Governing Body of the Borough. The appointment shall be made by Resolution duly adopted by the Borough Council and the appointment shall be for the term prescribed by law. The individual so appointed shall possess all of the requisite qualifications and experience required by law and, specifically, Chapter 110 of the Laws of 1988, and Chapter 9 of Title 40A of the New Jersey Statutes, as amended and supplemented.

The term of office of the Chief Financial Officer shall be for a term of one year. A Chief Financial Officer who has served in that position for a period of not less than five consecutive years and who is the holder of a Municipal Finance Officer Certificate issued in accordance with P.L. 1971, c. 413 (N.J.S.A. 40A:9-140.1, et seq.), shall be granted tenure of office upon filing with the Borough Clerk and with the Division of Local Government Services in the Department of Community Affairs, a notification evidencing his compliance with this section. Thereafter, such person shall continue to hold office during good behavior and efficiency and shall not be removed therefrom except for just cause; and then only after a public hearing upon a written complaint setting forth the charge or charges against him as required by law or upon expiration or revocation of Certification by the Director of the Division of Local Government Services.

Nothing contained within this section shall be construed as prohibiting an individual holding the position of Municipal Treasurer, Assistant Treasurer or Municipal Finance Officer from being appointed to the position of Chief Financial Officer, provided such individual possesses the required qualifications.

The Chief Financial Officer shall have responsibility for the fiscal records of the Borough of Woodbine. In addition, the Chief Financial Officer shall perform the following duties:
a. 
Supervise the expenditure of all Borough funds and make certain that such expenditure is strictly in accordance with the budgetary appropriation;
b. 
Assist in the preparation of the Annual Municipal Budget;
c. 
Issue Certificates as to the availability of funds prior to the Borough entering into any contract pursuant to the provisions of the Local Public Contracts Law of the State of New Jersey;
d. 
Supervise the payroll accounts of the Borough;
e. 
Issue payroll checks to all officials, officers and employees of the Borough;
f. 
Prepare and distribute all informational returns and payroll reports required by any agency of the Federal or State government concerning any payments made to officials, officers, employees and vendors of the Borough;
g. 
Supervise the method and procedures for the payment of all claims against the Borough;
h. 
Supervise all investments of the Borough and make recommendations, where appropriate, to the Borough Council concerning investments or any other matter touching upon the financial affairs of the Borough; and
i. 
Perform such further and additional duties as may be prescribed by the Borough Council.

The duties of the Municipal Treasurer are:
a. 
To assist the Mayor and other members of the Council in preparation of the annual budget;
b. 
To keep and maintain books and records of all financial transactions of the municipality in accordance with the standards and requirements of the State Division of Local Government Services;
c. 
To have custody of all public moneys of the municipality;
d. 
To make, or cause to be made, monthly reports to the Council of all receipts, expenditures, commitments and unencumbered appropriation balances;
e. 
To compile, at the close of the fiscal year, a true and full account of the receipts of the Treasurer's Office and the expenditures during the year and also the state of the treasury;
f. 
To supervise all employees and personnel assigned to the office of the Municipal Treasurer;
g. 
To perform such other or additional duties as may be required by the Borough Council of the Borough of Woodbine.

The duties of the Tax Collector are:
a. 
Receive and collect all moneys assessed or raised by taxation or assessment for any purpose;
b. 
Enter into the suitable books of account all receipts received in any given day;
c. 
Deposit such public moneys in an authorized public depository of the municipality to the credit of the appropriate account within 48 hours (or the first banking day) after the receipt of said funds;
d. 
Prepare monthly reports to the Governing Body on all receipts, deposits and cash on hand belonging to the municipality;
e. 
Prepare and furnish a detailed and true list of all delinquent taxpayers for the next preceding year within 60 days after the end of the fiscal year or for such period as the local governing unit may require;
f. 
To supervise all employees and personnel assigned to the office of Tax Collector;
g. 
To perform such other or additional duties as may be required by the Borough Council.

The duties of the Deputy Tax Collector are:
a. 
To perform all of the duties of the Tax Collector in the absence of the Tax Collector or when specifically assigned to do so;
b. 
To perform such other duties as may be assigned by the Tax Collector;
c. 
To perform such other duties as may be assigned by written Rule, Regulation, Resolution or directive of the Governing Body of the Borough of Woodbine.

The duties of the Tax Assessor are:
a. 
To review, audit and determine the taxable valuations of each taxpayer in taxing district required to file a personal property tax return with him;
b. 
Determine the taxable value of tangible personal property not used in business;
c. 
On or before January 10th of each year, complete the above mentioned review;
d. 
Compile a tax list and duplicate including therein the taxable valuation of tangible personal property;
e. 
Ascertain the names of the owners of all real property situate in the Assessor's taxing district;
f. 
After examination and inquiry, determine the full and fair value of each parcel of real property at such price as, in the Assessor's judgment, it would sell for at a fair and bona fide sale by private contract on October 1st next preceding the date on which the assessment was completed.

The purpose of this section is to create the administrative mechanisms needed for the execution of the Borough of Woodbine's responsibility to assist in the provision of affordable housing pursuant to the Fair Housing Act of 1985.

As used in this section, the following terms shall have the meanings indicated:
ADMINISTRATIVE AGENT
Shall mean the entity responsible for administering the affordability controls of some or all units in the affordable housing program for the Borough of Woodbine to ensure that the restricted units under administration are affirmatively marketed and sold or rented, as applicable, only to low- and moderate-income households.
MUNICIPAL HOUSING LIAISON
Shall mean the employee charged by the Governing Body with the responsibility for oversight and administration of the affordable housing program for the Borough of Woodbine.

a. 
Establishment of Position of Municipal Housing Liaison. There is hereby established the position of Municipal Housing Liaison for the Borough of Woodbine.
b. 
Subject to the approval of the Council on Affordable Housing (COAH), the Municipal Housing Liaison shall be appointed by the Governing Body and may be a full or part-time municipal employee.
c. 
The Municipal Housing Liaison shall be responsible for oversight and administration of the affordable housing program for the Borough of Woodbine, including the following responsibilities which may not be contracted out, exclusive of item 6 which may be contracted out:
1. 
Serving as the Borough of Woodbine's primary point of contact for all inquiries from the State, affordable housing providers, Administrative Agents, and interested households;
2. 
Monitoring the status of all restricted units in the Borough of Woodbine's Fair Share Plan;
3. 
Compiling, verifying, and submitting annual reports as required by COAH;
4. 
Coordinating meetings with affordable housing providers and Administrative Agents, as applicable;
5. 
Attending continuing education opportunities on affordability controls, compliance monitoring, and affirmative marketing as offered or approved by COAH;
6. 
If applicable, serving as the Administrative Agent for some or all of the restricted units in the Borough of Woodbine as described in paragraph f below.
d. 
Subject to approval by COAH, the Borough of Woodbine may contract with or authorize a consultant, authority, government or any agency charged by the Governing Body, which entity shall have the responsibility of administering the affordable housing program of the Borough of Woodbine, except for those responsibilities which may not be contracted out pursuant to paragraph c above. If the Borough of Woodbine contracts with another entity to administer all or any part of the affordable housing program, including the affordability controls and Affirmative Marketing Plan, the Municipal Housing Liaison shall supervise the contracting Administrative Agent.
e. 
Compensation. Compensation shall be fixed by the Governing Body at the time of the appointment of the Municipal Housing Liaison.
f. 
Administrative Powers and Duties Assigned to the Administrative Agent. The Administrative Agent shall have authority to take all action necessary and appropriate to carry out its responsibilities hereunder:
1. 
Affirmative Marketing.
(a) 
Conducting an outreach process to insure affirmative marketing of affordable housing units in accordance with the Affirmative Marketing Plan of the Borough of Woodbine and the provisions of N.J.A.C. 5:80-26.15; and
(b) 
Providing counseling or contracting to provide counseling services to low- and moderate-income applicants on subjects such as budgeting, credit issues, mortgage qualification, rental lease requirements, and landlord/tenant law.
2. 
Household Certification.
(a) 
Soliciting, scheduling, conducting and following up on interviews with interested households;
(b) 
Conducting interviews and obtaining sufficient documentation of gross income and assets upon which to base a determination of income eligibility for a low- or moderate-income unit;
(c) 
Providing written notification to each applicant as to the determination of eligibility or noneligibility;
(d) 
Requiring that all certified applicants for restricted units execute a certificate substantially in the form, as applicable, of either the ownership or rental certificates set forth in Appendices J and K of N.J.A.C. 5:80-26.1 et seq.;
(e) 
Creating and maintaining a referral list of eligible applicant households living in the housing region and eligible applicant households with members working in the housing region where the units are located; and
(f) 
Employing the random selection process as provided in the Affirmative Marketing Plan of the Borough of Woodbine when referring households for certification to affordable units.
3. 
Affordability Controls.
(a) 
Furnishing to attorneys or closing agents forms of deed restrictions and mortgages for recording at the time of conveyance of title of each restricted unit;
(b) 
Creating and maintaining a file on each restricted unit for its control period, including the recorded deed with restrictions, recorded mortgage and note, as appropriate;
(c) 
Ensuring that the removal of the deed restrictions and cancellation of the mortgage note are effectuated and properly filed with the appropriate county's register of deeds or county clerk's office after the termination of the affordability controls for each restricted unit;
(d) 
Communicating with lenders regarding foreclosures; and
(e) 
Ensuring the issuance of continuing certificates of occupancy or certifications pursuant to N.J.A.C. 5:80-26.10.
4. 
Resale and Rental.
(a) 
Instituting and maintaining an effective means of communicating information between owners and the Administrative Agent regarding the availability of restricted units for resale or rental; and
(b) 
Instituting and maintaining an effective means of communicating information to low- and moderate-income households regarding the availability of restricted units for resale or rerental.
5. 
Processing Request from Unit Owners.
(a) 
Reviewing and approving requests from owners of restricted units who wish to take out home equity loans or refinance during the term of their ownership;
(b) 
Reviewing and approving requests to increase sales prices from owners of restricted units who wish to make capital improvements to the units that would affect the selling price, such authorizations to be limited to those improvements resulting in additional bedrooms or bathrooms and the cost of central air conditioning systems; and
(c) 
Processing requests and making determinations on requests by owners of restricted units for hardship waivers.
6. 
Enforcement.
(a) 
Securing annually lists of all affordable housing units for which tax bills are mailed to absentee owners and notifying all such owners that they must either move back to their unit or sell it;
(b) 
Securing from all developers and sponsors of restricted units, at the earliest point of contact in the processing of the project or development, written acknowledgment of the requirement that no restricted unit can be offered, or in any other way committed, to any person, other than a household duly certified to the unit by the Administrative Agent;
(c) 
The posting annually in all rental properties, including two-family homes, of a notice as to the maximum permitted rent together with the telephone number of the Administrative Agent where complaints of excess rent can be made;
(d) 
Sending annual mailings to all owners of affordable dwelling units, reminding them of the notices and requirements outlined in N.J.A.C. 5:80-26.18(d)4;
(e) 
Establishing a program for diverting unlawful rent payments to the municipality's affordable housing trust fund or other appropriate municipal fund approved by the DCA;
(f) 
Creating and publishing a written operating manual, as approved by COAH, setting forth procedures for administering such affordability controls; and
(g) 
Providing annual reports to COAH as required.
