City of Albany, NY Chapter 35 Appointees to Public Bodies; Removal From Office

§ 35-1 Definitions.

For the purposes of this chapter:

APPOINTEE

Any individual appointed to a public body for a fixed term of office.

PUBLIC BODY

Shall mean, but not be limited to, any board, commission, authority, committee or task force established under this code or by a legislative action of the Common Council.

§ 35-2 Removal of appointees from office.

Any appointee of a pubic body may be removed prior to the expiration of their term of appointment for cause by the appointing authority following notice for the grounds for removal and an opportunity to be heard.

§ 35-3 Applicability.

The provisions of this chapter shall apply in instances where a removal for cause of an appointee is not otherwise provided for in the authorizing enactment of a public body or under the City Charter.
