Offenses against the public peace, safety and morals include
all of the following:
A.
Littering or destruction or defacing of public property owned by
the city, county or state.
B.
Destruction of playground equipment and public parks.
C.
Vandalism.
D.
Consumption of alcoholic beverages on a public street.
E.
Lack of supervision by a parent, legal guardian or other person having
care or custody of a minor child under the age of 18 years (a "person"
is defined as being parents, guardians or persons having custody or
control and acting in the position of loco parentis).
It shall be unlawful for any parent, legal guardian or any other
person having care or custody of a minor child under the age of 18
years, by any act or conduct or failure to encourage, to contribute
to, cause or tend to cause said child to become delinquent by reason
of the activities of said minor child within the City of South Amboy.
"Supervision" is defined as the exercise of control over a minor
child, knowing his whereabouts, knowing with whom he associates and
in what activities he or she may engage which could affect or offend
the public peace, safety and morals.
It shall be unlawful for any parent, legal guardian or any other
persons having care or custody of a minor child under the age of 18
years to assist, aid, abet, allow, permit or encourage said minor
to violate provisions of this Article or any other ordinance of the
City of South Amboy as defined herein, either by overt act, by failing
to act or by lack of supervision and control over said minor child.
Any minor who is under the age of 18 years of age, apprehended
for the violation of this Article, any laws of the State of New Jersey,
ordinances of this municipality or any federal statutes shall be brought
forthwith before the judge of the Middlesex County Juvenile Division
of the Juvenile and Domestic Relations Court, and the parent or legal
guardian or other person having care or custody of said minor child
shall be summoned and brought before the Judge in the Municipal Court
of the City of South Amboy when said minor child is apprehended. The
said minor child shall be held and tried according to the direction
and orders of the Judge of the Juvenile Division of the Juvenile and
Domestic Relations Court and the applicable rules and statutes thereof,
and the parent, legal guardian or other persons having legal care
or custody of said minor child as aforesaid who shall fail to provide
supervision of said minor child as aforesaid, after the first offense
by said minor, shall be subject to the penalties herein provided.
It shall be unlawful for anyone to offend against the peace,
morals and safety or to fail to supervise a minor child under the
age of 18 years who has been forced to appear before a court of competent
jurisdiction for any violation of any statute or municipal ordinance,
and it shall be punishable by a fine of not more than $500 or by imprisonment
of not more than 90 days, or both.
The fact that a child under the age of 18 years is adjudicated
to be a juvenile delinquent as a result of a second violation of this
Article, any ordinance of the City of South Amboy or any statute of
the state or federal government shall be prima facie evidence of a
violation of this Article on the part of the parents, legal guardians
or other persons having care or custody of said minor.
