A. Words and phrases. Whenever any
words and phrases are used in this chapter, the meanings respectively
ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes
of New Jersey shall be deemed to apply to such words and phrases used
herein.
B. Official time standard. Whenever
certain hours are named in this chapter, they shall mean either Eastern
standard time or Eastern daylight saving time as may be in current
use.
A. The Township Manager or, in the
event of his absence, disability or inability to act, the Chief of
Police of the municipality is hereby authorized to provide by regulation
for the closing of any street or portion thereof to motor vehicle
traffic on any day or days during specified hours on any day or days
whenever he finds that such closing is necessary for the preservation
of the public safety, health or welfare.
B. Any regulation promulgated by the Township Manager or Chief of Police and in accordance with Subsection
A above shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
C. Any violation of a regulation
promulgated under this section shall be punished by a fine not to
exceed $55.

D. Any regulation adopted that mandates
the closing of any street for a period greater than 48 consecutive
hours shall not become effective unless and until it has been submitted
to and approved by the Commissioner of the Department of Transportation.
If any part or parts of this chapter are held to be invalid
for any reason, such decision shall not affect the validity of the
remaining portions of this chapter.
Any vehicle parked in violation of this chapter shall be deemed
a nuisance and a menace to the safe and proper regulation of traffic,
and any peace officer may provide for the removal of such vehicle.
The owner shall bear the reasonable costs of removal and storage which
may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey statute
or this chapter, every person convicted of a violation of a provision
of this chapter or any supplement thereto shall be liable to a penalty
of not more than $55 or imprisonment for a term not exceeding 15 days
or community service for a term not exceeding 15 days.
All former traffic ordinances of the Township of Pequannock
are hereby repealed, and all ordinances or parts of ordinances in
conflict with or inconsistent with the provisions of this chapter
are hereby repealed, except that this repeal shall not affect or prevent
the prosecution or punishment of any person for any act done or committed
in violation of any ordinance hereby repealed prior to the taking
effect of this chapter.
The provisions of this chapter imposing a time limit on parking
shall not relieve any person of the duty to observe other or more
restrictive provisions prohibiting or limiting the stopping, standing
or parking of vehicles as set forth in N.J.S.A. 39:4-138 or any other
New Jersey statute or as hereinafter provided.
A. Upon the declaration of an emergency,
there shall be no parking upon streets or sections of streets where
temporary emergency no parking signs are displayed. The Chief of Police
or, in his absence, the ranking police officer is authorized to declare
an emergency and to direct the posting of said emergency no parking
signs when weather conditions, accidents, fires or public celebrations
dictate or require the avoidance of hazards or other conditions which
interfere with the free flow of traffic. Notification that the emergency
no parking signs are being or will be posted shall be given to the
operator or owner of any vehicle which has been parked prior to the
posting of the signs.
B. The effectiveness of this section
is contingent upon the signs being erected as required by law.

A. Prohibition on parking when roads
are snow covered. No vehicles shall be parked on any street, highway,
or portion thereof within the Township whenever snow or ice has fallen
and the accumulation is such that the Township determines that roads
must be treated. This prohibition shall remain in effect until the
streets have been plowed to the extent that parking will not interfere
with the normal flow of traffic. It shall be a violation of this chapter
to park a vehicle in violation of this section.
B. Any unoccupied vehicle parked
or standing in violation shall be deemed a nuisance and a menace to
the safe and proper regulation of traffic, and any peace officer may
provide for the removal of such vehicle. The owner shall pay the reasonable
costs of the removal and storage which may result from such removal
before regaining possession of the vehicle.
C. Signs shall be placed at appropriate
locations indicating that parking is prohibited throughout the Township
when roads are snow or ice covered.
A. Pursuant to N.J.S.A. 40:48-2.46
the following are prohibited in any areas which are open to the public
and to which the public is invited:
(1) Parking any motor vehicle
within any area which is adjacent to any building or structure.
(2) Parking any motor vehicle
in such a way as to impede ingress or egress to any parking area.
(3) Parking any motor vehicle
in any area other than in a designated parking area or outside of
or straddling the lines in the parking area.
(4) Parking any motor vehicle
in any parking area which is open to the public after the building
for which the parking is provided has closed for the night. This provision
is intended to be operative between the hours of sunset and sunrise
and is not intended to include any motor vehicle which is lawfully
parked on the premises by license or permit of the Township.

(5) Motor vehicle parking is
prohibited on all fire company property which has been posted with
the following designated sign: "No Parking - Fire Emergency Only;
Unauthorized Vehicles Will Be Towed."
B. This section shall be enforced
by the Township Police Department and a complaint may be signed on
information and belief.
C. Violations of this section may be punished by a fine not exceeding $500 or by imprisonment for a period of not exceeding 90 days, or both, and towing charges and impounding fees for impounding shall not exceed the amount provided in Chapter
152, Fees, in addition to the penalty provided for elsewhere. Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic; any peace officer may provide for the removal of such vehicle. The owner shall pay the reasonable cost of the removal and storage which may result from such removal before regaining possession of the vehicle.

A. The Council hereby finds and
declares that problems of traffic control occur when traffic must
be moved through or around road or street construction, maintenance
operations and utility work above or below ground which requires blocking
the roadway and obstructing the normal flow of traffic and that such
obstructions are or can become dangerous when not properly controlled.
In order to better promote the public health, safety, peace, and welfare,
it is necessary to establish controls and regulations directed to
the safe and expeditious movement of traffic through construction
and maintenance zones and to provide safety for the work forces performing
these operations. The Township of Pequannock in the County of Morris,
State of New Jersey, does hereby adopt the current Manual on Uniform
Traffic Control Devices, hereafter known as "MUTCD," except as hereby
supplemented and amended, as it controls and regulates whenever construction,
maintenance operations or utility work obstructs the normal flow of
traffic. Any person, contractor, or utility which fails to comply
with the provisions of MUTCD while performing such work is in violation
of this section.

B. Preconstruction meeting. It shall
be the responsibility of the person or contractor, or in the case
of a public utility, as required under the public utility agreement,
wishing to conduct work on, under or above the roadway to contact
the Traffic Bureau of the Pequannock Township Police Department in
order to arrange a preconstruction meeting to submit plans for the
safe movement of traffic during such period of construction or work.
Any person, contractor, or utility which fails to comply with this
section prior to the start of such work or whose plans are not approved
by the Traffic Bureau of the Pequannock Township Police Department
is in violation of this section. Public utilities conducting routine
maintenance work need not comply with the preconstruction meeting
requirement.

C. Emergency contact telephone numbers.
The person, contractor or utility shall provide the Traffic Bureau
with at least two emergency contact phone numbers to be called in
case of emergency problems at the construction or maintenance site
prior to the start of any work. If, for any reason, emergency contacts
cannot be reached or if the emergency contact person does not respond
to a call from the Police Department to correct a hazardous condition,
the Township may respond to correct such hazardous condition. The
reasonable fees for such emergency services by the Township shall
be charged to the person, contractor or utility responsible for such
condition.
D. Heavily traveled roads. The Township
of Pequannock Police Department Traffic Bureau shall maintain a list
of all roads determined to be heavily traveled for the purpose of
this section. Such determination shall be made by the Police Department
Traffic Bureau and shall be binding. Said list may be amended from
time to time as conditions warrant to include roads which become heavily
traveled due to temporary conditions or events. This list shall be
available for inspection during normal business hours, and a copy
shall be provided upon request of any party.
E. Time limits. There shall be no
construction, maintenance operations or utility work under, on or
above any heavily traveled roadway in the Township before the hour
of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to
permit work prior to 9:00 a.m. or after 4:00 p.m. by the officer in
charge of the Traffic Bureau of the Pequannock Township Police Department.
If it is determined by the officer in charge of the Traffic Bureau
that the construction or maintenance operations prior to 9:00 a.m.
or after 4:00 p.m. on any roadway would substantially delay traffic
or cause a safety or health hazard, the work shall then be permitted
only between 9:00 a.m. and 4:00 p.m.
F. Road closings and detours. Road
closings and/or traffic detours shall not be permitted unless approved
by the Pequannock Police Traffic Bureau.
G. Traffic directors. Traffic directors
shall be posted at all construction or maintenance sites when determined
by the Pequannock Township Police Traffic Bureau that the same is
necessary to provide for the safety and expeditious movement of traffic.
Traffic directors shall be qualified personnel as determined by the
Chief of Police.
H. Stop-work order. The Traffic
Bureau of the Pequannock Township Police Department shall have the
authority to stop work, including the removal of equipment and vehicles,
stored material within the street right-of-way, backfilling of open
excavations and/or other related work, in order to abate any nuisance,
traffic delay and/or safety hazard or for any violation of this section.
I. Emergency repair work. In case
of emergency repair work where construction maintenance operations
or emergency utility work must be performed that will obstruct, interfere
or detour traffic on any roadway in the Township, the person, contractor
or utility performing such operation shall notify the Pequannock Police
Department of such emergency operation. The person, contractor or
utility shall disclose the nature of the emergency, location, and
hours of operation. All emergency construction and maintenance operations
shall be performed with full regard to safety and to keep traffic
interference to an absolute minimum. During such emergency repair
work, the person, contractor or utility shall comply with the provisions
of the MUTCD while performing such emergency repair work.
J. Violations and penalties. Any
person, contractor or utility which commits a violation of this section
shall, upon conviction thereof for a first offense, pay a fine of
not less than $100 nor more than $500 and/or be imprisoned in the
county jail for a term not exceeding 90 days; for a second offense,
upon conviction thereof, pay a fine of not less than $250 and/or be
imprisoned in the county jail for a term not exceeding 90 days; and
for a third or subsequent conviction pay a fine of not less than $500
and/or be imprisoned in the county jail for a term not exceeding 90
days. A separate offense shall be deemed committed on each day during
or on which a violation occurs or continues.

A. Parking
of vehicles in excess of 10 tons prohibited. No person shall park
a truck, tractor, trailer, semitrailer or omnibus having registered
gross weight in excess of 20,000 pounds (10 tons) upon any street
at any time.
B. Overnight
parking of certain vehicles prohibited.

(1) It shall be unlawful for
any person to park the following described vehicles upon any Township
or county street located within the Township of Pequannock between
the hours of 11:00 p.m. and 6:00 a.m. on any day:
(a) Any commercial vehicle having a gross weight of 7,200 pounds or more
and/or a maximum length of 19 feet, including vans registered with
commercial plates, vans for commercial purposes, contracting equipment,
vehicles registered as livery vehicles, taxis or any other business
intended vehicle for transportation of passengers for a fee. Township
of Pequannock emergency vehicles are excluded.
(b) All recreation vehicles having a gross weight of 5,200 pounds and/or
a maximum length of 15 feet, including but not limited to motor homes,
all-terrain vehicles, campers, boat trailers, utility trailers, landscaping
trailers or any other type of trailer requiring a New Jersey Motor
Vehicle Commission registration plate, whether such registration plates
are considered under Motor Vehicle Commission regulations to be commercial
or private plates.
(c) Any vehicles having more than four wheels exclusive of a spare wheel
intended to be used as a spare tire.
(d) Any attached trailer or unattached trailer regardless of the status
of the registration of the vehicle said trailer is attached to.
(2) The provisions of this subsection
are not intended to prohibit vehicles parking on any Township or county
street located within the Township of Pequannock between the hours
of 11:00 p.m. and 6:00 a.m. that are registered as a private passenger
vehicle but not limited and used for personal transportation only,
including vehicles commonly referred to as sport utility vehicles,
family vans, rear open bed pickup trucks and utility vans.
(3) There shall be no prohibition
in this subsection on the parking of any vehicles for the purpose
of installing, maintaining or performing public utility services.
(4) Whenever certain hours are
named in this subsection, they shall mean either Eastern standard
time or Eastern daylight saving time, as may be in current use by
the Township.
(5) The owner of any vehicle
described herein who shall violate or fail to comply with any provisions
of this subsection, upon conviction thereof, shall be assessed a fine
of $55 for the first offense and $200 for each subsequent offense.

(5) The owners of the premises referred to in Subsection
B(3) and
(4) shall provide and install signs and pavement markings for each parking space reserved for use by handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall, subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Township. The owner shall be responsible for the repair and restoration or replacement of the same.

A. Definitions. Unless specifically
provided, the following words and terms shall be construed and defined
as follows:
LOW-SPEED VEHICLE
A four-wheeled low-speed vehicle, as defined in 49 CFR 571.3(b),
whose attainable speed is more than 20 miles per hour but not more
than 25 miles per hour on a paved level surface and which is not powered
by gasoline or diesel fuel and complies with federal safety standards
as set forth in 49 CFR 571.500.

B. Prohibition on the use of low-speed
vehicles on municipal streets and roads. It shall be a violation of
this chapter to operate a low-speed vehicle upon any public road or
highway under the jurisdiction of the Township of Pequannock.
