The Board of Supervisors may from year to year
prescribe or change the rates of charge for the extraordinary use
of the streets and roads in sanitary districts hereinafter included
in this article, said rates of charge to be a one-time user fee charged
to the owners of lots in said sanitary district upon which new construction
is commencing. Such charge is to be established or increased only
after an advertised public hearing. This rate of charge shall be paid
by or on behalf of such owner at the time application for a building
permit for a dwelling or other principal structure is made to the
Building Official. Such funds, less any administrative expense incurred
by the County, shall be deposited into the appropriate sanitary district
fund to be used for road repairs and/or maintenance within the sanitary
district in the same manner as other sanitary district taxes and fees.
It shall be unlawful for any person to commence
or cause to be commenced any new construction of a dwelling or other
principal structure requiring a building permit in any sanitary district
to which this article applies without first having paid said user
fee. Failure of the Building Official to collect the user fee prior
to the issuance of a permit shall not relieve the lot owner from the
responsibility of paying said fee.
Any person who commences or causes to be commenced
any new construction requiring a building permit in any sanitary district
to which this article applies without first having paid said fee shall
be deemed to have violated the provisions of this article and shall,
upon conviction, be punished as a Class One misdemeanor in accordance
with the Code of Virginia.

The user fee authorized by the article shall
apply to the following sanitary districts:
A. Within the boundary lines of the Skyland Estates Sanitary
District.
B. Within the boundary lines of the Blue Mountain Sanitary
District.
C. Within the boundary lines of the Shenandoah Farms
Sanitary District.
D. Within the boundary lines of the Shenandoah Shores
Sanitary District.
E. Within the boundary lines of the High Knob Sanitary
District.
F. Within the boundary lines of the Linden Heights Sanitary District.
