This chapter shall be known as the "Brady Township Recreational Vehicle Park/Campground Ordinance."
The purpose of this chapter is to set forth minimum standards for design and maintenance of recreational vehicle parks/campgrounds, the basis for permitting and regulating the design and maintenance and permitting inspection of the related facilities within Brady Township, Butler County, and Pennsylvania.
As used in this chapter, the following terms shall have the meanings indicated:
CAMPING UNIT
A tent, trailer, cabin, lean-to, recreation vehicle, or similar structure established or maintained and operated in a campground as temporary living quarters for any purpose.
CAMPSITE
Any plot or ground within a campground intended for exclusive occupancy by a camping unit or units under the control of a camper.
DEPARTMENT
The Department of Environmental Protection of the Commonwealth of Pennsylvania and its authorized representatives.
PERSON
An individual, partnership, corporation, association, or any other entity.
RECREATIONAL VEHICLE
A vehicular type unit primarily designed as temporary living quarters for recreational, camping or travel uses, which either has its own mode of power or is mounted, or drawn by another vehicle. The basic versions are: travel trailer, camping trailer, truck camper and motor home.
RECREATIONAL VEHICLE PARK/CAMPGROUNDS
A parcel (or contiguous parcels) of land which has been so designated and improved so as to contain four or more recreational vehicle pads for lease, each pad for the placement of one recreational vehicle or camper. Further, any parcel (or contiguous parcels) where sites are located, established or maintained for occupancy by recreational vehicles and/or camping units as temporary living quarters for any purpose, including but not limited to recreation, education or vacation purposes.
SEASONAL CAMPSITE
Any campsite rented for 30 days or more in any calendar year.
TENT
A portable lodging unit usually made out of skins, canvas, plastic, or strong cloth stretched and usually sustained by poles, and is dependent upon separate toilet and lavatory facilities.
TOWNSHIP
Brady Township, Butler County, Pennsylvania.
A. 
It shall be unlawful for any person to construct or maintain a recreational vehicle park/campground within Brady Township, Butler County, Pennsylvania, without first having secured a permit from the Township.
B. 
Application for such permit shall be provided by the Township Secretary upon request. Upon demonstrating compliance with the requirements herein, the Township Supervisors shall approve a permit, which shall be issued by the Secretary.
C. 
The campground permit fee, and the fee for the annual renewal thereof, shall be set from time to time by resolution of the Board of Supervisors. The campground permit and annual renewal fees shall be set to reflect the actual cost of the inspections the Township incurs plus a reasonable administrative fee.
D. 
The permit shall be valid for only the recreational vehicle park/campground for which application is made, for one calendar year, and required to be renewed with each calendar year.
E. 
The permit may be transferred to new ownership, provided the new ownership maintains the recreational vehicle park/campground in compliance with all provisions of this chapter.
F. 
In the event of the issuance of a permit is authorized by the Board of Supervisors of Brady Township for the establishment of a campground in accordance with the provisions of this chapter, or in case of a presently existing recreational vehicle park/campground, no change or alteration shall be made unless application therefore shall be made to, as in the case of the original establishment of a recreational vehicle park/campground and a permit is thereupon authorized to be granted for such change or alteration by resolution of Brady Township.
G. 
The Supervisors of Brady Township may revoke, suspend, or refuse to renew a permit at such time as there is evidence of noncompliance with this chapter.
A. 
Application for a recreational vehicle park/campground permit for new recreational vehicle park/campgrounds shall be accompanied by an approved land development plan, in accordance with applicable requirements of Chapter 295, Subdivision and Land Development, and Butler County Subdivision and Land Development Ordinance, for the proposed development. Such land development plan shall include, but not be limited to the location of all streets and roads, campsites, utility services, buildings, recreation areas, and other facilities.
B. 
Application for a permit for an existing recreational vehicle park/campground shall be accompanied by a map of the property prepared in sufficient detail to demonstrate full compliance with the requirements of this chapter, including but not limited to identification of all campsites by number.
A. 
The standards for new construction of recreational vehicle park/campgrounds sites, or modification of the same, after the effective date of this chapter shall be as set forth in the recreational vehicle parks and campgrounds section of the Butler County Subdivision and Land Development Ordinance, and as set forth in Section 613, with the same incorporated herein for enforcement purposes. To the extent not inconsistent with Section 613 of the Butler County Subdivision and Land Development Ordinance, the Brady Township, Butler County, Pennsylvania Land Division and Subdivision Act, along with the Zoning Ordinance, shall be complied with as a term and condition of the permit issued pursuant to this chapter.
B. 
All new or modifications undertaken to an existing recreational vehicle park/campground shall be in compliance with all DEP requirements and governed by the same for land development, sewage treatment facilities, water management, including but not limited to drinking water, and the same shall be required to be in compliance as part of the permit process.
C. 
The owner of the recreational vehicle park/campground shall assign each campsite a campsite number and include the number on the map of the property required to be submitted by § 118-5B of this chapter. The purpose of requiring campsite numbers in the map is so that the Township can adequately locate and access each and every campsite on any emergency or inspection purpose. The campsite numbers shall be displayed on a sign at least six inches in height from the ground to be posted in a conspicuous location at the campsite drive entry or visible location on the recreational vehicle as to provide for access for health, welfare and safety, and emergency personnel purposes. Campsites displaying a campsite number on a sign smaller than six inches in height from the ground as of the date of enactment of this chapter shall be considered to be in compliance with this section as long as the sign remains visible at the campsite drive entry and posted in a conspicuous location. In the event a sign is replaced, it shall comply with the size requirements herein.
A. 
A recreational vehicle park/campground shall comply with the rules and regulations of the Commonwealth of Pennsylvania Department of Environmental Protection.
B. 
A recreational vehicle park/campground shall comply with any and all other municipal regulations, county regulations, for the health, welfare, and safety provisions as applicable to a recreational vehicle park/campground.
C. 
Violation of the above shall constitute violation of this chapter, and such violator shall be subject to penalties described herein.
Any person operating a recreational vehicle park/campgrounds within Brady Township at the time of adoption of this chapter shall make application for permit, including a map of the property prepared in sufficient detail to demonstrate full compliance with the requirements of this chapter, including but not limited to the identification of each campsite unit by number. Nothing contained herein shall be construed to confer or extinguish upon a party the right to assert a defense that the campsite has the right to be considered grandfathered from the provision of this chapter or in accordance with any other applicable law.
Upon receipt of evidence that compliance with the requirements and standards of this chapter would render undue hardship, the Supervisors may grant a waiver to these requirements and standards provided that such waiver does not violate the intent of this chapter and/or endanger the health, safety, or general welfare of the public.

Upon appointment with the manager of the recreational vehicle park/campground manager, the Township Engineer or Code Enforcement Officer may make a thorough inspection of all recreational vehicle park/campground located within the Township. Except in the case of the need to conduct an emergency inspection and in response to the filing of an application for a permit under this or any other applicable ordinance, or in response to an identifiable complaint, all routine annual inspections to the extent reasonably practical shall be scheduled between October 31 of the current year and April 1 of the following year. The Township Engineer, Code Enforcement Officer or other duly authorized representative of the Township shall make a report to the Board at its next meeting on the health, safety and sanitary conditions found in each recreational vehicle park/campground to confirm compliance with all ordinances, and at a minimum, inspection shall be conducted once a year.
A. 
Any person who violates or permits a violation of this chapter shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township before a Magisterial District Judge, shall pay a fine of not more than $600, plus all court costs, including reasonable attorney's fees, incurred by the Township in the enforcement of this chapter. No judgment shall be imposed until the date of the determination of the violation by the Magisterial District Judge. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable Rules of Civil Procedure. Each day a violation exists shall constitute a separate offense. Further, the appropriate officers or agents of the Township are hereby authorized to seek equitable relief, including injunction, to enforce compliance herewith.
B. 
In addition to the penalty set forth in Subsection A above, the Township Supervisors are hereby authorized, or the Township Code Enforcement Officer is hereby authorized, to issue stop, cease and desist orders to any persons who violate any provision of this chapter by the institution of appropriate action or proceeding, at law or in equity to enjoin and restrain any such person from violating any provision of this chapter.
A. 
Each recreational vehicle park/campground owner shall maintain records of tenant lists, the campsite number of each tenant in accordance with § 118-13, Register of campers. Such records shall be available for inspection as permitted under § 118-13.
B. 
A copy of the name and contact information for each member of the Board of Directors and primary point of contact shall be available for inspection. The name and contact information for the recreational vehicle park/campground manager shall be submitted to the Township at least once per year and the Township shall be advised of a change as needed.
C. 
Every campground shall provide a copy of the Township's Building Code (or a summary of the Building Code approved by the Township) to any tenant who is contemplating constructing improvements on the campsite that a building permit may be required prior to the commencement of said construction.
D. 
The building permit from the Township shall be displayed in a conspicuous place at the campsite for which the building permit has been issued.
The owner or their agent shall keep a register of the head of the family accommodated in the recreational vehicle park/campground, their regular home address, and phone number. Said register shall be open at all times to the inspection by the Township Engineer or Code Enforcement Officer or law enforcement.
A. 
Should any section or provision of this chapter be declared by the courts to be invalid, the same shall not affect the validity of the chapter as a whole, or any part thereon, other than the part so declared to be invalid.
B. 
Any ordinance or parts of ordinance conflicting with the provisions of this chapter are hereby repealed so far as the same affect this chapter.
