Whenever any words and phrases are used in this chapter, the meaning respectively ascribed to them in Subtitle 1 of Title 39 of the Revised Statutes of New Jersey shall be deemed to apply to such words and phrases used herein.

Whenever certain hours are named in this chapter, they shall mean either Eastern Standard Time or Eastern Daylight Savings Time as may be in current use.

a. 
The Chief of Police or, in his/her absence, disability or inability to act, the ranking member of the Police Department, is hereby authorized to provide by regulation for the closing of any street or portion thereof to motor vehicle traffic on any day or days during specified hours on any day or days whenever he/she finds that such closing is necessary for the preservation of the public safety, health or welfare.
b. 
Any regulations promulgated by the Chief of Police and in accordance with paragraph a above, shall provide for the posting of proper warning signs of such closing on any street or portion thereof during the time the same is closed in pursuance thereof.
c. 
Any violation of this regulation promulgated thereunder shall be punished by a fine not to exceed $50.
d. 
Any regulation adopted that mandates the closing of any street for a period greater than 48 consecutive hours shall not become effective unless and until it has been submitted to and approved by the Commissioner of the Department of Transportation.

a. 
Authority; hours of closing established. The Mayor is hereby authorized, if he shall find that a safety problem exists for ingress and egress to any public or private school in the Borough or for the provision of recreational facilities for children attending such school or both, due to lack of a suitable area surrounding the school, to close by regulation any portion of any street, within the block upon which such school is located, to the use of traffic during such time as he shall determine, not to exceed one hour, between 7:30 a.m. and 10:00 a.m., two hours between 11:00 a.m. and 2:00 p.m. and one hour between 2:30 p.m. and 4:30 p.m. on any days upon which such school is in session and to permit the use of the portion of the street during the hours listed above for ingress and egress to such school and for the use by the pupils of such school for recreational purposes, under proper supervision and to provide adequate police facilities for such supervision and for the control of traffic upon such portion of such street.
b. 
Posting of warning signs. Warning signs, indicating that such street or portion thereof is so closed and stating the purpose therefor, shall be posted at both ends of the street or portion thereof and at intervals of 200 feet on each side of such street or portion thereof during the time that such street or portion thereof is so closed.
c. 
Violations and penalty. Each and every person violating the provisions of this subsection shall, upon conviction thereof, be liable to a penalty of not more than $200 or be imprisoned for not more than 10 days in the discretion of the Judge of the Municipal Court.

Any vehicle parked in violation of this chapter shall be deemed a nuisance and a menace to the safe and proper regulation of traffic, and any Police Officer may provide for the removal of that vehicle. The owner shall bear the reasonable costs of removal and storage which may result from such removal before regaining possession of the vehicle.

Unless another penalty is expressly provided by New Jersey Statute or in this chapter, every person convicted of a violation of a provision of this chapter or any supplement thereto shall be liable to a penalty of not more than $75 or imprisonment for a term not exceeding 15 days or both.

If any part or parts of this chapter are, for any reason, held to be invalid, such decision shall not affect the validity of the remaining portions of this chapter.

All former traffic ordinances of the Borough of Monmouth Beach are hereby repealed, and all ordinances or parts of ordinances in conflict with or inconsistent with the provisions of this chapter are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this chapter.

The Board of Commissioners hereby finds and declares that problems of traffic control occur and traffic must be moved through or around street construction, maintenance operations, and utility work, above and below ground which requires blocking the roadway and obstructing the normal flow of traffic; and that such obstructions are or can become dangerous when not properly controlled. In order to better promote the public health, safety, peace and welfare, it is necessary to establish controls and regulations directed to the safety and expeditious movement of traffic through construction and maintenance zones and to provide safety for the work force performing these operations.
The Borough of Monmouth Beach, in the County of Monmouth, State of New Jersey, does hereby adopt the current Manual on Uniform Traffic Control Devices hereafter known as M.U.T.C.D., except as hereby supplemented and amended, as it controls and regulates whenever construction maintenance operations of utility work obstructs the normal flow of traffic. Any person, contractor, or utility, who fails to comply with the provisions of M.U.T.C.D. while performing such work is in violation of this section.

It shall be the responsibility of the person, contractor, or in the case of a public utility agreement, wishing to conduct work on, under or above the roadway to contact the Police Department in order to arrange a pre-construction meeting in order to submit plans for the safe movement of traffic during such period of construction work. Any person, contractor or utility who fails to comply with this section prior to the start of such work or whose plans are not approved by the Police Department is in violation of this section.

The person, contractor, or utility shall provide the Police Department with at least two emergency contact phone numbers to be called in case of emergency problems at the construction or maintenance site prior to the start of any work. If for any reason emergency contact cannot be reached, or if the emergency contact person does not respond to the call from the Police Department to correct a hazardous condition, the Borough may respond to correct such hazardous condition. The reasonable fees for such emergency service by the Borough shall be charged to the person, contractor, or utility for such condition.

There shall be no construction, maintenance operations, or utility work on any roadway in the Borough before the hour of 9:00 a.m. or after 4:00 p.m. This time limit may be adjusted to permit work prior to 9:00 a.m. or after 4:00 p.m. by the Officer in charge of the Police Department. If it is determined by the Officer in charge that the construction or maintenance operations prior to 9:00 a.m. or after 4:00 p.m. would substantially delay traffic or cause a safety or health hazard, the work shall then be permitted only between 9:00 a.m. and 4:00 p.m.

Traffic directors shall be posted at all construction or maintenance sites when determined by the Police Department that same is necessary to provide for the safety and expeditious movement of traffic.

The Police Department shall have the authority to stop work, including the removal of equipment and vehicles, stored material within the street right-of-way, back filling of open excavations and/or other related work, in order to abate any nuisance and/or safety hazard or for any violation of this section.

It is to be expressly understood that no materials, vehicle or equipment are to be placed in the roadway or sidewalk or until all construction, signs, lights, devices and pavement markings are installed.

Any person, contractor or utility who commits a violation of this section shall, upon conviction thereof for a first offense, pay a fine of not less than $100 nor more than $500 and/or be imprisoned in the County Jail for a term not exceeding 90 days. For a second offense, the person, contractor or utility shall, upon conviction thereof, pay a fine of not less than $250 and/or be imprisoned in the County Jail for a term not exceeding 90 days.
A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

All ordinances or parts of ordinances which are inconsistent with the provisions of this section are hereby repealed to the extent of any such inconsistency.

This section shall take effect after approval by the Commissioner of Transportation 20 days after passage and publication as prescribed by law.

The provisions of this chapter imposing a time limit on parking shall not relieve any person of the duty to observe other more restrictive provisions prohibiting or limiting the stopping or standing or parking of vehicles as set forth in N.J.S.A. 39:4-138, any other New Jersey Statute or as hereinafter provided.
a. 
Upon the declaration of an emergency, there shall be no parking upon streets or sections of streets where temporary EMERGENCY NO PARKING signs are displayed. The Chief of Police or, in his/her absence, the ranking Police Officer is authorized to declare an emergency and to direct the posting of EMERGENCY NO PARKING signs when weather conditions, accidents, road construction, fire or public celebrations dictate or require avoidance of hazards or other conditions which interfere with the free flow of traffic. Notification that EMERGENCY NO PARKING signs are being or will be posted shall be given to the operator or owner of any vehicle which has been parked prior to the posting of the signs.
b. 
The effectiveness of this subsection is contingent upon the signs being erected as required by law.
c. 
Any unoccupied vehicle parked or standing in violation of this subsection shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal, before regaining possession of the vehicle.

a. 
Whenever snow has fallen and the accumulation is such that it covers the street or highway, an emergency shall exist and no vehicles shall be parked on the following Borough streets or portions thereof listed below.
The parking prohibitions listed below shall remain in effect after the snow has ceased, until the streets have been plowed significantly, and to the extent that parking will not interfere with the normal flow of traffic.
b. 
Any unoccupied vehicle parked or standing in violation of this section shall be deemed a nuisance and a menace to the safe and proper regulation of traffic and any Police Officer may provide for the removal of such vehicle. The owner shall pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
c. 
The effectiveness of this subsection is contingent upon signs being erected as required by law.
d. 
Unless other penalty is expressly provided by New Jersey Statute, every person convicted of a violation of this subsection or any supplement thereto, shall be liable to a penalty of not more than $200 or imprisonment for a term not exceeding 15 days or both.

Note: Below are minimum standards for bus stop length which are based on recommendations of the Institute of Transportation Engineers and studies conducted by the Bureau of Traffic Engineering and Safety programs. These standards include minimum lengths required for Bus Stops in order that buses may leave moving traffic lanes safely. Keep in mind that buses must stop alongside the curb within six inches thereof as provided by State Law pursuant to N.J.S.A. 39:4-135. These minimums are as follows:
NEAR SIDE — Ninety feet plus the distance from the curbline to the end of the curb return, property line or crosswalk approximately 105 feet to 120 feet. Minimum acceptable length is 105 feet.

MID-BLOCK — No intersection on either side of roadway: minimum acceptable length is 135 feet.
FAR-SIDE — (AFTER BUS MAKES RIGHT TURN) — Minimum acceptable length is 150 feet. An additional 45 feet of length should be provided for each additional bus expected to stop simultaneously.

a. 
Police officers authority. The Police Officers of the Borough are hereby authorized to enforce violations of handicapped parking on both public and private property, when the parking zone or parking space is appropriately marked and designated restricting the parking to handicapped operators, and designating the zone on parking spaces as a tow away zone.
b. 
Permit required; display. Operators of motor vehicles not having a handicapped parking permit issued by the Director of Motor Vehicles or by the Municipality, and not prominently displayed on the vehicle, shall be in violation of the restrictions prohibiting parking except by handicapped operators, and shall be subject to fines as provided by law, upon the complaint of the Police Officer in the Municipal Court.
c. 
Requests by handicapped persons to remove illegally parked vehicles in restricted parking zones. Any Police Officer of the Borough, upon the request of a handicapped person who is the holder of a valid parking permit issued by the Director of Motor Vehicles or by the Municipal Authority, will cause to be removed from the restricted parking zone or space a vehicle illegally parked in the restricted zone, and will cause the same to be towed and stored at the cost of the violating operator. Notice of the consequence of illegally parking by which a vehicle may be towed and stored shall be prominently displayed at the parking site. The obligation of the violating operator to be responsible for the towing and storage charges shall be in addition to such other penalties as are prescribed by law.

The owners of the premises referred to in Subsections 7-37.3 and 7-37.4 shall provide and install signs and pavement markings for each parking space reserved for the use of handicapped persons, which signs and markings shall be in accordance with the Manual on Uniform Traffic Control Devices. The cost of procurement and installation of the signs and pavement markings shall be the responsibility of the owner of said property. The owner shall subsequent to initial procurement and installation, maintain such signs and pavement markings in good condition at no cost or expense to the Borough of Monmouth Beach. The owner shall be responsible for the repair and restoration or replacement of same.

Pursuant to P.L. 1989, C 201, the penalties for violations of this Section 7-37 must be $250 for a first offense and for a subsequent offense must be a fine of at least $250 and up to 90 days community service on such terms and such form as the Court shall deem appropriate, or any combination thereof.

The purpose of this section is to establish rates, schedules and policies in the paid metered parking areas specified herein, and to establish procedures and regulations to be implemented pursuant to these policies.

a. 
Paid parking kiosks shall be in operation daily between the hours of 8:00 a.m. and 8:00 p.m. Each kiosk shall provide for the duration of legal parking time and the charge for said legal parking time. No person shall park a vehicle longer than the full amount of time paid for and registered at the kiosk.
b. 
Whenever a vehicle shall be parked in a lot where a parking kiosk has been installed, the person operating and parking said vehicle shall deposit in the kiosk an appropriate sum for legal parking time designated and such other instructions to designate the vehicle parked and paid for at the parking lot. Upon so depositing said sum, the vehicle may remain parked for the period of time paid for, or less, indicated by the kiosk.
c. 
Payment made by credit card or phone app shall be subject to and charged a convenience fee as permitted by N.J.A.C. 5:30-9 et seq.
d. 
Paid parking shall be in effect from May 1 through September 30.
e. 
Parking Tags used for the Monmouth Beach Bathing Pavilion cannot be used to park in the Cultural Center Parking Lot.
a. 
It shall be a violation of this chapter to leave a vehicle parked for longer than required to pay the sum required at the kiosk.
b. 
It shall be a violation of this chapter for any person to cause, allow, permit or suffer any vehicle owned or operated by such person to be parked overtime or beyond the period of legal parking time established at the kiosk.
c. 
It shall be in violation of this chapter for any person to deface, injure, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this chapter.
d. 
It shall be a violation of this chapter to deposit or cause to be deposited in any parking meter any slug, device, or metallic substance, or any other substitute for the appropriate coins of the United States of America.
e. 
Each complete hour which the vehicle remains illegally parked at a meter after the initial citation for overtime parking has been issued may be treated as a separate violation and an additional citation issued and additional penalties collected.
a. 
The fines and penalties for violation of § 7-39.4a and b shall be as stated in § 7-4 of the Revised General Ordinances of the Borough of Monmouth Beach.
b. 
The fines and penalties for violation of § 7-39.4c and d shall be in an amount up to the maximum amount permitted by law in addition to any order for restitution arising out of the violation as permitted by fines shall be issued for violations.
c. 
In addition to any fine or penalty imposed, the vehicle parked without payment of the required fee(s) shall also be subject to being towed in the enforcing officer's discretion.
