This article shall be titled the "Town of Wilton Tobacco, Marijuana,
Cannabis and Vaping Device Use Health Protection Law."
The Town Board of Wilton finds that the smoking of tobacco,
marijuana, cannabis and vaping devices has the potential for creating
a serious health hazard for Town employees, residents, children and
visitors. In order to protect the public health, safety and welfare,
it is necessary to restrict the use of tobacco, marijuana, cannabis
and vaping devices.
Tobacco, marijuana, cannabis and vaping device use shall be
prohibited in all Town vehicles, facilities and on all Town properties,
whether owned, leased or operated by the Town of Wilton, including
all buildings, lands, recreation areas, parks, playgrounds and trails,
except in any area officially designated by the Wilton Town Board
for such uses. [NOTE: The Town Board may designate an outdoor tobacco
use area at the Town Hall complex.]
This article may be enforced by duly appointed law enforcement
officers of any municipal, Saratoga County or New York State agency,
or a Code Enforcement Officer of the Town of Wilton.
Any person who is convicted of violating any provision of this
article shall be subject to a minimum fine of $100 up to, but not
to exceed, $500.
This article is hereby adopted pursuant to the provisions of
§ 10 of the New York State Municipal Home Rule Law and of
the New York Statute of Local Governments and shall take effect immediately
upon filing in the office of the New York Secretary of State and the
office of the Town Clerk of the Town of Wilton.
