A. 
The above-entitled ordinance, adopted on April 22, 1977,[1] be and the same is hereby repealed to the end that, among other things, the functions and duties of the enforcing agency established thereunder shall be transferred to the Bureau of Construction Code Enforcement of the Department of Community Affairs of the State of New Jersey, as hereinafter set forth in § 180-2.

B. 
Notwithstanding the foregoing, the Township of Harmony, through its Construction Official, shall continue to be the enforcing agency of the State Uniform Construction Code until such time as the Department of Community Affairs has assumed the responsibility thereof, pursuant to the provisions of N.J.A.C. 5:23-4.3(a)1ii.
The Bureau of Construction Code Enforcement of the Department of Community Affairs of the State of New Jersey is hereby appointed by the Township of Harmony as the enforcing agency of the State Uniform Construction Code pursuant to the provisions of N.J.S.A. 52:27D-119 et seq. by virtue of the Township's decision not to enforce the code, and request is hereby made of the Commissioner of Community Affairs to assume the task thereof, to the end that he might promulgate such regulations necessary to provide for the enforcement of the aforesaid code and Act in the Township of Harmony and for payment to the State of New Jersey of fees necessary to defray the expenses in furtherance of that end, pursuant to N.J.S.A. 52:27D-128 and in accordance with N.J.A.C. 5:23-4.3(a)1ii.
The Clerk of the Township of Harmony is hereby directed to forward a certified copy of this chapter to the Department of Community Affairs following its adoption upon final passage.
