Under the powers and authority granted to the Township by N.J.S.A. 2B:12-1 et seq., a Municipal Court is hereby established for the Township of Harmony, in the County of Warren, to be known as "Municipal Court of the Township of Harmony."
The territorial jurisdiction of the Municipal Court of the Township shall be that territory embraced within the municipal boundaries of the Township and as provided in N.J.S.A.2B:12-16.
The Municipal Court of the Township and the Judge thereof shall have jurisdiction over all of the offenses set forth in N.J.S.A. 2B:12-17, together with any other matter concerning which jurisdiction shall by statute be conferred upon municipal courts of this state.
All administrative matters, fees, costs and all procedural rules and regulations shall be governed and controlled by the provisions of appropriate statutes in such case made and provided by and prescribed by the New Jersey Superior Court governing the courts of the State of New Jersey, and the regulations and directives of the administrative office of the courts of New Jersey, regarding procedures of municipal courts.
The Municipal Court shall have a Municipal Judge, Prosecutor, Public Defender and Court Administrator. The aforesaid parties shall have such qualifications, be appointed and serve such term as provided by law.
The salary of the Municipal Judge, Prosecutor, Public Defender, Court Administrator, staff and the other costs of operating the Municipal Court shall be shared between any municipalities with which the Township Committee has executed an interlocal agreement, as provided for in such interlocal agreement. Any costs and fines collected from defendants and any other costs or amounts collected or received by the Court operated pursuant to the interlocal agreement shall be divided between such municipalities as provided for in the interlocal agreement unless otherwise provided by law.
Before entering upon the duties of the respective offices, the Judge and Court Administrator and Violations Clerk thereof shall enter into a bond to the Township of Harmony and the County of Warren and State of New Jersey in such amount and with such surety as the Township Committee may fix, conditioned upon the faithful performance of its respective duties of such officers.
The Mayor, on behalf of the Township Committee, is authorized to enter into and execute an interlocal agreement with another municipality for the appointment of persons to serve as the Judge, Prosecutor, Public Defender and administrative staff of the Municipal Court of the Township of Harmony.
