The position of Code Enforcement Officer is hereby created and established within Harmony Township.
The Code Enforcement Officer shall be entrusted with the enforcement of all violations occurring under the Township's anti-littering ordinance as enumerated in Chapter 308 of the Code of the Township of Harmony entitled "Littering," and enforcement of all violations occurring within the purview of Chapter 319 of the Code of the Township of Harmony entitled "Nuisances, Public Health," as well as the enforcement of any violations or actions required for enforcement under Chapter 154 of the Code of the Township of Harmony entitled "Buildings, Unfit." As Code Enforcement Officer, the individual so appointed shall be empowered to prosecute any and all violations in the name of the Township in the Municipal Court for the Township of Harmony as well as to assist the Harmony Township Attorney in any proceedings relating to the abatement of any violations brought or pursued in the Superior Court of the State of New Jersey.
The term of the Code Enforcement Officer shall be for a period of one year, to commence on January 1 of the year in which the appointment is made, and shall be subject to appointment annually by the Township Committee on the corresponding day of each year thereafter.
The Code Enforcement Officer shall receive such compensation as shall be provided under an ordinance fixing the salaries of several officers and officials of the Township of Harmony, County of Warren and State of New Jersey, as the same shall be amended or supplemented from time to time.
A. 
The individual appointed as Code Enforcement Officer shall exercise all powers prescribed as set forth herein as well as to exercise all powers established for a position of public officer as defined in § 154-2 of the Code of the Township of Harmony entitled "Appointment of public officer; compensation." To that extent, the position of public officer is hereby consolidated into the larger powers of the office of Code Enforcement Officer as herein created, and any and all references to the position of public officer shall be deemed to mean the position of Code Enforcement Officer. The Code Enforcement Officer shall also be authorized to exercise all emergency powers as defined in § 154-8 of the Code of the Township of Harmony and such additional powers as are defined in § 154-10 of the Code of the Township of Harmony. The Code Enforcement Officer shall also be authorized to exercise any powers as permitted by any state statute concerning the areas of enforcement as defined hereunder.
B. 
The individual appointed as Code Enforcement Officer shall be empowered and authorized to prosecute all actions within the Township of Harmony relating to the removal or abatement of nuisances as well as to seek the recovery of expenses incurred in such removal or abatement proceedings. This Subsection B is intended to provide an additional enforcement authority relating to violations of the Public Health Nuisance Code within the Township of Harmony[1] and is not intended to supersede, modify or abridge any of the authority of the Board of Health of the Township of Harmony in enforcing, removing or seeking to abate public health nuisances within the Township of Harmony.

Each section of this article is an independent section, and the holding of any section or part thereof to be unconstitutional, void or ineffective for any cause shall not be deemed to effect the validity or constitutionality of any other sections or parts thereof.
This article shall become effective upon final passage and publication as required by law. All ordinances or parts thereof in conflict with the provisions of this article are hereby repealed.
