[Adopted 6-5-1986 by Ord No. 499 (Ch. 82, Art. I, of the 1973 Borough Code)]
For the purposes of this article, the following words and phrases shall be described as set forth:
ALUMINUM
All products made of aluminum, including aluminum cans, foil, wrappers, containers for prepared dinners or other foods, lawn chairs, storm windows and screening, including frame and storm windows.
DEBRIS
All waste material larger or heavier than trash, including furniture, trees, branches, brush, roots, stones, dirt, demolition material, broken concrete and other like material.
GARBAGE
Putrescible animal, fish, fowl, fruit, vegetable matter or matter of a similar nature incidental to and resulting from the use, preparation, cooking and consumption of food.
GLASS
All products made from silica or sand, soda ash and limestone, the products being transparent or translucent and being used for packaging or bottling of various matter, and all other material commonly known as "glass."
METAL
All products made of metal, including washers, dryers, refrigerators, stoves, water heaters, springs, bicycles, automobile parts, bimetal cans (tin food cans) or scrap metal.
OCCUPANT
The person, corporation or other legal entity actually occupying a premises.
TRASH
Ashes, blue and flat glass, nonputrescible solid waste, grass clippings, leaves, building materials, contaminated paper, plastic material and other similar materials that accumulate incidentally to the use and occupancy of a residence which can be enclosed in containers of the size and weight set forth in §§ 354-11 and 354-12 of this article.
WASTEPAPER PRODUCTS
All uncontaminated paper material, such as used daily or weekly newspapers, magazines, cardboard boxes, wrapping paper, bags and mailing materials.
The collection and disposal of trash and garbage within the Borough of Mount Ephraim shall be in strict compliance with the provisions of this article.
Except as provided herein, the Borough or its designated contractor shall be the sole collector of trash and garbage within the Borough, and no person shall pick over or remove all or any part of said trash or garbage placed at the curb for Borough collection.
No trash, brush or garbage shall be transported on any public street in the Borough unless it is carried in a covered, leakproof vehicle.
The occupant or owner of any building within the Borough of Mount Ephraim who shall place at the curb trash and garbage for disposal, removal or collection shall do so in strict conformity with the following regulations:
A. 
No single article, bundle or loaded container shall be heavier than 40 pounds. There shall be a maximum of five receptacles, containers or bags or otherwise of like size at any premises.

B. 
Garbage shall be drained of all liquids: trash and debris shall be placed in metal or heavy-duty plastic containers, boxes or plastic bags, secured by a lid or securely tied, with a total weight not to exceed 40 pounds.

C. 
Brush and/or branches shall be tied in bundles not to exceed four feet in length and of sufficient size and weight (not to exceed 40 pounds) to be handled by one man. This includes building lumber and/or demolition waste.

D. 
Magazines and similar materials, if not in a closed container, shall be securely tied to prevent their blowing away.
E. 
Large nonmetal items, such as furniture, rugs, mattresses, television sets and tires, shall be placed at curbside on the day designated for collection of such items.
F. 
Explosives, highly flammable materials, or waste oil, as defined in Article I, Recycling, of this chapter, shall not be disposed of pursuant to the provisions of this article. Waste oil shall be disposed of as set forth in Article I.
G. 
Refrigerators, freezers or any other item that has a capacity of four cubic feet shall have the door or lid removed from the hinges, and the cover or lid shall be placed separately at the curb.
H. 
The collection of garbage, trash and other wastes shall be supervised by the Superintendent of Public Works, who shall have the power to establish special times for large-item pickup.
All receptacles required herein shall be supplied by the occupant or owner of the premises, subject to approval by the Borough, and placed between the curb and sidewalk, where they shall be readily accessible to the collector. The occupant or owner shall keep all receptacles clear and shall maintain them for safe handling.
All containers shall be placed at curbside not more than 12 hours before pickup and shall be removed from curbside within 12 hours of pickup.
A. 
No trash or garbage shall be deposited upon any public street or in any public place, except at curbside for collection as set forth herein.
B. 
It shall be unlawful for any person to dump garbage, trash or debris upon the public property of the Borough or to trespass upon the property of another and deposit garbage, trash or debris thereon.
A. 
Trees or brush to be trimmed or removed by a private contractor shall be entirely disposed of by said contractor.
B. 
Trees or brush to be removed by the Borough shall be subject to the following:
(1) 
Brush or trees shall be cut in four-foot lengths tied securely in bundles of 40 pounds to be handled by one man.[1]

(2) 
Material to be removed shall be placed at the curb in such a manner so as not to obstruct any driveways or public walks.
(3) 
Trees, tree stumps, branches, bushes and/or leaves shall not be placed beyond the curb so as to interfere with or block parking, drainage or drainage culverts.

A. 
Debris generated by a contractor shall be entirely disposed of by said contractor.
B. 
Debris generated solely by a resident on his own property shall be subject to the following:
(1) 
Small debris shall be placed in containers not exceeding 40 pounds adequate to hold such weight of contents when lifted.
(2) 
All other debris shall be tied in bundles not exceeding 40 pounds in weight.
(3) 
Debris to be removed shall be placed at the curb in such a manner so as not to obstruct driveways or public walks.
(4) 
Debris shall be limited to one cubic yard per week.
No person shall deposit or cause or permit to be deposited in or upon any street, sidewalk or public or private property any glass or article composed primarily of glass. All glass shall be disposed of pursuant to the provisions of Article I, Recycling, of this chapter.
All leaves shall be disposed of as regular trash and shall be governed by the same container regulations, except as follows:
A. 
Between September 15 and December 15, residents shall be permitted to place leaves in piles between the sidewalk and curb for pickup.
B. 
Leaves placed at the curb shall be free of any trash, limbs or brush.
C. 
Leaves shall not be placed at the curb more than 48 hours prior to scheduled collection.
Any person, firm or corporation violating any of the provisions of this article shall be subject to the penalty provisions contained in Chapter 305, Penalties. Each and every violation of and nonconformance with this article or each day that any provision of this article shall have been violated shall be construed as a separate and distinct violation thereof.
