(a) A
person who is younger than eighteen (18) years of age commits an offense
if the person possesses, purchases or accepts receipt of a cigarette
or other tobacco product.
(b) This
section shall not prohibit a person younger than eighteen (18) years
of age from possessing a cigarette or other tobacco product while
in the presence of a parent or legal guardian.

It shall be unlawful for any person, business or tobacco retailer
to sell, permit to be sold, offer for sale or display for sale any
single-pack tobacco product by means of self-service merchandising
in such a manner that an employee does not have a clear view of the
tobacco product from the employee’s usual place of work.

Distribution of free samples of tobacco products to minors is
prohibited in any public place.
