(a) Animals subject to impoundment.
The animal control officer
may impound an animal as follows:
(1) Any cat or dog not exhibiting evidence of being vaccinated and licensed
as provided in this chapter;
(2) Any animal kept under conditions which could endanger the lives or
health of any person or animal, such as a rabid animal;
(3) Any animal that creates a nuisance as defined in section
2.01.010 of this chapter;
(4) Any animal running at-large;
(5) Any animal treated in a manner determined by the animal control officer
and verified by a licensed veterinarian to be cruel or inhumane;
(6) Any animal that has bitten a human being or requires observation
for suspected cases of rabies; or
(7) Any animal found in violation of any provision of this chapter.
(b) All
dogs subject to impoundment in this chapter shall receive standard
inoculations at the animal control officer’s discretion including,
but not limited to:
(1) Canine distemper-Adenovirus.
(c) All
cats subject to impoundment in this chapter shall receive standard
inoculations at the animal control officer’s discretion including,
but not limited to:
(1) Feline Rhinotracheitis-Calici-Panleukopenia-Chlamydia Psittaci Vaccine.
(d) Redemption of animal by owner.
The animal control officer
shall make a reasonable effort to contact the owner of any animal
impounded. The owner may resume possession of the impounded animal
upon:
(1) Payment of the following fees:
(C) Veterinary expenses incurred;
(D) License fee, if the animal is vaccinated but is not licensed; and
(2) Compliance with the vaccination requirements of section
2.02.003.
(e) Unlawful removal of animal.
A person commits an offense
if they remove or attempt to remove an animal from the city animal
shelter without first paying all impoundment, maintenance, and other
fees assessed.
(f) Place for impoundment.
The city manager shall select
and establish a place for impounding all animals impounded under any
provision of this chapter.
(g) Vaccination of adopted animal.
A person may not adopt
an animal older than three (3) months of age until the animal has
obtained a rabies vaccination.

(a) The
animal shelter shall be considered the designated caretaker of a stray,
impounded, or surrendered animal immediately upon intake at the shelter.
After a holding period of at least seventy-two (72) hours or three
(3) days from the time of intake, impound, or surrender, the city
shall become the full owner of the animal in question. After the expiration
of the holding period, animals that are not claimed and redeemed by
the owner or custodian may be put up for adoption, placed with a reputable
and approved rescue group or person, transferred to another animal
shelter or humanely euthanized.
(b) If
any dog or cat that is impounded by an animal control officer, or
brought to the animal shelter by a person other than the owner of
that animal, and is wearing traceable identification or where an owner
is known, such animal shall be held at the animal shelter for a minimum
of ninety-six (96) hours or four (4) days from the time the animal
enters the animal shelter. The animal control staff shall notify the
owner, when known, of the impoundment. The owner shall reclaim the
dog/cat and satisfy all applicable fees. If unclaimed, the animal
shall become the property of the city and may be placed for adoption,
placed with a reputable and approved rescue group or person, transferred
to another animal shelter, or euthanized after the fourth (4) day.

If the owner no longer wishes to keep the animal, a surrender fee, as described in the fee schedule in appendix
A of this code, will be charged, and a written release must be obtained.

No animal that has bitten a human being shall be administered
euthanasia before the expiration of the quarantine period.
