In furtherance of the purpose of this chapter, the Historic
Preservation Commission ("the Commission" or "HPC") of the Village
of Coxsackie is created.
The Commission has the power to perform the functions and duties
assigned to it in this chapter. It shall also have the power to:
A. Review any historic preservation local laws or regulations of the
Village and recommend to the Village governing board any changes and
amendments thereto, especially as such recommendations are needed
for the Commission to conduct its business.
B. Recommend to the Village governing board individual landmarks and historic districts to be adopted by local law and, from time to time, changes thereto, as set out in Article
III of this chapter.
C. Maintain an inventory of locally designated historic resources or
districts with the Village of Coxsackie. (See Appendix A.)
D. Recommend to the Village governing board additional criteria to be adopted in local law to be used when evaluating applications for a preservation work permit, in addition to the powers set out in Article
IV of this chapter.
E. Recommend to the Village governing board proposals for the acquisition
of preservation easements or other interests in real property.
F. Evaluate an application for a preservation work permit; approve,
approve with modifications, or deny any proposal for demolition, removal,
relocation, or for exterior changes to a designated individual landmark
or property within a designated historic district resulting from any
such application.
G. Evaluate, without a public hearing, an application for ordinary maintenance
and repair of historic resources, properties, or landmarks; approve,
approve with modifications, or deny any such applications.
H. Perform other functions that the Village governing board may designate
by local law.
If, for any reason, a position becomes vacant, the Mayor shall
appoint a person to fill the vacancy for the remainder of the term
within 45 days after the day on which the vacancy occurred. If a vacancy
occurs in a term with less than 45 days remaining, the Mayor may allow
the term to expire without appointing a person to fill the vacancy.
The Mayor has the duty to appoint qualified individuals as members
of the Preservation Commission, to the extent available in the community,
such as an architect, an historian, a real estate broker, a resident
of an historic district or any other person who shall have demonstrated
a significant interest in and commitment to the field of historic
preservation.
A person serving as a member of the Commission will not receive
a salary for his or her services but will be compensated for any expenses
incurred in the performance of his or her duties, subject to the prior
approval of the Chairperson.
The Commission shall meet as necessary at the call of the Chairperson.
All regular or special meetings of the Commission shall be consistent
with the notice provisions of the New York Open Meetings Law and shall
be open to the public. The members of the Commission shall enact rules
and regulations concerning the following business:
A. The time, date, and place of future meetings.
B. Design guidelines for individual landmarks and historic districts.
C. Recommend to the Village governing board regulations relating to
any subject matter over which the Commission has jurisdiction under
this chapter.
