(A) It shall
be unlawful for any person, partnership or corporation to drill or
maintain an oil or gas well within six hundred (600) feet of a residence,
religious institution, hospital building, school, public park or a
place where children commonly gather within the city limits and its
extraterritorial jurisdiction.
(B) Any
person, partnership or corporation who shall recklessly violate any
of the provisions of this section or fail to comply therewith shall
be deemed guilty of a Class C Misdemeanor and, upon conviction, shall
be fined not less than $1.00 nor more than $2,000.00. Each day that
the violation occurs may constitute a distinct and separate offense.
