Alcoholic Beverage Control Act — § 4.1-100 et seq.

A. 
Every person who shall engage in the business of manufacturing, bottling, wholesaling or retailing alcohol beverages shall obtain a local license and shall pay therefor an annual license tax as follows:
(1) 
For each distiller's license: $750, provided that no license shall be required of any distiller manufacturing not more than 5,000 gallons of alcohol or spirits, or both, during the license year.
(2) 
For each winery or farm winery license: $50.
(3) 
For each brewery license: $250.
(4) 
For each bottler's license: $500.
(5) 
For each wholesale beer license: $75.
(6) 
For each wholesale wine distributor's license: $50.
(7) 
For each retail on-premises wine and beer license for a hotel, motel, restaurant or club: $37.50.
(8) 
For each retail off-premises wine and beer license: $37.50.
(9) 
For each retail on-premises beer license for hotel, motel, restaurant or club: $37.50.
(10) 
For each banquet license: $5 per day.
B. 
Any person in the Town who holds a mixed beverage restaurant license from the state shall obtain from the Town a mixed beverage license and pay an annual license tax as follows:
(1) 
Persons operating restaurants, including restaurants located on the premises of and operated by hotels, motels or other persons:
(a) 
With a seating capacity at tables for up to 100 persons: $200.
(b) 
With a seating capacity at tables for more than 100 persons: $350.

The licenses referred to in this article shall be as respectively defined by Chapter 1 of Title 4.1 of the Code of Virginia, and the terms "alcoholic beverages," "alcohol," "spirits," "beer" and "wine," as used in this article, shall have the meanings respectively prescribed to them by such chapter.

No license shall be issued under this article to any person unless such person shall hold or secure simultaneously therewith the proper state license, which state license shall be exhibited to the Town Treasurer, and all dining rooms, restaurants, lunchrooms and clubrooms wherein beverages herein defined are sold for consumption on the premises shall at all times be open to inspection to the state police and the Shenandoah County Sheriff's Office. Any violation of the terms of this section shall be sufficient grounds for the revocation of the license issued in accordance with this article.
