Certain documents, one (1) copy of which is on file in the office of the City Clerk of the City of Higginsville, Missouri, being marked and designated as International Plumbing Code, 2021 Edition, including Appendix Chapters C and E, as published by the International Code Council be and is hereby adopted as the Plumbing Code of the City of Higginsville for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the City of Higginsville and providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such International Plumbing Code, 2021 Edition, published by the International Code Council on file in the office of the City Clerk are hereby referred to, adopted and made a part hereof as if fully set out in this Article.

All other ordinances or parts of ordinances in conflict herewith are hereby repealed.

A. 
The code adopted by Section 510.210 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding number of the International Plumbing Code, 2021 Edition, or where there is no corresponding Section in the code the following Sections shall be enacted as additions to the code.
1. 
Section 101.1. Insert: "City of Higginsville."
2. 
Delete Section 103 in its entirety. Refer to Section 103 of the International Building Code, 2021 Edition.
3. 
Delete in its entirety Section 104.7. Refer to Section 104.7 in the International Building Code, 2021 Edition.
4. 
Delete Section 106.1.1 it its entirety.
5. 
Delete Section 106.1.2 in its entirety.
6. 
Delete Section 109. Refer to Appendix B of the International Building Code, 2021 Edition.
7. 
Delete Section 113.4 in its entirety, and add new Section 113.4 as follows:
Section 113.4: Unlawful Continuance. Any person who shall continue any work after having been served with a stop work order, except such work as that person is directed to perform to remove a violation or unsafe condition, shall be liable to a fine of not less than fifty dollars ($50.00), nor more than five hundred dollars ($500.00), or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

Delete Section 115.4 in its entirety, and add new Section 115.4 as follows:
Section 115.4: Violation Penalties. Persons who shall be found guilty of violating a provision of this code or failing to comply with any of the requirements thereof or who erect, install, alter or repair any structure in violation of the approved construction documents or directive of the Code Official, or of a permit or certificate issued under the provisions of this code, shall be punishable by a fine of not more than five hundred dollars ($500.00) or by imprisonment not exceeding ninety (90) days, or both such fine and imprisonment. Each day that a violation continues after due notice has been served shall be deemed a separate offense.

Section 305.4, Freezing, is hereby modified, changed and amended, to read as follows: "A water, soil, or waste pipe shall not be installed outside of a building, or concealed in outside walls or in any place subject to freezing temperatures, unless adequate provision is made to protect such pipe from freezing by insulation or heat or both. Water service piping shall be installed below recorded frost penetration but not less than twenty-four (24) inches below grade."

Section 305.4.1. Insert: "24," "24."

Add new Section 403.2, Exception #7. Separate facilities shall not be required when the following conditions are met:
a. 
The structure is an existing structure or tenant space which is being remodeled or renovated; and
b. 
The total occupant load of the structure or tenant space, including both employees and customers, is seventy-five (75) or fewer; and
c. 
Food or beverage is served for consumption within the structure or tenant space; and
d. 
If liquor will be sold, the owner or tenant has a liquor license for a restaurant bar or new restaurant bar; and
e. 
The single restroom facility is handicapped accessible; and
f. 
Fewer than two (2) restroom facilities existed before the remodeling or renovation; or it is necessary to convert more than one (1) restroom facility to a single restroom facility in order to have one (1) restroom facility which is handicapped accessible.
12. 
Section 410.4, Substitutions, is hereby amended to read as follows: In other occupancies where drinking fountains are required, water coolers, bottled water dispensers, or break rooms with a kitchen sink shall be permitted to be substituted for the required drinking fountains.

Section 903.1.1. Insert: "12."

Add Section 1101.3 as hereby amended to read as follows: Storm water shall not be drained into sewers intended for sewage only. Sanitary sewer systems shall be designed, built, and maintained in such a manner to prevent all storm or ground water from draining, discharging or entering into the sanitary sewer system. Connection of sump pumps, foundation drains, yard drains, gutter downspouts and any other storm water draining receptacle(s) or system(s) are specifically prohibited from being connected to the sanitary sewer system.
Any person violating any of the provisions of this Article or of the code adopted in this Article shall be deemed guilty of an ordinance violation and upon conviction thereof shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned in the City or County Jail for a period of not exceeding ninety (90) days, or both such fine and imprisonment. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
