Certain documents, one (1) copy of which is on file in the office
of the City Clerk of the City of Higginsville, Missouri, being marked
and designated as International Swimming Pool and Spa Code, 2021 Edition,
as published by the International Code Council be and is hereby adopted
as the Swimming Pool and Spa Code of the City of Higginsville for
regulating and governing the design, construction, quality of materials,
erection, installation, alteration, repair, location, relocation,
replacement, addition to, use or maintenance of swimming pools and
spas as herein provided in the City of Higginsville and providing
for the issuance of permits and collection of fees therefore; and
each and all of the regulations, provisions, penalties, conditions
and terms of such International Swimming Pool and Spa Code, 2021 Edition,
published by the International Code Council on file in the office
of the City Clerk are hereby referred to, adopted and made a part
hereof as if fully set out in this Article.

That ordinances or parts of ordinances in conflict herewith
are hereby repealed.

A. The code adopted by Section
510.450 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding number of the International Swimming Pool and Spa Code, 2021 Edition, or where there is no corresponding Section in the code the following Sections shall be enacted as additions to the code.

In Section 101.1 and wherever the phrase "Name of Jurisdiction"
appears in the 2021 Edition of the International Swimming Pool and
Spa Code, it shall be deemed to mean the City of Higginsville.

Delete Section 103 in its entirety. Refer to Section 103 of
the International Building Code, 2021 Edition.
3.
Delete in its entirety Section 104. Refer to Section 104 of
the International Building Code, 2021 Edition.
4.
Delete Section 111 in its entirety. Refer to Appendix B of the
International Building Code, 2021 Edition.
5.
Delete Section 112 in its entirety. Refer to Appendix B of the
International Building Code, 2021 Edition.
6.
Delete Section 113.4 in its entirety, and add new Section 113.4
as follows:
Section 113.4: Violation Penalties. Persons who shall be found
guilty of violating a provision of this code, or failing to comply
with any of the requirements thereof, or who erect, install, alter
or repair any structure in violation of the approved construction
documents or directive of the Code Official, or of a permit or certificate
issued under the provisions of this code, shall be punishable by a
fine of not more than five hundred dollars ($500.00) or by imprisonment
not exceeding ninety (90) days, or both such fine and imprisonment.
Each day that a violation continues after due notice has been served
shall be deemed a separate offense.

Delete Section 114.4 in its entirety, and add new Section 114.4
as follows:
Section 114.4: Unlawful Continuance. Any person who shall continue
any work after having been served with a stop work order, except such
work as that person is directed to perform to remove a violation or
unsafe condition, shall be liable to a fine of not less than fifty
dollars ($50.00), nor more than five hundred dollars ($500.00), or
by imprisonment not exceeding ninety (90) days, or by both such fine
and imprisonment. Each day that a violation continues after due notice
has been served shall be deemed a separate offense.
8.
Add New Section 307.3 Dechlorination Required. All swimming
pool or spa water shall be dechlorinated before the water is discharged
from the pool or spa into the sanitary sewer system or stormwater
system. This Section applies to a public, privately-owned, subdivision-owned
or commercially-owned swimming pools or spas.
9.
Add New Section 307.4. Discharge Into Stormwater System. An
owner or operator of a swimming pool or spa that desires to discharge
water into the stormwater system shall direct the water to the street,
a stormwater inlet on the owner's property, or stormwater ditch
on the owner's property. The water shall be directed so as not
to create a nuisance or hazard in the right-of-way, or not to erode,
encroach upon, flow across or pond upon any adjoining property.
10.
Delete Appendix A in its entirety. Refer to Section 113 of the
International Building Code, 2021 Edition.
