A certain document, one (1) copy of which is on file in the office of the City Clerk of the City of Higginsville, being marked and designated as the International Fire Code, 2021 Edition, including Appendix Chapters B, C, D, E, F, and G, as published by the International Code Council, be and is hereby adopted as the Fire Prevention Code of the City of Higginsville in the State of Missouri; for the control of buildings, structures and premises as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Fire Code, 2021 Edition, are hereby referred to, adopted and made a part hereof as if fully set out in this Article, with the additions, insertions, deletions and changes, if any, prescribed in Section
510.290 of this Article.

Any and all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

A. The International Fire Code adopted by Section
510.270 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding number of the International Fire Code, 2021 Edition, or where there is no corresponding Section in the code the following Sections shall be enacted as additions to the code.

Section 101.1. Insert: "City of Higginsville."
2.
Delete in its entirety Section 102.8. Add new Section 102.8,
as follows: Subjects not regulated by this code. Where no applicable
standards or requirements are set forth in this code, or are contained
within other laws, codes, regulations, ordinances or bylaws adopted
by the City of Higginsville, compliance with the intent of this code
shall be determined by the Code Official for the necessary protection
of the health, safety and welfare of the residents of the City of
Higginsville. Nothing contained herein shall be deemed to adopt any
standard promulgated by any association or board that has contributed
to drafting of this code, unless such standard has been specifically
set forth herein. No standard of the National Fire Protection Association
is adopted by the City of Higginsville by implication.

Revise Section 103.1 General. The first sentence shall read:
The Department of Fire Prevention is established within the jurisdiction
under the direction of the Building Official, or his/her designee.
All references to "Fire Chief" in this Code shall be deemed to refer
to the Building Official.

Delete in their entirety, Sections 103.2 and 103.3.

Section A104.1 General. Add statement to the end of this Section:
Where the City of Higginsville has no City Fire Department under its
jurisdiction, the Building Official shall act as the Fire Code Official.
6.
Section 104.10 Fire Investigations. Replace: "Fire Code Official"
with "State Fire Marshall or his/her designee."

Delete Section 105.1.6.1.
9.
Add new Section 105.1.3.1 Fee Schedule. The fees for permits
referred to in Section 105.1.2 Item 1, Operational Permits, shall
be as prescribed by Resolution of the Board of Aldermen from time
to time. (Fees will be for selected items in Sections 105.5.1 thru
105.5.24.) The fees for permits referred to in Section 105.1.2 Item
2, Construction Permits, shall be as indicated in Section 109.2 of
the International Building Code.

Delete in its entirety Section 111 Means of Appeals. Refer to
Appendix B of the International Building Code, 2021 Edition.
11.
Delete Section 112.4 in its entirety, and add new Section 112.4
as follows:
Section 112.4 Violation Penalties. Persons who shall be found
guilty of violating a provision of this code or failing to comply
with any of the requirements thereof or who erect, install, alter
or repair any structure in violation of the approved construction
documents or directive of the Fire Official, or of a permit or certificate
issued under the provisions of this code, shall be punishable by a
fine of not more than five hundred dollars ($500.00) or by imprisonment
not exceeding ninety (90) days, or both such fine and imprisonment.
Each day that a violation continues after due notice has been served
shall be deemed a separate offense.
12.
Delete Section 113.4 in its entirety, and add new Section 113.4
as follows:
Section 113.4: Unlawful Continuance. Any person who shall continue
any work after having been served with a stop work order, except such
work as that person is directed to perform to remove a violation or
unsafe condition, shall be liable to a fine of not less than fifty
dollars ($50.00), nor more than five hundred dollars ($500.00), or
by imprisonment not exceeding ninety (90) days, or by both such fine
and imprisonment. Each day that a violation continues after due notice
has been served shall be deemed a separate offense.
13.
Add new last sentence to Section 114.1.1 Unsafe Conditions, which states: "If there is any conflict between this Fire Code and Chapter
505 of Title V of the Higginsville Code of Ordinances, the Higginsville Code of Ordinances shall apply."
14.
Add new Items A and B to Section 307.1.1 Prohibited Open Burning.
A.
|
Rubbish/waste consisting of combustible materials, including,
but not limited to, paper, cartons, rags, furniture/mattresses, and
like substances is prohibited. Burning of materials that produce heavy,
dark acrid smoke such as plastics, foam, styrofoam and similar petroleum-based
materials is prohibited.

B.
|
Open burning of hazardous and toxic waste is prohibited.

15.
Delete in its entirety, Exception #2 of Section 307.4.
16.
Add new Section 505.1.1. Address number size shall be increased
by a minimum of two (2) inches for each fifty (50) feet the building
is set back from the street, highway or road.
17.
Add new Section 505.1.2. If the building is not visible from
the street, highway or road, the address shall be posted at the intersection
of the driveway and the main road by separate signage. If separate
signage is used, numbers shall be installed so there is not less than
three (3) feet nor more than five (5) feet from ground level to the
numbers.
18.
Add new Section 505.1.3. If the property has a rear access drive
or road, the address shall be posted on the rear of the building or
at the roadway.
19.
Add new last sentence to Section 506.1. "To ensure compatibility
with our present key box system, the manufacturer shall be the 'KNOX
COMPANY'."
20.
Add new last sentence to Section 901.6.3. "Contractors who perform
inspection, testing and/or maintenance service on fire and lift safety
systems must submit those records of service to the Building Official."
21.
Add two (2) new sentences at the end of Section 907.2.11.6,
which state: "Batteries in battery-operated smoke detectors shall
be replaced at least once every twelve (12) months. Replacements shall
be dated, in a permanent fashion, when installed."
22.
Add new Section 907.6.6.4. Fire alarms that are not monitored
by a central station shall have each pull station, exterior horn/strobe
and water motor gong signed as follows: "Local Alarm Only, Call 9-1-1."
23.
Section 5601.1 Exception 4. Add new last sentence: "These activities
shall not take place within two hundred (200) feet of combustibles,
such as gasoline storage tanks or service station fuel dispensing
pumps."
24.
Section 5704.2.9.6.1 The storage of Class I and Class II liquids
in above-ground tanks outside of buildings is prohibited in the "SF-1,"
"SF-2," "SF-3," "MR," and "MHP" Zoning Districts in the City of Higginsville.
Exceptions: and/or as approved by the Fire Chief or his/her duly authorized
representative.
25.
Delete Section 5706.2.4.4 in its entirety. Insert new Section
5706.2.4.4 Location Where Above-ground Storage Tanks Are Prohibited.
The storage of Class I and Class II liquids in above-ground tanks
outside of buildings is prohibited in the "SF-1," "SF-2," "SF-3,"
"MR," and "MHP" Zoning Districts in the City of Higginsville. Exceptions:
and/or as approved by the Fire Chief or his/her duly authorized representative.
26.
Delete Section 5806.2. Insert new Section 5806.2 The storage
of Class I and Class II liquids in above-ground tanks is prohibited
in the "SF-1," "SF-2," "SF-3," "MR," and "MHP" Zoning Districts in
the City of Higginsville. Exceptions: and/or as approved by the Fire
Chief or his/her duly authorized representative.
27.
Delete in its entirety Section 6101.2 Permits. Add new Section
6101.2 Permit Required. A permit shall be obtained from the Fire Chief
for each installation of Liquefied Petroleum gas utilizing storage
containers in excess of one hundred twenty (120) gallons individual
water capacity; when installations of storage quantities exceed one
thousand (1,000) gallons, the installer shall submit plans, and a
copy of the State approved plans, if applicable, to the Fire Chief;
if compliance with the requirements of this code is shown by submitted
plans, a permit may be issued. Installations with an aggregate water
capacity in excess of two thousand (2,000) gallons will not be allowed,
unless approved by the Fire Chief, the Planning and Zoning Commission
and with final approval of the Board of Aldermen.
28.
Section 6104.2 The storage of liquefied petroleum gas is prohibited
in the "SF-1," "SF-2," "SF-3," "MR," and "MHP" Zoning Districts in
the City of Higginsville. Exceptions: and/or as approved by the Fire
Chief or his/her duly authorized representative.
Any person violating any of the provisions of this Article or
of the Code adopted in this Article shall be deemed guilty of an ordinance
violation and upon conviction thereof shall be fined in an amount
not exceeding five hundred dollars ($500.00) or be imprisoned in the
City or County Jail for a period of not exceeding ninety (90) days,
or both such fine and imprisonment. Each day such violation is committed
or permitted to continue shall constitute a separate offense and shall
be punishable as such hereunder.
