Certain documents, one (1) copy of which is on file in the office
of the City Clerk of the City of Higginsville, being marked and designated
as National Electric Code, 2020, issued by the American National Standard
Council with an effective date of August 25, 2019, be and is hereby
adopted as the Electric Code of the City of Higginsville for regulating
the design, construction, quality of materials, erection, installation,
alteration, repair, location, relocation, replacement, addition to,
use or maintenance of electrical systems in the City of Higginsville
and providing for the issuance of permits and collection of fees therefore;
and each and all of the regulations, provisions, conditions and terms
of such National Electric Code, 2020, on file in the office of the
City Clerk are hereby referred to, adopted and made a part hereof,
as if fully set out in this Article.

Any and all ordinances or parts of ordinances of the City of
Higginsville in conflict herewith are hereby repealed.

A. The National Electric Code, 2020, adopted by Section
510.300 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding numbers of the National Electric Code, 2020, or where there is no corresponding Section in the code the following Sections shall be enacted as additions to the code.
The following Sections are hereby revised:
1.
The City of Higginsville specifically adopts Annex H - Article
80 of the National Electric Code, 2020, titled, "Administration and
Enforcement" as amended herewith.
2.
Delete Annex H Section 80.2, Chief Electrical Inspector, and
Electrical Inspector. Refer to Section 103.1 of the International
Building Code.
3.
In Annex H Section 80.13(13), delete last two (2) words and
insert: "twenty-four (24) hours."
4.
Delete Annex H Section 80.15 in its entirety. Refer to Annex
B to the International Building Code, 2021 Edition.
5.
Delete Annex H Section 80.19(C)(1) in its entirety, and insert
new Annex H Section 80.19(C)(1), Work Exempt From Permit. "The following
work shall be exempt from the requirements for a permit. Repairs and
maintenance of existing approved installations of electric wiring,
equipment and systems, that are not in violation of the Electric Code
in effect at the time of the original installation." However, addition
to, alteration of, or relocation of any electric wiring, electrical
equipment, or electrical wiring systems shall require minimum plans
and a permit. Exemption from the permit requirements of this code
shall not be deemed to grant authorization for work to be done in
violation of the provisions of this code or other laws or ordinances
of this jurisdiction.
6.
Delete Annex H Section 80.19 D: Annual Permits.

Delete Annex H Section 80.19(E) in its entirety, and insert
a new Annex H Section 80.19(E): Fee Schedule. The fees referred to
in Section 404.1 shall be as indicated in Section 109.2 of the International
Building Code, 2021 Edition.
8.
In Annex H Section 80.19(F)(3), in last sentence delete the
blank space and word "days" and insert: "twenty-four (24) hours."
9.
Delete in its entirety Annex H Section 80.23(B) Penalties. Insert
a new Annex H Section 80.23(B) Penalties. Persons who shall be found
guilty of violating a provision of this code, or failing to comply
with any of the requirements thereof, or who erect, install, alter
or repair any electrical wiring or equipment in violation of the approved
construction documents or directive of the Code Official, or of a
permit or certificate issued under the provisions of this code, shall
be punishable by a fine of not more than five hundred dollars ($500.00)
or by imprisonment not exceeding ninety (90) days, or both such fine
and imprisonment. Each day that a violation continues after due notice
has been served shall be deemed a separate offense.
10.
In Annex H Section 80.25(B) Special Consideration. Change last
sentence to read: "The Building Official, or his/her authorized representative,
shall determine what needs are permitted under this provision."
11.
In Annex H Section 80.25(C) Notification. Insert the number
two (2) in blank space.
12.
In Annex H Section 80.25(E) Disconnection. In last sentence,
change to read: "— fifteen (15) business days or a longer period,
as may be specified by the Building Official. The Building Official
shall have the authority to cause the disconnection of that portion
of the installation that is not in conformity."
13.
Delete Section Annex H 80.27, Inspector's Qualifications,
in its entirety.
14.
In Section Annex H 80.29, Liability For Damages, insert the
word "City" in the blank space.
15.
In Section Annex H 80.35, Effective Date, insert "one-day" in
the blank space.
16.
Section 210.8.(A)(5) is hereby amended to read as follows: All
125-volt, single phase, 15- and 20-ampere receptacles installed in
unfinished basements shall have ground fault circuit interrupter protection
for personnel. For the purposes of this Section, unfinished basements
are defined as portions or area of the basement not intended as habitable
rooms and limited to storage areas, work area, and the like.
Exceptions:

Receptacles that are not readily accessible, such as a ceiling-mounted
receptacle for a garage door opener.
|
2.
|
A single receptacle supplied by a dedicated branch circuit that
is located and identified for a specific use by a cord and plug connected
appliance, such as a refrigerator, freezer, or sump pump.
|
3.
|
A receptacle supplying only a permanently-installed fire alarm
or burglar alarm.
|
17.
Add new last sentence in Section 230-32, which reads: "All unbreakered
or unfused service entrance conductors shall be protected by a minimum
of appropriately sized Schedule 40 PVC non-metallic conduit, from
the meter enclosure to the first main disconnect enclosure, with male
adapter, lock nut, and bushing to protect wire and insulation. Not
more than ten (10) feet of unbreakered or unfused service entrance
cable shall be used inside a building without an overcurrent protected
main disconnect."
18.
Add new Section 800.154(4), which reads: "For new installations
and modifications to existing installations, copper conductors shall
be, at a minimum, solid twenty-four (24) gauge or larger, four (4)
pairs for voice and data that comply with electrical specifications
for Category 5 wiring. All wire meeting this specification will be
marked "CAT5" or have a symbol consisting of the character "C" with
a "5" within the "C" character. Category 5 wire will have one (1)
of these indicators stamped once every twelve (12) inches along the
length of the wire."
Any person violating any of the provisions of this Article or
of the Code adopted in this Article shall be deemed guilty of an ordinance
violation and upon conviction thereof shall be fined in an amount
not exceeding five hundred dollars ($500.00) or be imprisoned in the
City or County Jail for a period of not exceeding ninety (90) days,
or both such fine and imprisonment. Each day such violation is committed
or permitted to continue shall constitute a separate offense and shall
be punishable as such hereunder.
