Certain documents, one (1) copy of which is on file in the office
of the City Clerk of the City of Higginsville, being marked and designated
as the International Energy Conservation Code, 2009 Edition, as published
by the International Code Council, be and is hereby adopted as the Energy
Conservation Code of the City of Higginsville for regulating the design,
construction, quality of materials, erection, installation, alteration,
repair, location, relocation, replacement, addition to, use or maintenance
of the building envelope, mechanical, lighting and power systems in
the City of Higginsville and providing for the issuance of permits
and collection of fees therefore; and each and all of the regulations,
provisions, conditions and terms of such International Energy Conservation
Code, 2009 Edition, published by the International Code Council, on
file in the office of the City Clerk are hereby referred to, adopted
and made a part hereof as if fully set out in this Article.

Any and all ordinances or parts of ordinances in conflict herewith
are hereby repealed.

A. The code adopted by Section
510.360 is hereby amended by substituting the following Sections or portions of Sections for those Sections or portions of Sections with corresponding number of the International Energy Conservation Code, 2009 Edition, or where there is no corresponding Section in the code the following Sections shall be enacted as additions to the code.

Section 101.1. Insert: "City of Higginsville."
2.
Revise Section 108.4 to read: Unlawful Continuance. Any person
who shall continue any work after having been served with a stop work
order, except such work as that person is directed to perform to remove
a violation or unsafe condition, shall be liable to a fine of not
less than fifty dollars ($50.00), nor more than five hundred dollars
($500.00), or by imprisonment not exceeding ninety (90) days, or by
both such fine and imprisonment. Each day that a violation continues
after due notice has been served shall be deemed a separate offense.

Add new Section 110.1 Violation Penalties. Persons who shall
be found guilty of violating a provision of this code or failing to
comply with any of the requirements thereof or who erect, install,
alter or repair any structure in violation of the approved construction
documents or directive of the Code Official, or of a permit or certificate
issued under the provisions of this code, shall be punishable by a
fine of not more than five hundred dollars ($500.00) or by imprisonment
not exceeding ninety (90) days, or both such fine and imprisonment.
Each day that a violation continues after due notice has been served
shall be deemed a separate offense.

Delete Section 109 in its entirety. Refer to Appendix B of the
International Building Code, 2021 Edition.

Delete Section 402.4.2 in its entirety.

Delete Section 404.2.2 in its entirety.

Delete Section 403.2.2 in its entirety.

Delete Section 403.9.3 in its entirety.

Delete Section 405 in its entirety.

The requirements of Section 505 and Section 506 shall be considered
"optional" and not "mandatory."
Any person violating any of the provisions of this Article or
of the Code adopted in this Article shall be deemed guilty of an ordinance
violation and upon conviction thereof shall be fined in an amount
not exceeding five hundred dollars ($500.00) or be imprisoned in the
City or County Jail for a period of not exceeding ninety (90) days,
or both such fine and imprisonment. Each day such violation is committed
or permitted to continue shall constitute a separate offense and shall
be punishable as such hereunder.
