This chapter is adopted in order to better ensure the safety of the residents of Pennsbury Township and to prevent the dangers caused by diseased or dangerous trees to the health, safety and welfare of the public or the right of the public to the unobstructed use of public roads or property.
This chapter applies to owners of property on which are located trees, the condition of which, through disease or otherwise, unreasonably affects or interferes with the health, safety or welfare of the public or the right of the public to the unobstructed use of public roads or property.
If the condition of the trees, through disease or otherwise, does unreasonably affect or interfere with the health, safety or welfare of the public or the right of the public to the unobstructed use of public roads or property, then the Board of Supervisors may give notice to the owner of the property on which the tree is located to cut and remove the tree. If within 30 days after the date of the notice by certified mail, return receipt requested, to remove the tree, the property owner has not complied with that order, the Board of Supervisors, or their agent, may enter the premises and remove the trees.
The cost of cutting and removal of the tree, or trees, by the Board of Supervisors, or their agent, shall be charged to the property owner. The charge to the property owner for each notice received in accordance with § 149-3 of this chapter shall not exceed $1,500. The charge shall be a lien against the real estate of the property owner and shall be collected in the same manner as other municipal liens.
