A. 
Any drain or conveyance, whether on the surface or subsurface, that allows any nonstormwater discharge including sewage, process wastewater, and wash water to enter a regulated small municipal separate storm sewer system, riparian buffers, wetlands, or to enter the surface waters of the commonwealth is prohibited.
B. 
No person shall allow, or cause to allow, discharges into a regulated small municipal separate storm sewer system, or discharges into riparian buffers, wetlands, or waters of the commonwealth, which are not composed entirely of stormwater, except:
(1) 
As provided in Subsection C below; and
(2) 
Discharges authorized under a commonwealth or federal permit.
C. 
The following discharges are authorized unless they are determined to be significant contributors to pollution of a regulated small municipal separate storm sewer system, riparian buffers, wetlands, or to other waters of the commonwealth:
(1) 
Discharges or flows from firefighting activities.
(2) 
Discharges from potable water sources including waterline flushing and fire hydrant flushing, if such discharges do not contain detectable concentrations of total residual chlorine (TRC).
(3) 
Noncontaminated irrigation water, water from lawn maintenance, landscape drainage and flows from riparian habitats and wetlands.
(4) 
Diverted stream flows and springs.
(5) 
Noncontaminated pumped groundwater and water from foundation and footing drains and crawl space pumps.
(6) 
Noncontaminated HVAC condensation and water from geothermal systems.
(7) 
Residential (i.e., not commercial) vehicle wash water where cleaning agents are not utilized.
(8) 
Noncontaminated hydrostatic test water discharges, if such discharges do not contain detectable concentrations of TRC.
D. 
In the event that the Borough or DEP determines that any of the discharges identified in Subsection C significantly contribute pollutants to a regulated small municipal separate storm sewer system or to the waters of the commonwealth, the Borough or DEP will notify the responsible person(s) to cease the discharge.
E. 
Nothing in this section shall affect a discharger's responsibilities under commonwealth law.
The following connections are prohibited, except as provided in § 441-37C above:
A. 
Any drain or conveyance, whether on the surface or subsurface, which allows any nonstormwater discharge, including sewage, process wastewater, and wash water to enter the separate storm sewer system and any connections to the storm drain system from indoor drains and sinks.
B. 
Any drain or conveyance connected from a commercial or industrial land use to the separate storm sewer system which has not been documented in plans, maps, or equivalent records and approved by the Borough.
C. 
Any drain or conveyance that delivers nonstormwater discharges directly into wetlands, riparian buffers, or other waters of the commonwealth.
D. 
The discovery of a prohibited discharge on a property that was previously inspected or issued a certificate of occupancy by the Borough shall not relieve the property owner from the responsibility of correcting the prohibited connection upon discovery of such prohibited connection.
A. 
Roof drains and sump pumps shall discharge to infiltration or vegetative BMPs whenever feasible and to the maximum extent possible, as determined by the Borough Engineer. Roof drains and sump pumps shall not be connected to streets, sanitary or storm sewers, or roadside ditches to promote overland flow and infiltration/percolation of stormwater.
B. 
Roof drains and sump pumps shall be considered in stormwater management calculations to demonstrate that conveyance and receiving facilities have adequate capacity.
C. 
The discovery of a prohibited connection of a roof drain or sump pump on a property that was previously inspected or issued a certificate of occupancy by the Borough shall not relieve the property owner from the responsibility of correcting the prohibited connection upon discovery of such prohibited connection, unless otherwise recommended by the Borough Engineer.
D. 
When it has been satisfactorily demonstrated by the applicant, to the satisfaction of the Borough Engineer, to be more advantageous to connect directly to streets or storm sewers or if an alternative connection is not feasible, or if the existing or a proposed connection is otherwise recommended by the Borough Engineer, connections of roof drains or sump pumps to streets or roadside ditches may be permitted upon the recommendation of the Borough Engineer, or in the case of a land development, by a waiver from Borough Council.
A. 
No person shall modify, remove, fill, landscape, or alter any existing stormwater control or BMP unless it is part of an approved maintenance program without the written approval of the Borough.
B. 
No person shall place any structure, fill, landscaping, or vegetation into a stormwater control or BMP or within a stormwater maintenance easement which would limit or alter the functioning of the stormwater control or BMP, in the sole discretion of the Borough Engineer, without the written approval of the Borough.
C. 
The discovery of an unauthorized alteration of a BMP on a property that may have occurred prior to the current landowner owning the property shall not relieve the current landowner from the responsibility of correcting the BMP so that the BMP operates according to the O&M plan or details in the SWM site plan.
