This article is adopted pursuant to the provisions of the Municipal
Home Rule Law of the State of New York.
The term of office of the elected Highway Superintendent shall be four years. Such four-year term shall apply to the person elected to such office at the biennial Town election to be held in November 2023 and to those elected thereafter, provided that a proposition submitted pursuant to §
30-17 below is approved.
This article is adopted subject to a mandatory referendum and
shall be submitted for approval of the qualified voters of the Town
of DeWitt at the general election to be held on November 8, 2022. A proposition in the following form shall be included
on the ballot at such general election, and the increased term of
office shall not take effect unless such proposition is approved by
a majority vote of the qualified voters voting thereon:
"PROPOSITION: SHOULD LOCAL LAW 1-2022, ENTITLED 'A LOCAL
LAW SETTING THE TERM OF OFFICE OF THE HIGHWAY SUPERINTENDENT TO FOUR
YEARS' BE APPROVED?"
This article shall supersede New York State Town Law § 24
relating to the term of office for Highway Superintendent of the Town
of DeWitt.
This article shall become operative immediately upon its passage
on November 8, 2022 and shall be effective upon filing in the office
of the Secretary of State, which shall take place within 20 days after
approval by the qualified voters of the Town of DeWitt.
