A certain document, three copies of which are on file in the office of the City Clerk of the City of Altoona, being marked and designated as the International Fire Code, 2018 Edition, including Appendix Chapters F, H, I (see International Fire Code, Section 101.2.1, 2018 edition), ("code") as published by the International Code Council, is hereby adopted as the Fire Code of the City of Altoona, Pennsylvania, regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of buildings and premises as herein provided; providing for the issuance of permits, licenses and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions and terms of said Fire Code on file in the office of the City Clerk of Altoona are hereby referred to, adopted, and made a part hereof as if fully set out in this chapter, with the additions, insertions, deletions and changes, if any, prescribed in §
358-2 of this chapter.
The following sections of the code are hereby revised:
A. In Section 101.1, Insert "City of Altoona."
B. Section 105.6.47 is hereby amended to delete the caption and introductory
sentence in its entirety and in its place shall appear the following:
105.6.47 Temporary membrane structures and tents. An operational permit is required to operate an air-supported temporary
membrane structure or a tent being used for a commercial purpose regardless
of size and for any other membrane structure or a tent having an area
in excess of 400 square feet (37 m2).
Exceptions remain unchanged from the Code.
C. Section 105.7.25 is hereby amended to delete the caption and introductory
sentence in its entirety and in its place shall appear the following:
105.7.25 Temporary membrane structures and tents. A construction permit is required to erect an air-supported temporary
membrane structure or a tent being used for a commercial purpose regardless
of size and for any other membrane structure or a tent having an area
in excess of 400 square feet (37 m2).
Exceptions remain unchanged from the Code.
D. Section 109.1 is hereby deleted in its entirety, and in its place
shall appear the following:
109.1 Board of Appeals. All appeals shall be made to the City of Altoona Code Appeals Board, as established by Ordinance No. 5421, adopted March 12, 1997, as amended, and as set forth in Chapter
15, §§
15-31 through
15-37, of the Altoona Code, as amended.
E. Section 109.2 remains unchanged.
F. Section 109.3 is hereby deleted in its entirety.
G. In Section 109.4, insert: "Summary offense; not more than $1,000
and not less than $50; 90 days."
H. In Section 112.4, insert: "$50; $1,000."
I. Section 106.1 is hereby deleted in its entirety, and in its place
shall appear the following:
A permit and/or license shall not be issued until the fees have
been paid, nor shall an amendment to a permit and/or license be released
until the additional fee, if any, has been paid. A fee may be charged
for any inspection by the Fire Code regardless of whether such inspection
results in the issuance of a permit and/or license.
J. Section 307.2. Insert the following language after the word "kindled"
in this section.
Exception. No permits for "container burning" will
be issued by the Fire Code Official.
K. At the end of Section 607, insert new Section 607.5, entitled "Certification
of Service Personnel for Commercial Kitchen Hoods." Section 607.5
shall read: "Service personnel providing or conducting maintenance,
inspections or cleanings of commercial kitchen hoods shall possess
a valid certificate issued by an approved governmental agency, or
other approved organization for the type of work performed."
The geographic limits referred to in certain sections of the
2018 International Fire Code are hereby established as follows:
A. In Section 5704.2.9.6.1 (geographic limits in which the storage of
Class I and Class II liquids in aboveground tanks outside of buildings
is prohibited): The City of Altoona.
B. In Section 5706.2.4.4 (geographic limits in which the storage of
Class I and Class II liquids in aboveground tanks is prohibited):
The City of Altoona.
C. In Section 5806.2 (geographic limits in which the storage of flammable
cryogenic fluids in stationary containers is prohibited): The City
of Altoona.
D. Section 6104.2. Within the limits established by law restricting
the storage of liquefied petroleum gas for the protection of heavily
populated or congested areas, the aggregate capacity of any one installation
shall not exceed a water capacity of 2,000 gallons (7570 L): The City
of Altoona.
