Highway safety shelters shall not exceed seven feet in width,
eight feet in length (depth), and seven feet in height and shall be
set upon and firmly anchored to reinforced concrete slabs at least
four inches thick. A mud-free approach from the side of the street
on which the shelter fronts to the shelter itself shall be installed.
The size of the shelter may be increased when:
A. School district officials indicate in writing that the shelter would
be too small for the number of students anticipated to occupy the
bus stop shelter and recommend erection of a larger shelter;
B. The size of the shelter is approved by both the School Board and
the Board of Supervisors.
Highway safety shelters shall in all cases be located on private
property; they shall not be located on property of any governmental
body or agency or of any nonprofit corporation.
No highway safety shelter shall be erected on private property
without the record owner or owners of such private property having
first granted permission in writing, authorizing the erection and
maintenance of the shelter thereon.
Highway safety shelters shall be erected only at locations designated
as official school bus stops by the Northwestern Lehigh School District.

Highway safety shelters erected between intersections shall be located at least one foot back from the legal right-of-way line of the street on which the shelter fronts. Highway safety shelters erected on street intersection properties where the side of the shelter is less than 50 feet from the legal right-of-way line of the street at the side of the shelter shall be set back at least 15 feet from the legal right-of-way lines of both streets. Shelters shall also be located at least 15 feet away from the side property line of the property on which the shelter is located unless the owner of the adjoining property grants written permission consenting to have said shelter placed closer than 15 feet from said side property line. Notwithstanding anything herein to the contrary, all highway safety shelters shall be located and set back so as to conform with the clear site triangle requirements of §
500-70 of Chapter
500, Zoning, of the Township of Weisenberg Code.
Highway safety shelters shall not bear advertising displays
or print of any sort.
Highway safety shelters shall at all times be properly maintained
and kept in repair by the owner thereof. They shall be kept clean,
free of papers and debris, and free of obscene writings and markings
on any part thereof.
No highway safety shelter shall be erected until the Weisenberg
Township Board of Supervisors shall have issued a permit authorizing
such erection. Application for such a permit shall be made to the
Township Manager. The application shall be accompanied by:
A. A copy of a written grant of permission signed by the owners of the
ground on which the shelter is to be erected authorizing such erection;
B. A picture or diagram of the proposed shelter indicating the dimension
thereof;
C. A plot plan showing the location of the proposed shelter on the private
property and indicating setbacks from road right-of-way and property
lines;
D. A certification from the School District officials indicating the
proposed shelter location is an official school bus stop;
E. A permit application fee to be established by resolution of the Board
of Supervisors.
Upon removal of any highway safety shelter, either voluntarily
by the owner thereof or upon order of the Board of Supervisors as
herein provided, the shelter shall be completely dismantled and/or
removed so that no part of the same remains at its former location
and the property on which it was located shall be restored to its
original condition, which shall include removal of the concrete slab
and permanent seeding of the ground as such condition existed immediately
prior to the time said shelter was erected.
Any ordinances and part of ordinances inconsistent herewith
be and the same are hereby repealed.
The provisions of this chapter shall become effective on the
fifth day following enactment.

Any person who violates or permits a violation of this chapter
shall, upon conviction in a summary proceeding brought before a Magisterial
District Judge under the Pennsylvania Rules of Criminal Procedure,
be guilty of a summary offense and shall be punishable by a fine of
not more than $1,000, plus costs of prosecution. In default of payment
thereof, the defendant may be sentenced to imprisonment for a term
not exceeding 90 days. Each day or portion thereof that such violation
continues or is permitted to continue shall constitute a separate
offense, and each section of this chapter that is violated shall also
constitute a separate offense.
