No person shall stop, stand or park any motor vehicle on the roadway
known as Route 863 from the point where Route 863 intersects with
Commerce Circle and southward a distance of 385 feet along the west
side of Route 863;
This subsection and Subsection B (related to prohibitions in specified places) do not apply to the driver of any motor vehicle which is disabled in such a manner and to such an extent that it is impossible to avoid stopping and temporarily leaving the motor vehicle in that position.
Except when necessary to avoid conflict with other traffic or to
protect the safety of any person or motor vehicle, or in compliance
with law or the direction of a police officer or official traffic
control device, the following prohibitions shall be in effect:
In addition to the general prohibitions in Subsection A, stopping, standing or parking a motor vehicle is expressly prohibited under the following circumstances:
On the roadway side of any motor vehicle stopped or parked at
the edge, or curb of Commerce Circle or of Route 863 from the point
where Route 863 intersects with Commerce Circle and southward a distance
of 385 feet along the west side of Route 863.
On any sidewalk of Commerce Circle or of Route 863 from the
point where Route 863 intersects with Commerce Circle and southward
a distance of 385 feet along the west side of Route 863.
On any crosswalk of Commerce Circle or of Route 863 from the
point where Route 863 intersects with Commerce Circle and southward
distance of 385 feet along the west side of Route 863.
Alongside or opposite any street excavation or obstruction which
would obstruct traffic of Commerce Circle or of Route 863 from the
point where Route 863 intersects with Commerce Circle and southward
south a distance of 385 feet along the west side of Route 863.
Within any intersection of Commerce Circle or of Route 863 from
the point where Route 863 intersects with Commerce Circle and southward
a distance of 385 feet along the west side of Route 863.
Editor's Note: Original Sec. 2B, prohibiting parking near fire hydrants, crosswalks, traffic control signals, and fire hydrants, which immediately followed this subsection, was repealed at time of adoption of Code (see Ch. 1, General Provisions, Art. I).
The general prohibitions outlined in Subsection A and B(1) are applicable to commercial, recreational or farm vehicles and/or equipment, whether attended or unattended.

Any person violating the provisions of this article shall be guilty
of a summary offense, and upon conviction before a Magisterial District
Judge shall be fined $50 plus costs of prosecution.

In addition to the penalties herein provided, whenever any police
officer finds an unattended motor vehicle in violation of any provisions
of this article, the officer may move the motor vehicle, or cause
the motor vehicle to be moved, or require the driver or other person
in charge of the motor vehicle to move the motor vehicle to a position
off the roadway where the motor vehicle will not interfere unduly
with the normal movement of traffic or constitute a safety hazard
or provide an annoyance to the residents living on or near Commerce
Circle or Route 863 from the point where Route 863 intersects with
Commerce Circle and southward a distance of 385 feet along the west
side of Route 863.
In addition to the penalties herein provided, whenever any police
officer finds an unattended motor vehicle in violation of any provisions
of this article, the officer may move or cause the vehicle to be moved
to the place of business of the operator of a wrecker or to a nearby
garage or other place of safety selected by the Township; if so moved,
the owner of said motor vehicle, if known, shall be notified in writing
of the fact of said removal, the place of deposit of said motor vehicle;
and that said motor vehicle may be reclaimed and surrendered upon
payment of towing and storage charges.
The provisions of this article are severable. If any section, sentence,
clause or phrase of this article shall be held illegal, invalid or
unconstitutional by any court of competent jurisdiction, such decision
of the court shall not affect or impair the remaining sections, sentences,
clauses or phrases of this article.
It is hereby declared as the intent of the Weisenberg Township Board
of Supervisors that this article would have been adopted had such
invalid or unconstitutional section, sentence, clause or phrase not
been included herein. Furthermore, it is the intent of this article
to be supplementary to and not contrary to any laws of the Commonwealth
of Pennsylvania or regulations of any of its executive agencies.
