This article shall be known and may be cited as the "Royal Oak
Farmers Market Historic District Ordinance."
The purpose of this article is to provide for the preservation
and/or rehabilitation of the building at the historic site of the
Royal Oak Farmers Market Historic District comprised of the market
building at 316 East Eleven Mile Road, in the City of Royal Oak, Michigan,
also known more specifically as: A Parcel of Land Being a Part of
Lots 1 Through 4, Part of Vacated Public Alley of 'Conner's Subdivision'
as Recorded in Liber 4 of Plats, on Page 75, Oakland County Records
and all of Lots 7 and 8 and Part of Lots 9, 10 and 18 of 'Assessor's
Plat No. 9' as Recorded in Liber 50 of Plats, on Page 3 Oakland County
Records and Part of Vacated Second Street All Being Part of the Northwest
1/4 of Section 22, Town 1 North, Range 11 East, City of Royal Oak,
Oakland County, Michigan and Being More Particularly Described as
Follows: Commencing At the Northwest Corner of Said Lot 1: Thence
South 89 Degrees 21 Minutes 00 Seconds East, 104.00 Feet to the Point
of Beginning: Thence Continuing South 89 Degrees 21 Minutes 00 Seconds
East, 152.50 Feet: Thence South 01 Degrees 19 Minutes 00 Seconds West,
266.00 Feet: Thence North 89 Degrees 21 Minutes 00 Seconds West, 152.50
Feet: Thence North 01 Degrees 19 Minutes 00 Seconds West, 266.00 Feet
to the Point of Beginning. Containing: 40,562 Square Feet or 0.93
Acres.
The Royal Oak City Commission determines that the property described above is eligible for local historic designation under the guidelines established by City of Royal Oak Code of Ordinances §
82-1, et seq., the Historic Preservation Ordinance.
The Royal Oak City Commission hereby designates the property described in §
82-101 as an historic district pursuant to City of Royal Oak Code of Ordinances §
82-1, et seq., the Historic Preservation Ordinance.
The owners of the properties or portions of the properties described in §
82-101 are required to apply for and obtain a certificate of appropriateness before commencing any work in the historic site. When considering an application, the Historic District Commission will be guided by the standards for rehabilitation set forth by the United States Secretary of the Interior at 26 CFR Part 67 and the City of Royal Oak Code of Ordinances §
82-13, et seq.
If any section, subsection, clause, phrase, or portion of this
article is for any reason held invalid or unconstitutional by any
court of competent jurisdiction, such portion shall be deemed a separate,
distinct, and independent portion of this article, and such holding
shall not affect the validity of the remaining portions of this article.
All proceedings pending and all rights and liabilities existing,
acquired or incurred at the time of this article takes effect are
saved and may be consummated according to the law in force when they
are commenced.
All ordinances or parts of ordinances in conflict with this
article are repealed only to the extent necessary to give this article
full force and effect.
This article takes effect 10 days after its final passage.
