As used in this chapter, the following terms shall have the meanings
indicated, except as specifically defined within the subsection:
BUILDING
An enclosed structure having a roof supported by columns
or walls, including mobile homes, whether movable or stationary.
BUILDING, ACCESSORY
A subordinate building, the use of which is incidental to
that of the main building on the same lot.
BUILDING, HEIGHT OF
The vertical distance from the average elevation of the finished
ground at the exterior walls of a building to the highest point of
the roof.
CARPORT
A permanent accessory structure or part of a main building
that is not fully enclosed, used for the storage of a motor vehicle.
DUMP
Any area used for the outdoor storage, keeping or abandonment
of junk or discarded materials, rubbish, trash, cans, bottles, garbage,
vehicles, machinery or parts.
DWELLING UNIT
A building, or portion thereof, providing complete living
facilities for one family, including permanent provisions for living,
sleeping, eating, cooking and sanitation, and in which not more than
two persons, other than members of the family, are lodged or boarded
for compensation at any one time.
FAMILY
One or more persons, related by blood or marriage, and with
not to exceed two boarders or roomers, occupying a dwelling unit as
a single, housekeeping unit.
GARAGE, PRIVATE
An accessory building or part of a main building used for
the storage only of motor vehicles as an accessory use.
HOME OCCUPATION
A customary use carried on for gain or as a hobby entirely
within a dwelling or within an accessory building by a member or members
of a family therein, and which is clearly incidental and secondary
to the residential use of the premises and does not change its character.
HOME PROFESSIONAL OFFICE
The office or studio of a physician, surgeon, clergyman,
architect, artist, engineer, attorney at law or similar professional
person, located in the dwelling of the principal practitioner, but
not including any display of such use outside the dwelling.
IMPROVED SURFACE
A surface of bituminous paving over a base course, Portland
cement concrete, brick or block designed for this use and laid over
a sand base, an oiled base course, or crushed rock, which provides
a stable, hard driving surface which resists rutting, is impervious
to erosion, does not result in blowing dirt or dust and the ponding
of water, and which eliminates the accumulation of dust, dirt and
mud, so to not drain onto neighboring property.
LOT
An entire parcel or tract of land occupied or to be occupied
by a main building and its accessory buildings, or by a group such
as a dwelling group or manufactured homes and its accessory buildings,
including the yards and open spaces required therefor by this chapter
and other applicable law.
MANUFACTURED HOME
A detached single-family dwelling unit designed for long-term
occupancy and containing sleeping accommodations, a flush toilet,
a tub or shower, and kitchen facilities, with plumbing and electrical
connections provided for attachment to outside systems, which unit
is mounted upon wheels or supports and capable of moving under its
own power or with the aid of another vehicle.
MOTOR VEHICLE
Any self-propelled land vehicle which can be used for towing
or transporting people or materials, including but not limited to,
automobiles, trucks, buses, motorized campers, and tractors.
NONCONFORMING BUILDING OR USE
A building or use, lawfully established prior to the effective
date of this chapter, or an amendment to this chapter, that does not
conform to the regulations of this chapter.
PUBLIC UTILITY
Any person, firm, corporation, municipal department or board
duly authorized to furnish and furnishing under public regulation
to the public electricity, gas, heat, power, steam, telephone services,
other communication services, video services, telegraph services,
transportation, or water.
RECREATION VEHICLE
A motor vehicle equipped with living space and amenities
usually found in a home.
SPECIAL NEEDS, HOUSING
Housing for people who have a physical or mental impairment
that substantially limits one or more major life activities, or who
has a history or record of such an impairment, or who is perceived
by others as having such an impairment.
STORAGE SHELTER
A temporary structure used to store automobiles and other
materials.
STRUCTURAL ALTERATION
Any change in or addition to the supporting members of a
structure, including any enlargement or extension of outside building
dimensions or building height or depth.
TRAVEL TRAILER
A vehicular portable structure designed as a temporary dwelling
for travel, recreation and vacation use, which does not fall within
the definition of "manufactured home."
USE, ACCESSORY
A subordinate use on the same lot with the principal use
and incidental and accessory thereto.
VISION CLEARANCE TRIANGLE
A triangle bounded by the intersecting street right-of-way
lines at a street intersection and a line connecting points on them
30 feet distant from their point of intersection.
YARD, FRONT
A yard extending across the full width of a lot whose depth
is the shortest distance between the front line of the lot and the
main building, including an enclosed or covered porch, provided that
the depth shall be measured from a future street line for a street
on which a lot fronts, when such line is shown on the district map
or on an adopted street map or is otherwise established.
YARD, REAR
A yard extending across the full width of a lot whose depth
is the shortest distance between the rear lot line and the main building.
YARD, SIDE
A yard between the side line of the lot and the main building
extending from the front yard to the rear yard whose width is the
shortest distance between said side line and the main building.
ZERO-LOT-LINE DUPLEXES
Horizontal (side-by-side) duplexes intended to be sold and
owned as separate residences, where the common wall between the units
is approximately perpendicular to the street right-of-way and is centered
in approximately the middle of a residential lot.
